Communities can scrutinize a proposed data center’s power, water, infrastructure, environmental effects and public-service needs before key local decisions are made—and, where the law and negotiating position allow, seek measurable commitments. Start by establishing what is actually proposed, which approvals remain open and who has authority over each issue. Then require project-specific evidence, involve the relevant service providers and public agencies, and track any commitments in writing. The process, decision-makers and deadlines depend on the location and design; the Pennsylvania, New Jersey, Michigan, Maryland and Canadian guidance discussed below are examples, not universal rules.
1. Establish what is proposed and when decisions will be made
Before debating whether a project is beneficial or harmful, assemble a clear description of it. A data center’s demands and impacts depend on its size, design, cooling system, location and operations. A project’s initial public description may not answer the questions needed to evaluate it.

Build a project fact sheet
Ask the applicant and municipality for the site location, applicant and parent company, project phase, anticipated construction and operating schedules, stated electrical load, water and sewer plans, cooling approach, backup-power design, site plans and list of requested approvals. Distinguish what is proposed now from possible later phases or expansions.

Request the schedule for applications, hearings, public notices and decisions, and ask how residents can inspect applications and submit comments. The Pennsylvania Department of Community and Economic Development’s Pennsylvania Data Center Planning Toolkit is organized to help local officials move from an initial inquiry through zoning, permitting and long-term planning. There is no single deadline or approval sequence that applies everywhere: the municipality should identify the relevant local process, and state or other requirements may also apply.

Turn unanswered questions into a public record
Ask officials to identify what information is missing and whether the applicant must provide it before a decision. Keep comments specific: name the impact, ask for the evidence needed to assess it, and identify the decision or condition to which it relates. If a hearing is approaching, confirm any submission rules directly with the responsible office rather than assuming that an email, petition or informal conversation counts as a formal comment.
2. Map who has authority over each issue
A data center is not reviewed by one decision-maker. Land use, utility service, water resources, air emissions, construction, emergency response and taxes can involve different agencies and providers. Make an issue-by-issue list of the bodies that can approve, regulate, advise on or pay for each part of the project. Include local planning and zoning officials, municipal counsel, utilities, state environmental agencies and utility regulators where relevant.
Michigan’s official Data Centers information page illustrates this division: state agencies regulate matters such as water withdrawals, air emissions, wastewater, wetlands, construction and electric service, while local governments retain land-use and community-impact authority. That description is specific to Michigan; the allocation of powers in another state, province or municipality must be checked locally. A local land-use decision does not necessarily settle a separate utility or environmental approval, and the reverse is also true.
Ask each agency or provider to explain its role, the application or study it is reviewing, opportunities for public input and how its decision relates to other approvals. If authority is unclear, ask municipal counsel or the relevant agency to identify the governing process. Whether a government can deny or condition a project depends on applicable law, zoning, existing approvals and the facts of the proposal.
3. Request evidence that can be checked
Broad assurances such as “adequate capacity” or “minimal impact” are hard to evaluate without assumptions, dates and methods. Request written, project-specific information, and ask the applicant to distinguish firm commitments from forecasts. Innovation, Science and Economic Development Canada’s Responsible Data Centre Development Principles call for project-appropriate, independently verifiable information about power, water, infrastructure, sound and emissions, along with ongoing tracking of material commitments.

