Then determine whether the issue is web scraping, model training, fine-tuning, live retrieval, a generated output that reproduces your expression, or a copy hosted on a platform. The applicable law, your ownership documents and the remedy you want will determine whether an opt-out, rights reservation, complaint, licence discussion, takedown notice or legal action makes sense. No notice, watermark or metadata field guarantees removal from a model that has already been trained.
Start with a fact pattern, not an accusation
“AI used my work” can describe several technically and legally different events. Write down which one you can actually support:

- Crawling or dataset ingestion: a bot copied a page, image or file into a collection used for development.
- Training or fine-tuning: material was used to adjust model parameters. A trained model does not normally contain a simple, searchable folder from which one notice can delete a particular file.
- Live retrieval: a system fetched your current webpage or database in response to a prompt.
- A generated output: an image, passage, recording or video resembles or reproduces protected expression.
- A hosted copy: a platform is displaying or distributing a particular copy or output.
These categories can overlap, but the evidence and remedy are different. A platform takedown process may address a hosted copy; it does not decide whether the earlier training was lawful or force a provider to retrain a model.

Before asserting infringement, check assignments, employment agreements, commissioned-work terms, exclusive licences, publishing contracts, collective-management arrangements and joint authorship. You may own copyright while another party controls a particular licence or enforcement right. Keep the version of the work that was actually published, not only a later edit.

Preserve an unaltered evidence file
Make a dated folder and retain originals. Include:
- Source files, drafts, camera or recording metadata and creation dates.
- Publication timestamps, invoices, contracts, registration records and licence terms.
- Exact URLs, screenshots and archived copies of pages showing your work or a provider’s statement.
- The provider, model and version name, relevant dates, prompts, outputs and output settings.
- Emails, support tickets and any response from the provider or platform.
Record the date and time for each capture. Do not overwrite source files or crop screenshots so aggressively that context disappears. Evidence that identifies the work, the alleged use and your authority to complain is more useful than a general claim that a model “knows” your style.
Check what the provider discloses
Read the provider’s copyright policy, complaint channel, crawler or dataset information and any training-content summary for the named model and version. A disclosure can help you decide whether to ask a precise question or propose a licence, but it may not identify every work.
European Union training summaries
The European Commission requires providers of general-purpose AI models placed on the EU market to publish a summary of training content using its mandatory template. The summary is intended in part to help rights holders exercise their rights. It covers general data types, dataset sources and information about web-scraped material, including crawler names, collection periods, content descriptions and a list of the top 10% of scraped domains. For a small or medium-sized enterprise, the domain list is the top 5% or 1,000 domains, whichever is lower. These are source and domain disclosures, not a work-by-work catalogue.

Summaries should be updated at six-month intervals, or sooner when a materially significant further-training update requires it. The Commission’s FAQ, updated March 26, 2026, says the obligation applies from August 2, 2025. Providers of models placed on the EU market before that date should make corresponding summaries available by August 2, 2027. Check the current FAQ and the model’s update date because implementation details can change: European Commission training-content summary FAQ.
What a summary can and cannot establish
A listed crawler, dataset or domain can justify a focused inquiry, but its presence does not prove that your particular file was copied, that copying was unauthorized or that a model can reproduce it. Conversely, the absence of your domain does not prove your work was never obtained through another source. Ask the provider to identify the relevant source, collection period, model version and complaint route, and keep the reply with your evidence.
Know which law applies
Copyright, text-and-data-mining exceptions, contract terms and platform rules vary by country. Identify where you are, where the provider or platform operates, where the copying or output occurred and which contract governs access. Do not treat a rule from one jurisdiction as a global answer.

United States: fair use is a four-factor, fact-specific inquiry
U.S. fair use considers the purpose and character of the use, the nature of the copyrighted work, the amount and substantiality used and the effect on the potential market. The Copyright Office’s Fair Use FAQ explains the factors; none automatically decides an AI-training dispute. Commercial purpose, the use of highly creative material, extensive copying and market substitution may matter, but the result depends on the complete record.
The U.S. Copyright Office’s AI study page identifies Part 3, “Generative AI Training,” as a prepublication version released May 9, 2025. It is an agency analysis of training, licensing and liability questions, not a court judgment deciding a particular creator’s claim. The status page and report are available at copyright.gov/policy/artificial-intelligence/ and the Part 3 PDF. The Office received more than 10,000 comments by its December 2023 deadline; that number measures submissions to the study, not the prevalence of infringement or creator losses.
Generated outputs and human authorship in the United States
If your complaint concerns an output that resembles your work, separate the question of copying from the question of who owns the output. In its January 29, 2025 Part 2 announcement, the Copyright Office said an output can be protected where a human author determined sufficient expressive elements; prompting alone is insufficient, while AI assistance or AI material inside a larger human-authored work does not automatically bar protection. The announcement states: “Where that creativity is expressed through the use of AI systems, it continues to enjoy protection.” See the Office’s Part 2 announcement.

