Find and replace yours safely.Free scan · under a minuteThe federal guidance behind this article does not establish that AI mortgage tools rig rates in general, and it does not show that any particular borrower paid more because of an algorithm. It does establish narrower points that matter for a buyer. Lenders that use complex models must still give accurate, specific reasons for adverse decisions. Fair-lending rules cover mortgage terms as well as approvals. Comparison platforms can have financial conflicts that shape which lender appears first. Risk-based pricing is lawful even though it means different people receive different rates. “Rigged” is a claim to test, and most of the testing comes down to documents you can request and comparisons you can make yourself.
Three places AI can touch your mortgage rate
When someone says an AI tool is rigging a mortgage rate, they may mean one of three different things. Each has different rules and different ways for a borrower to check it, so it helps to keep them apart.

Lender underwriting and pricing models
Lenders use algorithmic models to decide whether to approve an application and on what terms. These models weigh the borrower’s creditworthiness together with loan characteristics such as loan amount, loan type, and down payment. Federal guidance confirms that lenders use algorithmic underwriting. It does not describe how any named lender builds its model, and it does not say whether any lender uses AI to set the rate for an individual borrower.
Automated property valuation models
Automated valuation models estimate what a home is worth. That estimate feeds the loan-to-value figure a lender uses in its decision. The federal sources reviewed for this article do not address how valuation models affect pricing, so a claim that valuation software sets your rate should be treated as unverified until a lender or regulator documents it.

Online comparison platforms
Comparison sites rank or present lenders and offers. This is the mechanism where federal guidance identifies a specific conflict risk: a platform’s ranking can be shaped by which lenders pay it or send it business. Unlike the first two, this one is visible on the screen, which makes it the easiest to check.
Will I have to pay more for my mortgage loan?
You may, and a higher rate by itself is not evidence of wrongdoing. The FTC describes risk-based pricing as offering different rates or terms based on creditworthiness. A lender that quotes a higher rate to a borrower with a weaker credit profile is using a factor that federal guidance does not, by itself, treat as illegal discrimination.

The line that matters is different. Under the Equal Credit Opportunity Act (ECOA) and the Fair Housing Act, creditors may not impose different terms, such as higher rates or fees, on the basis of protected characteristics. The FTC’s consumer guidance says these rules apply to the people involved in granting credit or setting terms, not only to the person who takes your application. The useful question is therefore not “Is my rate higher?” but “Is the difference explained by my credit and my loan, or by something the law does not allow a lender to use?”
Risk-based pricing also carries its own notice requirement. When information in a consumer report leads to materially less-favorable terms, specific notice requirements can apply. Such a notice is a starting point for the questions below, not a finding of discrimination.

What a lender owes you when it says no or offers less
Using complex technology does not reduce a lender’s obligation to explain an adverse action. In its September 19, 2023 release, CFPB Director Rohit Chopra said: “Creditors must be able to specifically explain their reasons for denial. There is no special exemption for artificial intelligence.”
In practice, the notice must give accurate, specific principal reasons. CFPB guidance says this holds even when the decision relied on machine learning or another model that is hard to interpret. A lender cannot satisfy the requirement by pointing to a generic checklist of factors or by saying its model is too complicated to explain.

When you reject an offer, and when you accept one
If a lender offers less favorable terms than the ones you applied for, FTC consumer guidance says you may request the specific reasons if you reject those terms. The FTC describes that right as not applying in the same way if you accept. Timing therefore matters: ask for the reasons before you sign.

If you are denied or receive an adverse action notice
- Read the notice and confirm it lists specific reasons, not only a broad category or a list of factors the model considered.
- Compare those reasons with what the loan officer told you. If they conflict, write down both versions and when you heard each one.
- Keep the application, the notice, every written offer, and any emails or messages about the decision.
- If the reasons appear generic or do not match the lender’s explanation, contact the CFPB or another appropriate regulator and bring your records.
How comparison platforms can tilt what you see
A comparison platform is where a ranking can most directly shape your choice. In a February 7, 2023 CFPB release on mortgage comparison platforms, Director Chopra said: “Given the rise in mortgage interest rates, it is even more important for homebuyers to shop and compare loan offers.”