Information to request
- Electricity: expected and peak demand over time, anticipated load timing, connection plans, relevant interconnection or upgrade studies, proposed sources of power and reliability assumptions.
- Water and wastewater: water source, projected withdrawals and consumption, wastewater volumes and treatment plans, stormwater plans, cooling design and any drought or supply contingencies.
- Backup power and emissions: generator count, fuel and storage plans, expected testing and emergency operation, emissions assumptions, and any associated batteries or uninterruptible power supply equipment.
- Noise and site effects: a suitably scoped sound analysis at nearby homes or other sensitive locations, the equipment and operating assumptions used, and construction traffic and access effects.
- Community services: emergency response needs, fire-water demand, road and bridge effects, communications needs and construction logistics.
- Local benefits and costs: construction and permanent jobs by phase, the basis for tax projections, and expected demands on public services and infrastructure.
For each estimate, ask who prepared it, what project phase it covers, what assumptions it uses and whether the public can inspect supporting material. A projection should not be presented as a guaranteed benefit; a commitment should specify who is responsible for delivering it and how compliance will be checked.
4. Examine water supply and electricity costs with providers
Water and electricity impacts cannot be inferred from the label “data center.” Michigan notes that water use varies with facility size, cooling technology, electricity source and location, including indirect water use associated with electricity generation. Do not assume every project uses the same amount of water or needs the same permits. Ask for estimates specific to the design under review and examine both routine operations and less common conditions such as peak demand or drought.

Ask the water and sewer providers what capacity is available, whether the project would require upgrades, how those works would be funded, and whether other customers could be affected. Review withdrawals, actual consumption, wastewater, stormwater and the proposed cooling system as distinct questions. A withdrawal is not automatically the same as consumption: request the project’s definitions and accounting method.
Maryland’s Executive Order 01.01.2026.16 identifies adequate water without adverse effects, cooling alternatives including non-potable sources, and public disclosure of water-use and efficiency metrics as review considerations. Those are Maryland considerations, not requirements that automatically govern projects elsewhere. Ask the responsible local and state bodies which standards and permits apply to this particular site.
Electricity demand, grid work and who pays
Ask the utility to explain the proposed load, when it would occur, what connection work is required, what grid upgrades may be attributable to the project and how reliability is assessed. Then ask the relevant utility regulator or public utility commission how tariffs, cost allocation and ratepayer protections apply in that jurisdiction. A developer’s statement about paying for a connection does not, by itself, answer whether broader system costs could affect other customers.

Canada’s Responsible Data Centre Development Principles state that proponents must pay costs of connecting and serving projects, including directly attributable generation, transmission, substations and grid upgrades, proportionate to scale and impact. This is a Canadian policy statement; it must not be treated as the governing cost-allocation rule for a U.S. project. In Canada, ask which principles and local approval processes apply to the proposal; in the United States, obtain the applicable answer from the utility regulator and governing tariff or other relevant rules.
5. Test the proposal against local plans and alternatives
Compare the site and design with the comprehensive or master plan, zoning, infrastructure capacity, nearby homes and sensitive uses, and other feasible locations or layouts. The Pennsylvania toolkit identifies land use, zoning, infrastructure, fiscal impacts and legal considerations as local review subjects. Maryland’s executive order also considers consistency with local plans and zoning.
Ask whether the proposed use is allowed as of right, requires a zoning change or variance, or needs another local approval. Request maps and plans that make setbacks, access, buffers, drainage and nearby uses legible. If a project is inconsistent with a plan, ask the applicant and decision-makers to explain the claimed basis for proceeding and what alternatives were considered. A community may have limited leverage if key approvals are already in place; have jurisdiction-specific legal advice before assuming a particular condition or denial is available.
6. Bring public services and quality of life into the review
Engage municipal engineers, public works, electric and water or sewer utilities, fire officials, emergency responders, affected residents, community organizations, workers and local nonprofits early enough for their information to matter. New Jersey Economic Development Authority’s General Guidance recommends engagement with residents, community leaders, trades and nonprofits, and assessment of water, roads, bridges, communications and site-specific hazards.
Ask emergency and fire authorities to review access, fire-water supply and the site’s equipment and stored materials. Generators, fuel storage, batteries and uninterruptible power supply systems may create distinctive fire, electrical or hazardous-material response needs. The relevant authorities can identify training, equipment, access or coordination questions for the specific design; communities should not assume that a general site plan resolves them.

