Stake.us in Oregon: What State Law Says About Legality and Access

Oregon’s 2025 DOJ opinion says ordinary gambling games do not escape the state’s gambling definition just because they are online. It does not decide Stake.us’s status or confirm Oregon access.

Is Stake legal in Oregon, and can you play Stake.us in OR? Oregon law can treat chance-based games involving something of value and a possible prize as gambling, even when played on a website or app. But the Oregon authorities cited here do not specifically decide whether Stake.us’s current sweepstakes model is legal or confirm whether Oregon residents can access it. Check Stake.us’s current Oregon eligibility rules, and do not treat the “sweepstakes” label by itself as a legal answer.

How Oregon defines gambling

Oregon Revised Statutes section 167.117(7) defines gambling around three elements: a person stakes or risks something of value on a contest of chance or a future event outside that person’s control, under an understanding that someone may receive something of value depending on the outcome. The Oregon Department of Justice describes the test in those terms in its 2025 Opinion OP-8297.

  • Value is risked: The player puts something of value at stake.
  • Chance or an uncontrolled event matters: The result depends on chance or a future event outside the player’s control.
  • Something of value may be received: The player understands that an outcome can result in something of value for someone.

Whether a particular product meets that definition depends on how it actually works, including its payment or token arrangements, gameplay, prizes, and redemption mechanics. The name a platform gives its product does not resolve those legal questions.

What Oregon’s 2025 DOJ opinion says about online games

Opinion OP-8297 addresses sports betting, fantasy sports, esports, and traditional games offered through websites or applications. It says traditional games such as poker, blackjack, and slot machines are not exempt from Oregon’s gambling definition simply because they are provided online. In the opinion’s short answer to whether those traditional forms are exempt when offered through a website or application, the DOJ answers: “No.”

The opinion explains how Oregon law applies to the types of products and questions it addresses; it is not a ruling on Stake.us. It does not establish that every sweepstakes or social game violates Oregon law, nor does it determine Stake.us’s legal status. The Oregon State Lottery is treated separately under a statutory exemption.

Does that make Stake.us illegal in Oregon?

Not on the evidence of this opinion alone. The Oregon sources discussed here establish a general legal test and explain that online delivery does not automatically remove traditional gambling games from that test. They do not specifically name Stake.us or decide whether its current product satisfies the statutory elements or qualifies for an exception.

A platform-specific assessment would need to consider the current product’s token purchases, chance-based play, prizes, and redemption options, as well as any applicable law or exception. A “sweepstakes” or “social game” description alone is not enough to settle the question.

Can you play Stake.us in OR?

Current Stake.us access rules for Oregon were not confirmed in the official sources cited here. Check Stake.us’s current eligibility terms or contact the platform for its position on Oregon residents. Do not assume a site is legally available just because it loads, and do not bypass location controls or other access restrictions.

For a firmer answer about legality, the relevant information would be a current statement from Stake.us on Oregon eligibility and legal advice that examines the product’s present mechanics under Oregon law. Neither a current platform statement nor a Stake.us-specific legal determination is established by the sources cited here.

Oregon licenses do not create blanket online-casino permission

Oregon’s Secretary of State Business Xpress directory describes a Social Gaming License for games between players in a private business, club, or place of public accommodation; it says the game is authorized only after obtaining that license. That specific licensing description is not a general authorization for an online casino.

The directory also lists an Online Wagering Management license administered by the Oregon Racing Commission within pari-mutuel rules and wagering. Its existence does not show that Stake.us holds a license or that its product falls under that regime.

An August 2023 Oregon Secretary of State audit report noted that gambling technology had evolved faster than state law and described a Racing Commission licensee offering online games with casino-like interfaces. That is regulatory context, not a legal determination about Stake.us or a blanket approval of similar platforms. The report is available from the Oregon Secretary of State Audits Division.
