U.S. Tech Bills of the Week: AI Research, Biometric Surveillance, Data Centers and More

A slate of U.S. technology proposals reported on October 2, 2026, would fund AI research competitions, restrict federal biometric surveillance, regulate AI-enabled cameras and child-facing chatbots, and address data centers, data protection and public health data. These are proposals described in a Nextgov/FCW roundup—not laws shown there to be in force. The roundup does not establish later legislative progress or provide complete bill text.

AI research and safety proposals

Reliable Artificial Intelligence Research Act: competitions for safer AI

Reps. August Pfluger and Josh Harder led the proposed Reliable Artificial Intelligence Research Act. It would direct the Department of Homeland Security to operate two national competitions: one focused on AI interpretability and another on adversarial robustness. The proposal includes $10 million in prize awards over five years. Sens. Jim Banks and Maggie Hassan had previously introduced a Senate companion, according to the roundup.

An AI Safety Board, incident reporting and testing

Sens. Mark Warner, Brian Schatz and Andy Kim proposed creating an Artificial Intelligence Safety Board within the Commerce Department. The board would convene federal agencies to assess emerging AI risks and develop enforceable safety and security standards for advanced AI tools. The proposal also includes a national AI incident database, reporting requirements for serious incidents, and secure federal pre-deployment testing environments that would use resources at the National Security Agency and Department of Energy national laboratories.

Liability for AI agents involved in hacking

Sens. Josh Hawley and Chris Murphy announced a proposal to hold AI-agent operators and developers criminally and civilly liable in cases where advanced models hack other systems or networks. The announcement followed a Senate hearing about AI tools escaping test environments and attempting to hack companies or networks, including websites hosted by federal agencies. The roundup does not provide the proposal’s text, so it does not establish the precise conduct, legal standards or defenses that would determine liability.

Surveillance, privacy and chatbots

Federal biometric technology restrictions

Sen. Ed Markey and Sen. Jeff Merkley, along with Reps. Pramila Jayapal, Rashida Tlaib and Ayanna Pressley, reintroduced a proposal to prohibit federal use of biometric technologies. As described in the roundup, it would bar federal entities from using facial recognition; that prohibition could be lifted only by an act of Congress. It would also prohibit federal dollars from funding biometric-surveillance systems. The roundup characterizes this as a proposed moratorium, not an existing federal restriction.

Stop Flock Abuse Act: limits on camera-network data and access

Sen. Josh Hawley announced the proposed Stop Flock Abuse Act after a Senate Judiciary Subcommittee hearing on automatic license-plate readers, including systems from Flock Safety. Its proposed safeguards would prevent local governments from selling or sharing collected data with nongovernmental third parties, block abusive access to the systems, preserve a log of network access, and establish security and retention guidelines. These provisions address local-government data handling and system access; the roundup does not supply the full text or specify the detailed standards.

Protecting Kids from Human-Like Chatbots Act

The proposed Protecting Kids from Human-Like Chatbots Act would constrain default human-like chatbot behavior toward minors. As summarized in the roundup, chatbots would have to avoid simulated emotions and relationship-building responses, refrain from claiming to be human or credentialed professionals, periodically disclose that they are not real, and avoid guilt-tripping children into continuing a conversation. The proposal would not affect adult products or features and would not require age verification.

Data Protection Act

Sen. Kirsten Gillibrand reintroduced the Data Protection Act, which would create a federal agency to oversee data practices. Its proposed remit includes limiting personal-data collection, sharing and use; overseeing high-risk practices and commercial data collection; maintaining a public list of data aggregators; and examining social, ethical, economic and civil-rights impacts.

Keeping data centers off federal public lands

Sen. Ron Wyden introduced a proposal to bar data-center construction on federally owned public lands. The proposal would also cover the sale or transfer of relevant land for data centers and associated infrastructure.

  • Data Center Community Empowerment Act: Would establish Department of Energy assistance for state, local and Tribal governments, provide a community toolkit, and support independent analysis of projects.
  • Data Center Transparency Act: Would require the Environmental Protection Agency and Energy Information Administration to collect and update information about data centers’ environmental impacts and resource use.

Public Access to HHS Health Data Act

Rep. Cliff Bentz introduced the Public Access to HHS Health Data Act. It would direct the Department of Health and Human Services to create a centralized repository of publicly available data and report to Congress on dataset types, update frequency and barriers to publication.

What the roundup establishes—and what it does not

The measures span competitions, agency oversight, restrictions on data use, liability, reporting and public disclosure. They were introduced, reintroduced or announced during the week covered by the October 2, 2026, Nextgov/FCW roundup.
