For EU users who need a stablecoin through a regulated crypto provider, USDC currently has the clearer MiCA-compliant issuance route. Circle says its French electronic money institution is authorised to issue USDC as an e-money token (EMT) in the European Economic Area. USDT has faced restrictions on services by EU providers and delistings at prominent exchanges following ESMA guidance. That does not mean every venue lists USDC, or that MiCA universally bans private possession or self-custody of USDT: check the provider, country and specific action you need.
What is the practical difference between USDC and USDT in the EU?
| Question | USDC | USDT |
|---|---|---|
| Issuer and MiCA position | Circle says its French EMI is authorised to issue USDC as an EMT under MiCA in the EEA. See Circle’s licenses disclosure and Circle France FAQs. | ESMA guidance treats EMTs from issuers not authorised under the relevant MiCA requirements as non-compliant for specified provider services. ESMA’s 2025 report records USDT delistings at prominent EU exchanges. |
| Access through providers | Clearer regulated issuance does not guarantee that a particular exchange or broker offers USDC in every country or for every action. | Access through regulated providers is constrained; venue policies and supported services vary. |
| What to check | Confirm the provider’s exact legal entity and authorisation, then check whether your account and country can buy, sell, trade, deposit, withdraw or exchange the specific token and network you intend to use. | |
The distinction is not simply “one coin is legal and the other is illegal.” MiCA addresses token issuance and crypto-asset services through separate rules, and a provider’s authorisation does not itself establish support for every token.

What MiCA compliance means here
Issuer authorisation is one check
MiCA classifies tokens referencing one official currency as e-money tokens. Its rules for offering an EMT to the public or seeking its admission to trading include issuer authorisation and a white paper, subject to the regulation’s terms and exceptions. Circle’s disclosures identify its French entity as an authorised electronic money institution issuing USDC as an EMT in the EEA. That is a statement about issuer and token issuance obligations, not a guarantee of availability on a particular platform or a claim that USDC is risk-free. The relevant legal text is Regulation (EU) 2023/1114.

Provider authorisation is separate
MiCA Article 59 generally requires a person providing crypto-asset services in the Union to be authorised as a crypto-asset service provider (CASP) or to operate under one of the regulation’s specified routes. Check the exact legal entity serving you, not just the exchange brand. ESMA’s MiCA register page can help identify authorised entities; the relevant national regulator’s register is also useful. A CASP authorisation does not mean the provider lists USDC, USDT, or any particular trading pair.

ESMA says the EU-wide CASP transitional period ended on 1 July 2026. A provider relying only on an expired transition should not be described as authorised. ESMA warns that clients of unauthorised providers do not receive MiCA safeguards, including protections for client assets. See ESMA’s April 2026 statement and June 2026 public statement.
Why EU providers restricted or delisted USDT
On 17 January 2025, ESMA and the European Commission published guidance on non-MiCA-compliant asset-referenced and e-money tokens. ESMA said national authorities should ensure CASPs complied with the restrictions as soon as possible and no later than the end of Q1 2025. Its statement expected trading platforms to stop making non-compliant tokens available for trading and addressed services such as receiving and transmitting orders, executing orders and exchanging crypto-assets. A longer sell-only period was contemplated to let investors liquidate or convert positions through the end of Q1 2025; that was a historical transition, not an ongoing general permission. Read the ESMA and Commission guidance and ESMA’s statement on services involving non-compliant tokens.

ESMA’s September 2025 risk report documented delistings of USDT by prominent EU exchanges following the guidance. It also recorded USDT’s relative share falling from 65% to 61% over the period it discussed; that is a dated market observation, not a current market-share figure or a measure of EU exchange access. See the ESMA Report on Trends, Risks and Vulnerabilities No. 2, 2025.

“Banned” is too broad for the evidence described here. The restrictions concern offers and services by providers, including trading availability for non-compliant tokens. They do not establish a blanket MiCA prohibition on every person privately holding or self-custodying USDT. The practical effect is that a regulated provider may not offer the service you want, and access differs across venues and countries. Do not assume that the ability to hold a token means an EU-regulated provider may facilitate every transaction involving it.

How to check whether you can use either token
- Identify the provider’s legal entity. Find the entity named in your account agreement or service terms, then check it against the ESMA MiCA register and the relevant national regulator’s register.
- Check the exact service and country. On the provider’s current asset or help pages, verify support for your country and account type, and separately check buying, selling, trading, deposits, withdrawals and conversions. A token being listed for trading does not prove deposits or withdrawals are open.
- Confirm the network. Check the exact blockchain network for deposits and withdrawals. Support for USDC or USDT on one network does not establish support on another. Do not transfer until the sending and receiving networks match the provider’s instructions.
- Check current restrictions before acting. Token support can change, and this article does not provide a live country-by-country provider matrix. Confirm the provider’s current status and terms immediately before placing an order or transferring funds.
How to interpret the market figures
Market size does not settle the compliance or access question. The ECB’s Financial Stability Review for May 2025 reported USDT at USD 149 billion market capitalisation and a 65% market share, and USDC at USD 62 billion and a 27% share. These are the ECB’s historical figures, not current October 2026 values and not EU-specific market shares. See the ECB review.
