What AI Regulation Could Learn From Nuclear Power Safety

AI regulation can adapt nuclear safety’s principles of clear responsibility, independent oversight, proportional controls, defence in depth, and emergency learning—without regulating every AI system as a nuclear facility.

AI regulation can learn from nuclear safety without treating every AI system like a nuclear facility. The most transferable lessons are clear operator responsibility, independent oversight, controls proportionate to risk, multiple safeguards, and tested incident response. They are governance principles—not a ready-made regulatory blueprint.

How nuclear safety divides responsibility

Nuclear safety separates the duties of the operator from those of the regulator. The operator carries primary responsibility for safety; the regulator sets requirements, checks compliance, and can enforce them. In the European Union, national regulators license installations where applicable, inspect, and enforce, while Member States retain ultimate responsibility for the safety of their nuclear installations. The European Nuclear Safety Regulators Group’s overview of nuclear safety describes this division and the role of defence in depth.

The IAEA’s GSR Part 1 (Rev. 1) sets out related requirements, including regulator independence, prime responsibility for safety, emergency preparedness, and the sharing of operating and regulatory experience. These are requirements for nuclear safety frameworks; they do not make the IAEA a general AI regulator.

Five lessons for AI oversight

1. Keep responsibility with the organization operating the system

Under IAEA requirements, safety responsibility rests with the person or organization responsible for a facility or activity. Oversight or assessment by another party does not replace that responsibility. Applied to AI, the policy lesson is to keep clear accountability with the organization deploying or operating a system, rather than treating regulatory approval or a third-party assessment as a transfer of duty. That is a proposal for AI governance, not a statement of existing AI law.

2. Make oversight independent and enforceable

A regulator needs enough independence to make safety decisions without undue influence from entities it oversees or from other interests. It also needs authority to inspect and enforce requirements. For AI governance, this points toward oversight institutions with clear mandates and practical enforcement powers, rather than relying only on voluntary commitments or assessments commissioned by the organizations being assessed.

3. Match controls to the system’s risk and significance

Nuclear regulation uses a graded approach: requirements reflect the risks involved, rather than applying every control uniformly. AI oversight can use the same proportionality principle, considering a system’s likely impact and safety or security significance. The IAEA’s 2025 publication on AI for nuclear power applications likewise discusses risk-informed requirements and stronger scrutiny for more significant systems. Neither source establishes a universal threshold for AI risk, so the criteria and consequences would need to be designed for the relevant uses.

4. Build several safeguards instead of relying on one

Defence in depth means that safety does not depend on a single protection working perfectly. If one layer fails, other layers should prevent an incident or limit its consequences. In AI systems, possible layers might include monitoring, cybersecurity, contingency procedures, redundancy, and separation from safety-critical systems. Which protections are appropriate depends on the deployment: a system that can affect essential services needs different fallbacks from a low-impact tool.

The IAEA’s Artificial Intelligence for Nuclear Power Applications discusses safeguards such as monitoring, cybersecurity, contingency planning, redundancy, isolation from safety-critical systems, and personnel training specifically for AI used in nuclear power applications. Those examples show how the principles can be applied in a high-consequence setting; they are not a complete checklist for every AI product.

5. Plan for incidents and learn from them

Nuclear operators and authorities are expected to prepare and test emergency plans. IAEA requirements also address timely response and learning from operating and regulatory experience. An AI framework could adapt the underlying practice through incident reporting, response exercises, and shared learning about failures and near misses. The reporting rules, thresholds, and response duties would need to fit AI systems and their varied uses.

Why AI should not simply be regulated like nuclear power

Nuclear safety provides useful governance models, but the analogy has limits. AI is used across settings with very different levels of impact, and systems can change quickly. A licensing model designed for high-consequence infrastructure may be suitable for some high-impact AI uses, but applying it identically to every system would not follow the risk-based logic of nuclear safety itself.

A 2024 scholarly comparison proposes international standards, independent supervision, response protocols, and international information-sharing as possible lessons from the IAEA’s nuclear framework. It also cautions that AI and nuclear power have different characteristics and risks, and that international harmonization may be slow or poorly suited to some national conditions. Licensing, inspection, and safety-case concepts should therefore be treated as options for governance—not proof that all AI should be licensed like a nuclear installation. See Park et al.’s 2024 comparison.

  • Who is accountable? Is responsibility assigned to the organization that operates or deploys the system?
  • Who oversees it? Can an independent regulator inspect compliance and enforce requirements?
  • Are controls proportionate? Do requirements reflect the system’s risks and potential impact?
  • What happens if a safeguard fails? Are there additional protections, monitoring, and workable fallbacks?
  • How are incidents handled? Are response plans tested, and can lessons be shared?
  • Does the model fit the context? Are licensing and other demanding controls reserved for uses where their benefits justify them?

The point is to transfer nuclear safety’s disciplined allocation of responsibility and layered risk management—not its institutional form wholesale. AI-specific rules still need to account for where systems are used, how they change, and what harms they can cause.
