Unemployment benefits are payments from a state unemployment insurance program for eligible workers; severance is a termination-related payment from an employer. They are not the same benefit, and getting severance does not have one nationwide effect on whether or when you can receive unemployment. State rules and the way the employer pays or describes severance matter.
Unemployment benefits and severance compared
| Question | Unemployment benefits | Severance |
|---|---|---|
| Who pays? | The state unemployment insurance program. | Your former employer. |
| Why is it paid? | Temporary support for unemployed workers who meet state requirements. | A termination-related payment, often based on tenure or an agreement. |
| What determines eligibility or amount? | State law, work and wage history, separation circumstances, and other state requirements. | An applicable employer agreement or other governing arrangement. |
| Can you receive both? | It depends on state law and how the severance is paid or treated. | It may affect unemployment eligibility or payment timing under state rules. |
| How is it taxed? | Generally taxable federally and usually reported on Form 1099-G. | Taxable and generally handled through payroll and reported as wages. |
Is severance required by law?
Federal wage law does not generally require employers to provide severance. The U.S. Department of Labor states, “There is no requirement in the Fair Labor Standards Act (FLSA) for severance pay.” Whether you are entitled to a payment may instead depend on a contract, severance plan, or other applicable arrangement. Review the documents from your employer for the amount, payment schedule, and any conditions.

Can you collect unemployment if you receive severance?
There is no universal yes-or-no answer. IRS guidance on reduction-in-force benefits says a person receiving severance may also be eligible for unemployment compensation, while noting that in most states unemployment is not payable while a former employee is receiving severance. That is a general federal summary; your state’s current rules determine your claim.

The federal guidance does not settle how each state treats those arrangements. Report the payment accurately and ask the state unemployment agency how it affects your eligibility, claim timing, and reporting obligations. Do not assume you must wait until severance payments end before filing; contact the agency promptly to learn what to do in your circumstances.

How unemployment eligibility and timing work
Unemployment insurance is a federal-state program administered through separate state programs. The U.S. Department of Labor describes benefits as for eligible workers unemployed through no fault of their own, as determined under state law, who meet other state requirements. States set eligibility rules, benefit amounts, and duration, including work and wage requirements and how separation circumstances are assessed.
The Department of Labor says a first benefit check generally takes two to three weeks after filing. This is an agency-wide estimate, not a guarantee for an individual claim. Benefits may last up to 26 weeks in most states, and additional weeks may be available in some circumstances; state rules determine the duration that applies to a claimant.

Where to file
File with the appropriate state unemployment agency. If you live in a different state from the one where you worked, or worked in multiple states, the Department of Labor advises contacting the agency where you now live for information about filing. Ask the agency how to report severance as part of your claim.
How severance and unemployment are taxed
Both severance pay and unemployment compensation are generally taxable for federal income-tax purposes. Employers generally process severance through payroll and report it as wages. Unemployment compensation is generally reported on Form 1099-G.
You can request federal income-tax withholding from unemployment compensation; IRS Publication 525 (2025) describes optional withholding at 10% when requested. You may instead need estimated tax payments, depending on your overall tax situation. Check the IRS instructions for the tax year involved and any applicable state tax rules.
