Section 73 and Section 74 address the same broad types of GST demand—tax not paid or short paid, erroneous refunds, and input tax credit wrongly availed or utilised—but they apply on different factual grounds. Section 73 is used when the shortfall is for a reason other than fraud, wilful misstatement or suppression of facts to evade tax. Section 74 is used when the demand is alleged to arise because of one of those fraud-related grounds.
That distinction affects the limitation period, the minimum notice lead time and the reduced-penalty payment options. The comparison below follows the sections 73–75 text and guidance published by the Central Board of Indirect Taxes and Customs (CBIC). For a particular financial year, especially periods potentially affected by Section 74A, verify the version of the Act and commencement notifications before relying on any deadline.

Section 73 and Section 74 at a glance
CBIC’s GST FAQ on demands and recovery gives the basic test: Section 73 applies without invocation of fraud, suppression or misstatement, while Section 74 applies when those grounds are invoked. The table shows the principal differences in the CGST Act text consulted.
| Issue | Section 73 | Section 74 |
|---|---|---|
| Statutory ground | Tax or ITC demand for reasons other than fraud, wilful misstatement or suppression of facts to evade tax. | Demand said to be by reason of fraud, wilful misstatement or suppression of facts to evade tax. |
| Demand types | Tax not paid or short paid, erroneous refund, or ITC wrongly availed or utilised, where the specified fraud-related ground is not invoked. | The same demand types where the specified fraud-related ground is invoked as the reason. |
| Order period in the consulted Act text | Three years from the due date for the annual return for the relevant financial year, or three years from the date of an erroneous refund. | Five years from the due date for the annual return for the relevant financial year, or five years from the date of an erroneous refund. |
| Minimum notice lead time | Notice at least three months before the Section 73 order deadline. | Notice at least six months before the Section 74 order deadline. |
| Payment after notice | Tax and interest paid within 30 days of notice: no penalty is payable and proceedings in respect of that notice are deemed concluded. | Tax, interest and a 25% penalty paid within 30 days of notice: proceedings are deemed concluded, subject to the statutory conditions. |
| Pre-notice route | Tax and interest may be paid before notice; the cited provision does not specify a Section 73 penalty for that route. | Tax, interest and a penalty equal to 15% of the tax may be paid before notice. |
| After an order | The consulted material does not provide a comparable reduced-penalty percentage for a post-order Section 73 payment. | Tax, interest and a penalty equal to 50% of the tax may close the matter when paid within 30 days of communication of the order, subject to the statutory conditions. |
| If the fraud-related ground fails | Section 75(2) treatment can govern the redetermination, making the Section 73 limitation period important. | The Section 74 basis may fail; the matter is determined as if a Section 73 notice had been issued. |
These are statutory comparison points, not a ruling on whether any individual notice is valid. The governing period, amendments, exclusions, court orders and the evidence in the case can change the result. The official Act text is available from CBIC’s CGST Act publication.

What Section 73 covers
The non-fraud route
Section 73 is the recovery route when the department says GST was not paid, was paid short, an amount was refunded erroneously, or input tax credit was wrongly availed or utilised, but the reason is not fraud, wilful misstatement or suppression of facts to evade tax. A calculation mistake, an incorrect tax treatment, a classification dispute, a reconciliation difference or an ineligible credit claim can fall into this route when the facts do not support the specified fraud-related allegation.
Section 73 does not mean that the taxpayer automatically wins or that no penalty can ever be involved. It means the demand is being pursued under the statutory provision designed for cases without the Section 74 ground. The officer still has to establish the tax or credit amount, interest and any amount legally payable under the relevant order.
The demand must fit one of the listed situations
The provision is not a general power to reopen every GST issue without a defined shortfall. The notice should identify the tax not paid or short paid, the erroneous refund, or the input tax credit allegedly wrongly availed or utilised, along with the period, calculation and legal basis. A taxpayer should reconcile the notice with returns, invoices, electronic liability and credit ledgers, refund applications and payment records rather than treating the section number as the whole case.

The fraud-related route
Section 74 applies when the demand is stated to be by reason of fraud, wilful misstatement or suppression of facts to evade tax. The phrase matters: a large amount, an error or a disputed credit does not automatically become fraud. The department must connect the alleged conduct to the unpaid or short-paid tax, erroneous refund or wrongly availed or utilised ITC.

