U.S. Work Visas Compared: H-1B, L-1, and O-1

H-1B is based on specialty-occupation employment, L-1 on a qualifying intracompany transfer, and O-1 on extraordinary ability. Here’s how to assess which route may fit.
Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

H-1B, L-1, and O-1 visas are built around different qualifications: a specialty-occupation job, a qualifying transfer within a related business, and extraordinary ability in a covered field, respectively. The right option depends on the proposed U.S. role, the worker’s background, and—especially for L-1—the employer’s corporate structure. Eligibility for one category does not establish eligibility for another.

How the three visa categories differ

These are temporary U.S. work classifications, not interchangeable labels for a skilled job. The central question is what legal basis supports the proposed employment. An employer’s need to fill a position, or a worker’s general qualifications, does not by itself establish that any one of the three categories applies.

As an Amazon Associate I earn from qualifying purchases.

Category Qualifying basis Key fit question
H-1B Specialty-occupation employment Does the proposed job qualify as specialty-occupation work, and can the employer petition on that basis?
L-1 Transfer from a qualifying foreign organization to a related U.S. organization Do the organizations have the required relationship, and does the employee meet the foreign-employment and U.S.-role requirements?
O-1 Extraordinary ability in a covered field Does the worker’s record potentially meet the extraordinary-ability standard for the relevant field?

USCIS describes Form I-129 as the form an employer uses to petition for a beneficiary to come temporarily to the United States to perform services or labor, or to receive training. The USCIS instructions dated January 17, 2025 identify H-1B with specialty-occupation employment and O-1 with extraordinary ability in fields including arts, sciences, education, business, and athletics. The category named on a petition matters: USCIS evaluates the eligibility requirements for the classification requested.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The distinctions also shape what an employer needs to establish. For H-1B, the core question is the specialty-occupation basis of the proposed work. For L-1, the relationship between the U.S. and foreign organizations and the worker’s qualifying history are central. For O-1, the question is whether the worker’s record meets the relevant extraordinary-ability standard. There is no one-size-fits-all comparison based only on salary, seniority, or how “skilled” a job sounds.

H-1B: specialty-occupation employment

What the category is for

H-1B is the option among these three whose defining basis is a specialty-occupation position. The employer petitions for the worker in connection with qualifying employment; the worker’s education or experience alone does not turn a job into a qualifying position. Conversely, a job title that sounds technical or professional is not, by itself, a determination that the position qualifies. The employer must make the case under the category’s requirements.

The USCIS materials cited here establish the category and provide historical context on its cap and duration, but they do not supply a complete current filing guide or resolve eligibility for a particular job. A worker and employer should assess the actual duties and petition evidence rather than rely on a title, a general claim that the work is highly skilled, or the fact that another employee received H-1B status.

Cap and duration figures: read them in context

USCIS’s FY 2023 H-1B report described an annual cap of 65,000 regular H-1B numbers and an additional 20,000 exemption for qualifying U.S. advanced-degree holders. The same report said H-1B admission is generally limited to six years and that an initial petition is generally approved for up to three years. These are report-era figures and descriptions—not confirmation of the current cap-season process, current filing dates, or how a particular person’s time in status is calculated.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Cap applicability, current registration or filing procedures, exceptions, and case-specific duration rules require current verification with USCIS. Do not use the FY 2023 report as a calendar for a later cap season or assume the general duration description settles every individual case.

L-1: transfer within a qualifying business

Corporate relationship and prior employment

L-1 is not simply a visa for a company moving any employee to the United States. The U.S. petitioner and foreign organization must have a qualifying parent, branch, affiliate, or subsidiary relationship, and the organizations must be doing business. The worker also must have qualifying employment abroad for at least one year during the three years preceding the petition. These requirements make L-1 particularly dependent on the employer’s structure and documented history.

That means an international brand name or offices in multiple countries are not enough, by themselves, to show that a particular transfer qualifies. The employer must be able to document both the qualifying corporate relationship and ongoing business activity, as well as the employee’s qualifying foreign employment. A proposed transfer needs to fit the rules, not just the company’s internal job title or relocation plan.

L-1A and L-1B are different role categories

  • L-1A is for an executive or manager. USCIS also provides for a foreign company to send an executive or manager to establish a U.S. office, subject to the applicable requirements.
  • L-1B is for an employee with specialized knowledge. The petitioner should explain what that specialized knowledge is and why it is needed for the proposed U.S. role.

