On April 23, 2024, it approved a “sale-or-ban” measure requiring ByteDance to complete a legally sufficient qualified divestiture of TikTok’s U.S. business or face restrictions on the app’s distribution, updates and hosting. President Joe Biden signed the package on April 24, 2024. The Supreme Court upheld the law’s constitutionality in January 2025, but successive presidential orders delayed enforcement. As of August 18, 2026, TikTok remains available in the United States under a newly announced U.S. joint-venture structure.
What the Senate actually passed
The Senate approved the TikTok provision as part of Public Law 118-50, a broader supplemental appropriations and foreign-aid package. The measure is formally called the Protecting Americans from Foreign Adversary Controlled Applications Act (PAFACAA).

Rather than making it illegal for individuals to watch TikTok, the law generally bars U.S. app stores and internet-hosting services from distributing, maintaining, updating or hosting a covered foreign-adversary-controlled application unless its owner completes a qualified divestiture. TikTok and ByteDance were expressly covered, along with certain related applications and entities.
That distinction matters. The law was designed to pressure a change in ownership and control. It did not order the government to confiscate phones, delete accounts or prosecute ordinary users for possessing the app.

The Senate vote followed an earlier House vote on March 13, 2024. Biden signed the revised package on April 24, 2024. The legislative sequence is documented by the Associated Press and the Congressional Research Service.
Why Congress acted
Lawmakers and national-security officials said ByteDance’s ownership and its potential obligations under Chinese law created risks involving U.S. user data and control over recommendation algorithms. They also raised the possibility that a foreign adversary could influence what Americans see or use data for intelligence purposes.
Those were the government’s stated concerns, not a judicial finding that TikTok had used its U.S. service to conduct prohibited surveillance or manipulate an election. Supporters and opponents disputed the evidence, the proportionality of the remedy and its effect on speech. The CRS overview describes the competing arguments.
The original deadline and the legal choice
PAFACAA provided a 270-day period after enactment for ByteDance to complete a qualified divestiture. That period reached January 19, 2025. The president could grant one extension of up to 90 days only after certifying that a qualified transaction was possible and that significant progress had been made. ByteDance therefore faced a statutory choice:
- Complete a qualified divestiture that removed foreign-adversary control and met the law’s operational requirements; or
- Leave U.S. app stores and hosting providers unable to continue supporting the covered application under the statute.
A qualified divestiture was more than selling a minority stake or changing an investor list. The law addressed continuing control and operational relationships, including arrangements involving recommendation technology and data sharing.

What the Supreme Court decided
On January 17, 2025, the Supreme Court rejected the First Amendment challenge brought by TikTok, ByteDance and related users. The Court accepted the government’s national-security rationale for purposes of the case and concluded that the law did not burden substantially more speech than necessary to advance that interest. The CRS summary explains the decision.
The ruling left the statute in place. It did not itself sell TikTok, transfer its ownership or permanently shut down the service. It also did not decide every future dispute over whether a particular transaction satisfies the law.
Why TikTok did not disappear permanently
Three separate questions are often collapsed into the phrase “TikTok ban”:

- Enforcement: whether the Justice Department pursued penalties against covered service providers.
- Availability: whether app stores, hosting companies and TikTok continued providing the service.
On January 20, 2025, President Donald Trump directed the Justice Department to refrain from enforcing the law for 75 days. Later orders extended the stated non-enforcement period, including delays announced for April 4, June 19 and September 17, 2025. The January order is at the White House; the later framework is in the September 2025 order.
A delay in enforcement did not repeal or invalidate PAFACAA. It changed the immediate practical risk for providers, allowing the app to remain available while negotiations and implementation continued. The statute’s primary enforcement target was the companies distributing or hosting the service, not users who simply had the app installed.

The proposed U.S. joint venture
On September 25, 2025, the White House said a proposed U.S.-based joint venture would qualify under the law, subject to implementation agreements. The administration described a structure with:
- U.S. persons holding majority ownership and control;
- ByteDance and its affiliates owning less than 20%;
- a new board of directors;
- U.S. control of algorithms, source code and content-moderation decisions;
- sensitive U.S. user data stored in a U.S. cloud environment; and
- trusted security partners monitoring software updates, algorithms and data flows.
These safeguards are the White House’s description and legal determination, not a blanket finding that every aspect of independence has been independently verified. Ownership, governance, algorithm control, data handling and continuing operational relationships must be considered separately. See the White House fact sheet and executive order.
TikTok USDS Joint Venture LLC announced that it was established on January 23, 2026. TikTok’s U.S. terms, last updated July 15, 2026, identify that entity as the U.S. platform operator. Those disclosures indicate that the U.S. arrangement is no longer simply the pre-law ByteDance-controlled structure, while not by themselves proving that ByteDance has no continuing technology, intellectual-property or commercial connection.

For users, the key point is that PAFACAA is not an account-level criminal ban. Continued access depends on the U.S. platform’s legal and operational status, provider support and the government’s enforcement posture.
Users may encounter revised terms of service, privacy notices, data-handling explanations or a different contracting entity. TikTok’s current U.S. terms identify TikTok USDS Joint Venture LLC as the operator.

Do not assume that every technical or corporate transition preserves drafts, direct messages, monetization balances or Shop activity identically. Save important videos and drafts outside the app, keep records of payments and sponsorships, and maintain another way to reach your audience. That is continuity planning—not evidence that another shutdown is imminent.
What creators and businesses should check
Creators
- Keep original video files and customer records outside TikTok.
- Build at least one alternative audience channel, such as a website, email list, YouTube or Instagram.
- Review sponsorship, payout, tax and creator-fund documentation for the named contracting entity.
- Do not assume followers, earnings or account access are automatically lost—or automatically transferred—without checking the applicable terms.
Advertisers
- Check whether new campaign contracts name TikTok USDS Joint Venture LLC or another entity.
- Confirm where campaign, conversion and measurement data are stored.
- Test pixels, measurement APIs, targeting, Shop integrations and creator-campaign workflows.
- Keep contingency budget for YouTube Shorts, Instagram Reels, Pinterest or other channels.
TikTok’s official advertising resources are available at ads.tiktok.com and TikTok for Business. Availability, approval, targeting and measurement terms can vary.
TikTok Shop sellers
Shop sellers should review current seller, payment, tax, fulfillment, returns and account-verification terms before committing inventory or advertising spend. TikTok’s notice says that, effective January 22, 2026, certain U.S. Shop contractual rights and obligations were assigned to BD TikTok USA LLC, also identified as TT Commerce & Global Services; it says no user action was required solely because of that assignment. Read the Shop notice for the scope of the change.
Practical failure points include a changed contracting entity, payment interruptions, revised product policies, altered customer support, or traffic changes if the app or recommendation system changes.
What remains unresolved
- Whether every implementation detail satisfies each statutory definition and operational-relationship restriction.
- How independently algorithm governance and software-update monitoring can be verified over time.
- What ByteDance’s remaining economic interest means in practice for technology, intellectual property and commercial relationships.
- Whether Congress will amend or repeal PAFACAA. Repeal is legally possible, but no repeal is established here.
- Whether a future administration will change enforcement policy.
A U.S. operating company is not automatically synonymous with complete technological or corporate independence. The legal status can remain settled enough for service to continue while implementation details and future policy remain contested.