Examples that may lead an officer to consider Section 74 include deliberately concealed turnover, fabricated or knowingly arranged documents, or an intentional statement said to have been made to evade tax. Those are illustrations of the type of allegation, not conclusions about any taxpayer. Whether the statutory ground is actually established depends on the notice, evidence and adjudication.
An allegation is not a finding
A show-cause notice may use words such as fraud, suppression or wilful misstatement. That wording starts the Section 74 process; it does not by itself prove the required ground. The taxpayer can challenge both the underlying tax computation and the factual and legal basis for the fraud-related allegation. The order must address the response and the evidence instead of treating the label in the notice as conclusive.
How to classify a fact pattern
Use the following sequence when a notice or audit communication arrives:
- Identify the demand. Is the department alleging unpaid or short-paid tax, an erroneous refund, or ITC wrongly availed or utilised?
- Read the stated reason. Look for an express allegation that the amount arose through fraud, wilful misstatement or suppression of facts to evade tax.
- Test the connection. Check whether the notice explains how the alleged conduct caused the particular tax or credit difference. A bare assertion may be contestable.
- Separate error from intent. A transposition, classification disagreement or failed reconciliation may support a non-fraud explanation, while knowingly concealed transactions may be relied on for a Section 74 allegation.
- Check the financial year and event date. The relevant annual-return due date or erroneous-refund date controls the starting point used in the consulted provisions.
- Check the statute in force. Amendments, special extensions, stays and the possible operation of Section 74A can affect which provision and deadline apply.
| Illustrative situation | Likely analytical question |
|---|---|
| A return contains an underpayment caused by a disclosed calculation or classification position. | Does the notice identify evidence of fraud, wilful misstatement or suppression to evade tax, or is this a Section 73 dispute? |
| Input credit is disputed because invoices, supplier data or eligibility records do not reconcile. | Is the difference an eligibility or documentation issue, or does the department allege intentional fabrication or concealment and support it? |
| Turnover is said to have been deliberately kept out of returns. | What evidence links the omission to an intention to evade tax, and has the notice calculated the resulting demand? |
| A Section 74 case reaches appeal and the fraud-related ground is not established. | Section 75(2) requires determination as if the notice had been issued under Section 73, so the shorter limitation period becomes decisive. |
Limitation periods and notice timing
Section 73 calculation
In the Act text consulted, the order under Section 73 must be issued within three years from the due date for furnishing the annual return for the financial year to which the demand relates. For an erroneous refund, the period is measured from the date of that refund. The notice must be issued at least three months before the applicable order deadline.

Section 74 calculation
Section 74 uses five years from the relevant annual-return due date, or five years from the date of an erroneous refund, in the consulted text. The notice must be issued at least six months before the corresponding order deadline. The longer period is not a free-standing extension for every disputed amount; it is tied to a demand pursued on the Section 74 ground.
Why conversion can defeat a late notice
Section 75(2) says that when an appellate authority, tribunal or court finds the fraud, wilful-misstatement or suppression ground unestablished, the tax is to be determined as if the notice had been issued under Section 73. CBIC Circular 185/17/2022-GST, dated 28 December 2022, explains that the Section 73 limitation remains material in this redetermination. For annual-return cases, the circular describes the Section 73 notice window as two years and nine months before the order deadline; for erroneous refunds, it refers to the refund date. A Section 74 notice outside the period in which a Section 73 notice could have been issued cannot automatically be rescued merely by changing the label after the fraud ground fails.
When calculating a deadline, preserve the underlying dates and check whether a statutory exclusion, notified extension, court-ordered stay or amendment applies. A deadline should be computed for the precise financial year and demand type, not copied from a different notice.
Payment and penalty routes
Section 73 payment sequence
- Before notice: The person may pay the tax and interest and inform the officer. If the payment is less than the amount ultimately found payable, proceedings can continue for the balance.
- Within 30 days after notice: Payment of the tax and interest within the statutory period means no penalty is payable under the cited route, and proceedings in respect of that notice are deemed concluded.
- After the response period: The officer may adjudicate the disputed amount. The taxpayer should not assume that a partial payment closes the case unless the statutory conditions are met and the payment is correctly reported.
Section 74 payment sequence
- Before notice: The statutory route requires tax, interest and a penalty equal to 15% of the tax, with the prescribed intimation and payment conditions.
- Within 30 days after notice: Tax, interest and a 25% penalty can conclude the proceedings when the Section 74 conditions are satisfied.
- Within 30 days after communication of the order: Tax, interest and a 50% penalty can provide the post-order closure route described in the Act.
- Outside those routes: The amount, interest and penalty consequences depend on the order, payments already made, appellate status and the law applicable to the period.
The percentages are statutory payment options, not advice to concede liability. Before choosing one, check whether the notice correctly invokes Section 74, whether the amount is accepted, whether the period is within limitation and whether payment would affect an appeal or refund position.