The distinction is substantive: a transfer does not qualify merely because the worker is senior, experienced, or familiar with the company. The role and supporting evidence need to fit the requested L-1 category. USCIS notes that L-1B requirements differ from those of other classifications; meeting one visa category’s standard does not automatically satisfy another’s.

Evidence and new-office petitions

USCIS’s Policy Manual L-1 documentation guidance identifies several parts of the petition case: the qualifying organizations and their relationship, ongoing business activity, the employee’s qualifying role, and the required prior employment abroad. For L-1B, the employer should connect the explanation of the employee’s specialized knowledge to the U.S. position, rather than treating the employee’s company tenure as sufficient on its own.

A petition to establish a new U.S. office has additional requirements. USCIS guidance includes evidence of premises and the ability to support the proposed operation. An employer considering this route therefore needs to address both the employee’s eligibility and whether the planned U.S. business operation satisfies the requirements. A corporate connection alone does not answer those questions.

For a new-office plan, the practical review therefore extends beyond whether the worker is an executive or manager. The employer also needs to document the premises and demonstrate the ability to support the proposed operation. The cited USCIS guidance does not set out every new-office detail, so employers should confirm current USCIS requirements before relying on a particular business plan or filing strategy.

O-1: extraordinary ability in a covered field

O-1 is based on extraordinary ability in a covered field, with USCIS’s Form I-129 instructions identifying fields that include arts, sciences, education, business, and athletics. This is a distinct legal basis, not a synonym for being talented, highly educated, successful at work, or generally accomplished. A person’s record must potentially meet the extraordinary-ability standard applicable to the relevant field.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The USCIS Form I-129 instructions identify the broad category but do not, on their own, establish the detailed O-1 evidentiary criteria, initial period of stay, extension rules, or all permissible employer and agent petition arrangements. Those points should be checked against current O-1-specific USCIS guidance before anyone plans a filing. This comparison therefore cannot responsibly reduce O-1 eligibility to a checklist of achievements or present a stay limit that the cited material does not establish.

For that reason, the sensible first question is whether the person’s work falls within a covered field and whether their record warrants a focused review of the O-1 standard. Do not assume that a strong résumé, advanced degree, or successful career automatically answers that legal question. The cited USCIS materials do not support a complete comparison of O-1 evidence or timelines with the H-1B and L-1 categories.

Which route should you investigate first?

Use the following questions to screen which category may warrant closer review. They are not a legal eligibility test, and a “yes” does not predict approval.

  1. Is the U.S. position specialty-occupation work? If so, H-1B may be worth examining. Confirm the role’s fit and the current cap and filing rules rather than relying on historical figures or the job title alone.
  2. Is the move a transfer from a related foreign organization? If so, check the corporate relationship, the employee’s qualifying foreign employment during the required period, and whether the U.S. role is executive or managerial (L-1A) or involves specialized knowledge (L-1B).
  3. Could the worker’s record meet the extraordinary-ability standard? If so, review O-1 requirements for the particular field against current USCIS guidance. Do not substitute a general impression of professional distinction for the actual standard.

More than one category may be worth assessing when the facts support it, but each petition is judged under the classification requested. The employer’s willingness to sponsor, the worker’s credentials, the role’s duties, and the company’s international structure are separate facts; none should be treated as a substitute for the others.

A useful order of review is to start with the position and employer facts, then match those facts to the category. Ask whether the work appears to be specialty-occupation employment; whether a qualifying corporate transfer and required prior employment exist; and whether the worker’s record could meet the applicable O-1 standard. These are screening questions only. A case-specific determination requires reviewing the actual evidence and current requirements.

What the petition process does—and does not—decide

Employer petition and later travel steps

For these employer-petition classifications, Form I-129 is a central step. USCIS’s January 17, 2025 instructions describe it as an employer’s petition for a beneficiary to come temporarily to the United States for services, labor, or training. The petition asks USCIS to approve the requested classification based on the submitted case; it is not itself a visa stamp or a guarantee that the worker will be admitted.

USCIS’s FY 2023 H-1B report expressly notes that petition approval does not by itself guarantee visa issuance or admission. In practical terms, approval of the employer’s petition, issuance of a visa where required, and admission to the United States are distinct steps. A person should verify the appropriate next step for their location and circumstances with USCIS and the Department of State.