Noise, traffic and daily operations
Cooling equipment and generators are common potential noise sources. Michigan explains that effects depend on equipment, setbacks, barriers and operating practices, and that local governments can impose additional noise mitigation requirements. Request a study scoped to nearby receptors and realistic operating conditions, including relevant nighttime conditions. Discuss feasible operating limits, setbacks, barriers, monitoring, complaint response and enforcement with the body that has authority.
For construction and operations, ask about truck routes, work hours, road wear, emergency access and any changes expected at nearby intersections. Seek agency or provider review where a proposed demand falls within that body’s responsibility. Separate temporary construction impacts from ongoing operations in both analysis and any proposed agreement, because they may need different controls.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.7. Compare proposals on the same basis
If a community is considering more than one site, design or proposal, use common definitions and time periods. A comparison is misleading if one applicant gives peak load and another gives annual averages, or if water figures use different definitions. Record the source and assumptions for each entry, and mark information that has not been established rather than filling gaps with estimates.
| Comparison area | Questions to apply consistently |
|---|---|
| Electricity | What are peak demand and load timing? What grid work is identified, how is reliability assessed, and how are attributable costs allocated? |
| Water | What are the source, withdrawals, consumption, cooling method, wastewater plan and drought assumptions? |
| Environmental and service impacts | What are the noise, backup generation, emissions, traffic and emergency-response assumptions? |
| Land use and infrastructure | How does the proposal fit local plans, zoning and available infrastructure capacity? |
| Public costs and benefits | What construction and permanent jobs are projected, what tax contributions are expected, and what service costs may arise? |
| Accountability | Which promises are enforceable, what will be disclosed and monitored, and how do obligations cover expansion or decommissioning? |
These comparison dimensions recur in the Pennsylvania, New Jersey, Michigan, Maryland and Canadian guidance. The table is a way to organize local review, not a scoring system that determines whether a proposal should be approved.

8. Put negotiated commitments in measurable writing
Where local law and the community’s bargaining position allow, seek written terms based on identified impacts and public input, rather than relying on general promises. New Jersey’s guidance emphasizes grounding community-benefit discussions in an understanding of local resource impacts and engagement. Maryland’s executive order lists agreement subjects and features including noise, traffic, emergency services, reporting, remedies and decommissioning.
Best Value
Make a commitment verifiable
For each term, identify the responsible party, measurable standard, deadline, reporting method, independent verification if appropriate, enforcement body and remedy for noncompliance. Clarify how obligations apply if the project expands or ownership changes. Possible subjects in the official guidance include contributions to roads and water or sewer improvements, noise, lighting, traffic, air quality, buffers, emergency services, employment, reporting, decommissioning and periodic review.
Canada’s principles say: “Proponents must engage early and transparently with impacted local governments and Indigenous communities on data centre projects and respect local approval processes.” They also say proponents must pay costs of connecting and serving projects, including directly attributable generation, transmission, substations and grid upgrades, proportionate to scale and impact. These are statements in Canada’s principles and should be understood in that national policy context, not quoted as universal U.S. law.
Before signing or endorsing an agreement, have qualified counsel and relevant technical specialists review whether its terms are lawful, measurable and enforceable. An agreement is not a substitute for permits, regulatory review or public disclosure required under applicable law.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errors9. Keep a record and monitor performance
After approval, maintain a public-facing record of the project description, agency decisions, written commitments, reporting dates and responsible contacts. Ask what information will be reported during construction and operation, where it will be published, and who will respond if a limit or promise is missed. Canada’s principles call for ongoing tracking of material commitments; monitoring expectations and enforcement powers still depend on the applicable jurisdiction and instruments.
If a report changes an assumption—such as expected load, cooling approach, expansion schedule or backup equipment—ask the responsible agency whether the change requires a new review or public process. Residents can compare reported performance with the written baseline and raise specific discrepancies with the agency, utility or agreement administrator that has authority over the issue.
