U.S. Work Visa Options for Tech Workers Facing Green Card Delays

A pending green-card case is not work authorization. Understand the separate rules for maintaining status, changing employers on H-1B, AC21 adjustment portability, L-1 transfers, and visa-number delays.
Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A delayed employer-sponsored green card does not extend your work authorization or create a new visa option. You must continue to qualify for your current status or qualify independently for another route. Depending on your circumstances, that could mean maintaining or extending your current status, changing employers through H-1B portability, using employment-based adjustment portability after the required period, or qualifying for an L-1 transfer within a related multinational company. Each route has different rules, and a pending green-card case is not permission to keep working.

What a green card delay does—and does not—mean

Permanent-residence processing and permission to work in the United States are separate issues. A pending immigrant petition or adjustment-of-status application does not, by itself, authorize employment. Your ability to work depends on a separate, valid basis, such as qualifying nonimmigrant status or employment authorization granted through an eligible filing.

The phrase “green card processing” can refer to different stages, including an employer’s immigrant petition, a labor-certification step, or an employee’s Form I-485 adjustment application. The stage matters: some job-change rules apply only after an I-485 has been pending for a specified period, while H-1B portability is a separate nonimmigrant process. Do not treat either rule as an automatic extension of your status or as permission to work for any employer.

USCIS and the Department of State describe the relevant rules, but no route can be selected from job title or industry alone. The details that may change the answer include your citizenship and country of chargeability, current status and expiration, employer and corporate structure, actual job duties, overseas work history, petition history, and the dates of your I-140 and I-485 filings. Review the rules with an immigration attorney before changing employers, traveling, or relying on a pending filing.

Route to investigate What it may address Key eligibility question Important limit
Maintain or extend current status Continued work authorization under your existing classification Do you still qualify, and can the relevant employer file or extend the required petition? A green card delay does not extend status by itself.
H-1B portability Starting with a new H-1B employer after a qualifying petition is filed Do your prior H-1B history and filing circumstances meet the portability rules? This is not a general job-change rule for all visa categories.
AC21 adjustment portability Changing to a qualifying job or employer while certain employment-based I-485 applications are pending Are the petition, waiting period, and new role covered by the rule? It does not authorize a move to any job and does not replace work authorization.
L-1 intracompany transfer Working in the United States for a qualifying related organization Do the employer relationship, overseas employment, and U.S. role qualify? It is not a route to an unrelated employer.
A different employment-based immigrant petition A potential permanent-residence strategy Do you meet the category’s requirements, including job-offer or labor-certification rules where applicable? An immigrant petition is not, by itself, immediate work authorization.

Can I keep working in the U.S. while my employment-based green card is delayed?

Only if you have an independent, valid basis to work. First identify exactly what currently authorizes your employment and when it ends. For many workers, the relevant questions concern the terms and duration of their nonimmigrant status, the employer named in the petition, and whether an extension or other filing is available. An immigrant petition’s pending status does not answer those questions.

Check the work-authorization document or status basis

Make a record of the expiration date and conditions attached to your current authorization. Check your approval notices and any employment-authorization document, if applicable, and confirm which employer and position are covered. Do not assume that a pending extension, an unexpired visa stamp, or an I-140 approval alone gives you permission to work; the relevant authorization and its terms need to be assessed for your particular case.

Ask the current employer about status maintenance

If you plan to remain in your existing role, ask the employer’s immigration team or counsel whether an extension or other filing is appropriate and when it must be made. The answer depends on your classification and petition history, not simply on the fact that the green card is delayed. Keep copies of filings and notices, and confirm any start or end dates before continuing work under a changed circumstance.

Can I change employers on H-1B while waiting for my green card?

Some H-1B workers may be able to begin work for a new employer after that employer files a qualifying Form I-129 under H-1B portability. USCIS describes this as an exception to the general requirement that a prospective employer follow the process for the relevant nonimmigrant category. It is not automatic, and an H-1B worker should not treat the green-card case as the basis for the move.

USCIS’s reference guide describes conditions that include prior lawful admission, timely filing before the prior authorized stay expires, and no unauthorized employment after admission and before the new petition is filed. Those conditions are not a substitute for checking current rules and the worker’s full petition and status history. See USCIS’s Nonimmigrant-Based Employment reference guide, and have qualified counsel assess eligibility and timing before you start.

What to confirm before starting with a new employer

  • Whether your H-1B status and prior admission history meet the applicable portability requirements.
  • Whether the new employer has filed the required petition and whether the filing and your authorized stay meet the relevant timing rules.
  • Whether any periods of unauthorized employment or gaps in status affect eligibility.
  • Whether the offered role and petition are consistent with the requirements that apply to your H-1B case.

A pending or approved employment-based immigrant petition does not make H-1B portability broader. If you are in a different status, do not assume the H-1B rule applies to you; the available evidence here does not establish a comprehensive comparison of every temporary visa category.

Can I switch jobs while my I-485 is pending?

Some employment-based adjustment applicants can use portability under the American Competitiveness in the Twenty-First Century Act (AC21), but the rule is limited. USCIS describes it for certain applicants with an approved EB-1, EB-2, or EB-3 immigrant petition and an I-485 pending for at least 180 days. The new job offer must be in the same or a similar occupational classification as the job associated with the underlying petition.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

That 180-day period is a condition for the covered portability provision—not a general waiting period after which a worker can take any job. USCIS identifies exceptions for adjustment applicants whose approved immigrant petition is based on extraordinary ability or a national interest waiver. If you request to transfer the adjustment application to a different employment-based category on the basis of a new I-140, USCIS says the 180-day portability clock begins again after that transfer request.