Information to assemble before a category-specific review

  • The proposed U.S. role and a clear description of its duties.
  • The worker’s background and the evidence relevant to the particular category being considered.
  • For a possible L-1 case, records showing the relationship between the U.S. and foreign organizations, their business activity, qualifying employment abroad, and the proposed U.S. role.
  • For a possible H-1B case, information needed to assess the specialty-occupation basis and the current filing context.
  • For a possible O-1 case, the worker’s field and record, evaluated under current O-1-specific evidentiary guidance.

This is a preparation list, not a substitute for category-specific legal advice. Fees, form editions, cap procedures, and adjudication guidance can change. Confirm current requirements with USCIS and, for visa issuance and travel questions, the Department of State before filing or making plans.

Check current USCIS fee information and any relevant Department of State charges immediately before filing or making a budget.

Family considerations for L-1 workers

USCIS employer guidance says an L-1 worker’s dependent spouse and children may seek L-2 classification. It also states that a spouse admitted with the L-2S class of admission is employment-authorized incident to status. That statement is specific to spouses admitted with the L-2S designation; it should not be extended to every dependent, every L-2 record, or family members in H-1B or O-1 cases. Verify the individual’s admission documentation and current guidance before relying on work authorization.

This is a relevant planning point for an L-1 household, but it is not a comparison of family benefits across all three categories. USCIS guidance supports the L-2 and L-2S details above and does not establish parallel family-work-authorization rules for H-1B or O-1 dependents. Check the specific family member’s status and current guidance rather than drawing a broader conclusion from the L-1 rule.

Common comparison mistakes

  • Treating all three as general “skilled worker” visas. H-1B turns on specialty-occupation employment, L-1 on a qualifying transfer and organization relationship, and O-1 on extraordinary ability in a covered field.
  • Assuming a strong worker profile fixes a weak job or employer case. The classification must fit the position and petitioning context, not only the beneficiary’s résumé.
  • Assuming L-1 is available whenever a company has offices in two countries. The qualifying relationship, business activity, prior employment, and role all require support.
  • Using historical H-1B figures as current instructions. The cap and duration details above come from a FY 2023 USCIS report, not a current-year cap-season announcement.
  • Calling O-1 a shortcut. Its broad label does not mean that ordinary professional competence or success automatically meets the applicable extraordinary-ability standard.
  • Equating petition approval with permission to travel or enter. USCIS petition approval does not itself ensure visa issuance or admission.
  • Assuming costs or procedures can be compared from a general chart. The available USCIS and Department of State information does not establish current comparable fees, current cap-season steps, or every category’s current form requirements.

Frequently Asked Questions

What is the main difference between H-1B, L-1, and O-1?

H-1B is based on specialty-occupation employment, L-1 on a qualifying transfer from a related foreign organization, and O-1 on extraordinary ability in a covered field. These are distinct legal bases; meeting one category’s requirements does not automatically meet another’s.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What does an employer need to show for an L-1 petition?

The employer generally needs evidence of a qualifying parent, branch, affiliate, or subsidiary relationship and ongoing business activity, along with the worker’s qualifying employment abroad for at least one year during the three years preceding the petition. The proposed U.S. role must also fit L-1A executive or managerial classification or L-1B specialized-knowledge classification. New-office petitions have additional requirements, including premises and the ability to support the proposed operation.

Does H-1B approval guarantee a visa or entry to the United States?

No. Petition approval, visa issuance where required, and admission are separate steps. USCIS’s FY 2023 H-1B report notes that petition approval does not itself guarantee visa issuance or admission.

Can an L-2 spouse work in the United States?

USCIS says spouses admitted with the L-2S class of admission are employment-authorized incident to status. Confirm the person’s admission documentation and current guidance; this does not mean every dependent or every immigration category has the same work authorization.

How much do H-1B, L-1, and O-1 filings cost?

Current USCIS fee information and relevant Department of State charges do not establish comparable current filing costs for all three categories. Fees can change, so check current USCIS fee information and any relevant Department of State charges before budgeting or filing.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The Bottom Line

Start with the legal basis each route requires: a qualifying specialty-occupation job for H-1B, a documented qualifying transfer for L-1, or a record that may meet the O-1 extraordinary-ability standard. The H-1B cap and duration figures cited here are from a FY 2023 USCIS report, not current filing instructions; current fees, procedures, and O-1 details also need verification. Petition approval is not itself a visa or a guarantee of admission, so confirm the next steps for the specific case.