European Union: reservations operate within text-and-data-mining rules
EU AI Act Recital 105 explains that copyright-protected content generally requires rightsholder authorization unless an exception or limitation applies. It describes the text-and-data-mining exceptions in Directive (EU) 2019/790, including a reservation mechanism subject to conditions and a scientific-research qualification. It says that when a reservation has been expressly made in an appropriate manner, a general-purpose AI provider needs authorization to mine the reserved works. This is an EU framework, not a worldwide opt-out rule. Whether a reservation is appropriately expressed, who must receive it and what an exception permits depend on the applicable law and facts. A reservation also cannot reliably undo copying that occurred before it was served.

How to contact a provider effectively
- Identify yourself and your authority. Give your name, contact details, the rights holder and whether you own the rights or act for the owner.
- Describe the work precisely. Include title, URL, creation and publication dates, file hashes or other identifiers where useful, and the relevant contract or registration.
- Describe the suspected activity without overstating it. Say whether the evidence points to crawling, dataset inclusion, training, retrieval, an output or a hosted copy. Distinguish what you observed from what you infer.
- Attach focused evidence. Provide dated screenshots, source links, model and version details, prompts and outputs, and the provider statement that led to your inquiry. Keep originals and send copies.
- State the remedy you want. Ask for source information, a rights-reservation record, a licence discussion, removal of a specific copy, or another defined response. Request the applicable escalation route and expected response time.
- Keep the exchange professional and auditable. Save the sent message, attachments, delivery record and reply. Avoid claiming that infringement is established when the facts only show a possibility.
When a DMCA notice is appropriate
In the United States, Section 512 notice-and-takedown is aimed at specific allegedly infringing material hosted on a covered online service. The Copyright Office’s resources are at copyright.gov/512/. A notice generally must identify the copyrighted work, identify and locate the allegedly infringing material, provide your contact information, state a good-faith belief that the use is unauthorized and confirm, under penalty of perjury, that the information is accurate and that you are authorized to act.
Send the notice to the service’s designated agent and identify the exact URL or other location. A valid notice starts a statutory service-provider process; it is not a court decision. It does not determine whether ingesting the work for training was fair use, and it does not erase information already incorporated into model parameters. False material assertions can have consequences, so limit the notice to a copy or output you can identify and support.
Opt-outs, robots instructions and metadata: useful records, not guarantees
Where applicable law recognizes a reservation, use the method that law and the provider’s published process recognize, and preserve proof of what you served and when. A robots directive, metadata tag, watermark or site term may communicate your preference or help establish notice, but no source establishes that one mechanism binds every provider, reaches every dataset or works retroactively. Do not promise that it will remove a work from an already trained model.
If you need to protect unreleased material, restrict access under a contract that clearly addresses automated copying and training, and limit distribution to the people who need it. Contractual controls can be stronger than a public webpage signal, but their scope depends on the agreement and the parties bound by it.
When to involve a lawyer
Get advice before sending a high-stakes demand, accepting a settlement, granting a broad licence or filing suit. A lawyer can assess ownership, jurisdiction, fair use or text-and-data-mining exceptions, contract claims, evidence preservation and the remedy realistically available. A creator-rights clinic or intellectual-property attorney may be appropriate when the value, reputational impact or number of works justifies tailored advice.
For a U.S. work, the Copyright Office states that registration is required before the owner can file an infringement lawsuit. Registration does not guarantee victory, but filing requirements and timing can affect available remedies; check the current rules before relying on an older registration assumption. Other countries have different registration systems, prerequisites and damages rules.
A practical decision checklist
- Can you identify the work, the rights holder and the rights allegedly affected?
- Do contracts, licences or employment terms change who may complain?
- Do you have dated originals, publication records, URLs, screenshots and provider or model details?
- Is the issue ingestion, training, fine-tuning, live retrieval, a generated output or a hosted copy?
- Which jurisdiction and exception or limitation governs each activity?
- Does the provider publish a complaint route or, for an EU-market model, a current training-content summary?
- Is your goal information, a future rights reservation, a licence, removal of a hosted item or litigation?
- Would a lawyer review be proportionate to the financial and reputational stakes?
The strongest first move is usually disciplined documentation followed by a narrow, accurate request. That approach preserves options without assuming that every training use is lawful or every use is infringement.
