Does UAE law require exam data to stay in the country?
The UAE Government’s summary of Federal Decree-Law No. 45 of 2021 says the law applies to electronic personal-data processing inside and outside the UAE and sets requirements for cross-border transfers and sharing for processing. - List every item sent to the system: scripts, student identifiers, prompts, marks, feedback, and other attached information.
- Map where processing, storage, backups, support access, and any onward handling occur.
- Identify every subprocessor and whether it receives or can access student information.
- Check whether the school can remove identifying information before use. Do not assume that removing names alone makes a script anonymous.
The National Child Protection Policy in Educational Institutions applies to public and private educational institutions across the UAE, including remote learning, and identifies protection of confidential student information as an institutional duty. - Data and purpose: What files and fields are received, and are they used only to mark the school’s assessment or also for another purpose?
- Locations: Where are data processed, stored, and backed up? Where can support staff access them from?
- Subprocessors: Which other organizations handle the data, what do they do, and where does that handling take place?
- Retention and deletion: How long are scripts, prompts, outputs, and logs retained? How can the school request deletion, including from backups?
- Access and security: Who can access the information, under what controls, and what contractual commitments govern security and incident handling?
- Transfer terms: What transfer conditions and safeguards apply if any personal data are handled outside the UAE?
- Assessment controls: Can the school review outputs, correct errors, moderate marks, and retain an auditable record of decisions?
Have the school’s legal or data-protection adviser review the actual contract, configuration, and data map. A provider statement that data are “secure” or “hosted locally” is not, on its own, an answer to every question above.
Who should confirm the school’s requirements?
The applicable oversight can vary by emirate and school type. The UAE Government says the Ministry of Education oversees private-school registration except in Abu Dhabi, Dubai, and Sharjah, where ADEK, KHDA, and SPEA have roles. The Ministry describes its Student Assessment Policy Guide for academic year 2025–2026 as the official reference across UAE school levels. Its scope includes continuous, school-based, and centralized assessments and identifies moderation and quality-assurance mechanisms. Use AI as part of a school-governed assessment workflow, not as a substitute for the school’s accountability for marks. Before using the system, decide who reviews uncertain or disputed outputs, how marks are moderated against the school’s assessment standards, how errors are corrected, and who remains accountable for the final assessment decision.