- Automatic Tax Keys.
- Selectable decimal setting.
- Input any three loan variables to compute the fourth.
The CFPB’s guidance under the Real Estate Settlement Procedures Act (RESPA) gives examples of conduct that may violate existing law. Two apply directly to a results page:
- presenting a lender as the best option because it pays the platform more; and
- manipulating a ranking formula to favor providers in which the platform has a financial stake.
These examples describe potential conduct. The CFPB did not conclude that every paid listing or referral relationship is unlawful. A platform that clearly explains how lenders are selected and ranked gives you something you can check. One that does not leaves you unable to judge the order you see.
Questions to ask about any comparison site
- Does the site say whether lenders pay for placement or referrals, and whether that affects the order of results?
- Is a lender labeled “best” or “recommended,” and does the site say what that label is based on?
- Does the site show offers from lenders that did not pay it, or only from those that did?
Compare offers on the same terms
Federal guidance encourages shopping and negotiation, but the material reviewed does not supply a full line-by-line checklist for comparing lender offers. The table below lists the axes that most often make two headline rates incomparable. Two offers with the same interest rate can cost different amounts if their points, fees, loan terms, or lock assumptions differ.
Quick wins for a faster PC:
Repair Windows errors before they cause bigger problemsFix Now →Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →| Comparison axis | Why the headline rate can mislead | What to write down for each offer |
|---|---|---|
| Loan amount and down payment | A rate quoted on one loan amount or down payment is not directly comparable with a rate quoted on another. | Loan amount, down payment, and the property value used |
| Loan type and term | A fixed-rate loan and an adjustable-rate loan, or a 15-year and a 30-year term, are different products even at similar rates. | Loan type, term, and whether the rate can change |
| Points and lender credits | Paying points can lower the rate, and lender credits can raise it. The rate alone hides which trade-off applies. | Points paid or credited, in dollars and as a percentage of the loan |
| Fees and closing costs | Two offers can share a rate and still differ in charges. | Origination and third-party fees, taken from the Loan Estimate if one has been issued |
| APR | APR is designed to reflect the cost of credit including certain fees, which makes it a better comparison point than the rate alone. | APR as stated on each lender’s disclosure |
| Rate lock | An unlocked rate can change before closing. The lock period determines how long a quote holds. | Whether the rate is locked, the lock length, and the expiration date |
Ask each lender three questions and record the answers in writing:
- Is the rate you quoted a personalized estimate, and what assumptions does it use?
- Is the rate locked? If so, for how long, and what happens if closing is delayed?
- What points or fees come with the rate?
What if I think I was discriminated against?
Separate two situations. One is a rate that is higher than you expected, which may be explained by lawful pricing factors. The other is a term set because of a protected characteristic, which is what ECOA and the Fair Housing Act prohibit. A single comparison of offers cannot tell you which one happened.
Quick Recap
- Preserve the evidence: quotes, written offers, Loan Estimates, notices, and any messages in which the lender described your terms. Keep the records listed earlier as well.
- Collect other written offers for the same loan amount, loan type, and down payment. A difference that persists across several lenders is more informative than a difference with one.
- Ask the lender for the specific reasons for any less-favorable term, in writing.
- Check the current CFPB and FTC guidance, and consult a qualified attorney or housing counselor about your situation.
What these sources cannot tell you
- The CFPB statements quoted here are dated February 7, 2023 and September 19, 2023. Agency guidance is revised over time, so check the CFPB and FTC websites for current versions before relying on any specific rule.
- The sources covered here are U.S. federal materials. State rules, which can add requirements, are not addressed.
- No source establishes how often AI tools affect mortgage pricing or how much they change borrower costs. Any figure offered for that should be traced to its original study and publication year.
- Federal guidance does not establish that a named lender, platform, or valuation vendor uses an AI system to set rates. Ask the lender directly and read the platform’s own disclosures.
- This article cannot say whether any quote you received was lawful. That depends on your application and on current law, and a rate comparison does not guarantee a legal outcome.