How to assess a proposed same-or-similar role

Compare the proposed position with the occupation connected to the approved petition. The job title alone may not settle the question: consider actual duties and the occupational classification. A move within the same employer can still raise a portability question, and a move to a different employer does not automatically qualify. Ask counsel to review the underlying petition, the I-485 filing and pending dates, and the new role before relying on AC21.

USCIS’s Policy Manual chapter on transfer of underlying basis explains the applicable framework. AC21 adjustment portability and H-1B portability address different matters: one concerns certain employment-based adjustment cases and qualifying job offers; the other concerns eligibility to begin with a new H-1B employer after a qualifying filing. Satisfying one does not establish the other or independently grant work authorization.

Can my company transfer me from an overseas office to the U.S.?

An L-1 intracompany transfer may be worth examining if the U.S. and foreign organizations have a qualifying relationship and the worker and proposed U.S. role meet the classification’s requirements. It is not a general option for joining an unrelated U.S. employer. A tech worker’s expertise or seniority, standing alone, does not establish eligibility.

USCIS describes requirements that include a qualifying organization with U.S. and foreign business presence, a qualifying relationship between the entities, and at least one year of full-time employment abroad for the qualifying organization within the relevant three-year period. The prospective U.S. role must primarily involve managerial or executive work or specialized knowledge. The petitioning employer must provide evidence supporting the petition.

What the employer and worker should examine

  • Corporate relationship: Establish how the U.S. and foreign entities are related and that the relationship meets the qualifying standard.
  • Prior employment: Document the required full-time work abroad and check the relevant three-year period.
  • U.S. duties: Describe the work the employee will actually perform and how it fits the managerial, executive, or specialized-knowledge category.
  • Supporting evidence: Work with the petitioning employer to assemble evidence for the organizational relationship, overseas employment, and U.S. role.

See USCIS’s Policy Manual chapter on L-1 documentation and evidence. Whether a particular software, engineering, or product role fits depends on the actual facts; a “tech worker” label is not an eligibility category.

Could a different employment-based immigrant petition help?

A new or alternative employment-based immigrant petition may be a long-term permanent-residence strategy, but it is distinct from obtaining temporary permission to work. The Department of State describes employment-based immigrant classifications and notes that some require labor certification and an employer-filed Form I-140. For EB-2, the general route involves a job offer and labor certification; a national interest waiver is available to applicants who qualify for that exception.

Whether another category is realistic depends on its legal requirements and the worker’s qualifications and circumstances. Changing or adding an immigrant-petition strategy does not by itself authorize an immediate employer change or continued employment. A new I-140 can also affect how an adjustment case is handled, including the AC21 portability clock in the transfer situation described above.

What happens if my priority date retrogresses?

Employment-based immigrant visa numbers are controlled by category and priority date, with chargeability also relevant. A date can move backward, or a category can become unavailable, when demand and annual limits require it. Retrogression may delay the point at which a visa number is available; it does not itself create or cancel temporary work authorization. Your separate status or employment authorization still needs to be valid.

The Department of State’s July 2026 Visa Bulletin warns that dates may retrogress and categories may become unavailable. It is a dated snapshot, not a forecast of the bulletin in effect now. At the time you make a decision or file, check the latest bulletin for your employment category and chargeability, and verify USCIS’s current instructions on which chart adjustment applicants may use for that month. Do not assume that a date shown in an older bulletin remains current.

How to organize the decision before changing jobs or traveling

Because the options rely on different facts, gather the relevant records before acting. A change in employer, job duties, status, or travel plans can have consequences beyond the green-card timeline. Use this checklist to focus a conversation with the employer’s immigration counsel or an independent immigration attorney.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Identify your current work basis. Record your classification, the employer and role covered, the expiration date, and any separate employment-authorization document or pending extension.
  2. Map the permanent-residence case. Find the immigrant category, I-140 approval status, priority date, I-485 filing date and current status, and any transfer or category-change request.
  3. Describe the proposed change. Write down the new employer, corporate relationships, duties, work location, and intended start date. For a possible L-1 transfer, include overseas-employment dates and the foreign and U.S. entities.
  4. Check visa-number availability. Consult the current Department of State Visa Bulletin for the relevant category and chargeability, then check USCIS’s adjustment-chart instruction for the filing month.
  5. Confirm the legal route and timing before acting. Ask counsel whether the facts support an extension, H-1B portability, AC21 adjustment portability, or L-1 petition, and what must be filed or approved before work or travel.
  6. Keep a dated record. Save notices, filings, job descriptions, authorization documents, and written advice. If the facts or proposed role change, reassess instead of assuming the earlier answer still applies.

Questions that cannot be answered from the job title alone

“I work in tech” is not enough information to identify a route. The same software engineer could have materially different options depending on current status, prior H-1B history, the employer’s corporate structure, the dates and status of the I-140 and I-485, and whether a proposed role is in the same or a similar occupational classification. Likewise, an employer’s willingness to sponsor does not establish that a worker meets a visa or immigrant-category requirement.

The rules described here cover selected pathways supported by USCIS and Department of State material: H-1B portability, AC21 adjustment portability, L-1 transfers, employment-based immigrant categories, and visa-number availability. They are not a survey of every nonimmigrant classification. Workers considering another category should verify its specific requirements through current official instructions and qualified counsel rather than assuming that rules for H-1B or L-1 carry over.
