It may be an online-native station, a traditional station simulcast online, or—depending on how the term is being used—an individualized service that selects audio for each listener. The key distinction is delivery: listeners receive the programming through an internet-connected device rather than only over the air.
What does “virtual radio station” mean?
“Virtual radio station” is a plain-language description, not a universally established legal category. A closely related term in UK law is “internet radio service.” Section 362BF of the UK Media Act 2024 defines it as a service, or a separable part of one, that provides programmes consisting wholly of sound, along with any ancillary services, for public reception by internet distribution. UK Media Act 2024, section 48.

In practical terms, a virtual station makes a programmed audio stream available online. Listeners can tune in using internet-connected devices such as computers, smartphones, and smart speakers; the FCC also describes other connected devices as routes to online audio programming. FCC 24-136.
What kinds of services can the term describe?
| Service type | Where the programming originates | Over-the-air broadcast? | How the stream is programmed |
|---|---|---|---|
| Internet-native station | Created for distribution as an online service. | No matching terrestrial broadcast is required. | Often a shared stream for listeners, though the exact format varies. |
| Online simulcast | A terrestrial station’s broadcast is retransmitted online. | Yes; the station also broadcasts over the air. | Generally mirrors the terrestrial content, although advertisements may differ. |
| Custom or personalized radio | An individualized system generates or selects a stream for a listener. | Not necessarily. | Can reflect an individual listener’s preferences rather than delivering one shared station stream. |
These distinctions are described in testimony submitted in a U.S. Copyright Royalty Board proceeding; the terminology is useful for explanation, not a universal legal definition. Copyright Royalty Board proceeding, Dkt. No. 19-CRB-0005-WR (2021–25).

Is an internet radio station the same as an online radio station?
Usually, yes. “Internet radio” and “online radio” commonly refer to audio programming delivered over the internet. Either may mean a station created for online distribution or a traditional station’s online simulcast. The words alone do not tell you whether the service also broadcasts terrestrially or personalizes its stream.
How is internet radio different from regular radio?
The main difference is the route the audio takes. A terrestrial station sends a broadcast signal for reception by a radio receiver within its coverage area. An internet station sends its audio through an online service, so listeners need an internet connection and a compatible connected device. A terrestrial station may use both routes by simulcasting its broadcast online.

Internet delivery does not automatically mean that a station is personalized. A station may provide the same scheduled stream to everyone; custom radio, by contrast, can tailor an individual stream to stated preferences.

Does a virtual radio station need a licence?
Requirements depend on the country and on what the service broadcasts. In the UK, Ofcom says, “We do not regulate online-only radio services, and so these stations do not require a licence from Ofcom.” That does not mean music can be played without rights: Ofcom says online stations playing music need relevant licences from PPL and PRS for Music, and directs operators to contact those organizations about requirements and costs. Ofcom: Radio broadcast licences—Internet radio. This UK guidance should not be treated as the rule in the United States or elsewhere.