How a demand generally proceeds
Notice and opportunity to respond
The notice should state the proposed tax, interest and other amounts, the period involved, the factual basis and the provision invoked. It should provide an opportunity to submit a written response and supporting records. A response can challenge the computation, the classification of the case, limitation, the fraud-related allegation, or all of them.
Adjudication
The officer considers the notice, reply, documents and any hearing required by the applicable procedure before issuing an order. The order should determine the amount legally payable and address the submissions. A Section 74 order should not treat the existence of a demand as proof of fraud; the statutory ground remains a factual issue.
Payment, appeal and recovery
Payment made under a statutory closure route should be matched to the correct tax period and accounting heads. If liability is disputed, the taxpayer must track the applicable appeal deadline, pre-deposit requirements and recovery rules separately. A general comparison of Sections 73 and 74 cannot determine the best litigation or payment strategy for a live notice.
How to read a show-cause notice
Mark these fields before preparing a reply:
- Tax period: Financial year, tax months and the annual-return due date used by the officer.
- Demand category: Short payment, non-payment, erroneous refund or wrongly availed/utilised ITC.
- Section cited: Section 73, Section 74 or another provision used alongside it.
- Ground for the section: Exact paragraphs alleging fraud, wilful misstatement or suppression and the facts said to prove intent to evade tax.
- Computation: Tax, interest, penalty, credit reversals, payments already made and the method used to reach each figure.
- Limitation: Date of annual-return due date or refund, proposed order deadline and date of notice.
- Evidence: Invoices, books, returns, statements, data extracts, correspondence and third-party material relied on by the department.
- Authority and hearing: Issuing officer, adjudicating officer, reply channel, hearing date and document-submission instructions.
Keep an indexed evidence file. A reconciliation that maps each notice allegation to a return line, invoice, ledger entry and payment can expose a calculation error without conceding the legal ground. If the notice alleges intent, address the alleged conduct directly rather than replying only with the tax amount.

What changed for certain DGGI notices
CBIC Circular 239/33/2024-GST, dated 4 December 2024, records that Notification No. 27/2024-Central Tax, dated 25 November 2024, took effect on 1 December 2024. It expanded the specified Additional or Joint Commissioners empowered with All India jurisdiction to adjudicate certain show-cause notices issued by officers of the Directorate General of Goods and Services Tax Intelligence.
This is a procedural point about who may adjudicate specified DGGI notices. It does not change the substantive test separating Section 73 from Section 74. The notice should still be examined for the correct ground, amount, period and limitation.
Section 74A and the current-law check
The two-section comparison above follows the Section 73 and Section 74 framework in the consulted CBIC Act text. The commencement and transition rules for Section 74A were not established in the official materials used for this article. Do not assume that the older two-section framework governs every period. For periods beginning with financial year 2024–25, and for any notice issued under an amended Act, check the current statutory text, commencement notification and applicable departmental instructions before deciding which provision controls.

- Treating every mismatch as fraud: A mismatch may indicate tax or credit exposure, but Section 74 requires the specified fraud-related reason.
- Ignoring the words to evade tax: The notice should connect suppression or misstatement to an intention to evade, not merely identify an omission.
- Assuming the five-year period always applies: The longer period is tied to a sustainable Section 74 ground; Section 75(2) can bring the matter back to Section 73 treatment.
- Counting from the wrong date: Annual-return demands and erroneous refunds use different reference events.
- Paying without checking posture: Reduced-penalty routes have exact payment, intimation and timing conditions. A payment decision can affect objections and appeals.
- Overlooking the governing version: Amendments, transition provisions, notified extensions and court orders can alter a calculation.
- Responding only to arithmetic: A Section 74 reply should address the alleged intent and evidence as well as the amount.
- Missing procedural instructions: Reply portals, hearing dates, authorised representatives and document formats can be decisive even when the substantive position is strong.
A practical decision checklist
- Save the complete notice, annexures, relied-upon statements and electronic service record.
- Create a period-wise reconciliation of returns, books, invoices, credit records, refunds and payments.
- Write a one-page issue list separating amount, classification, eligibility, limitation, jurisdiction and alleged intent.
- Map each Section 74 allegation to the evidence cited and identify documents that contradict or explain it.
- Calculate both the Section 73 and Section 74 deadline scenarios from the correct annual-return or refund date, then check exclusions and amendments.
- Decide whether to contest, pay, or use a statutory payment route only after reviewing the effect on interest, penalty, appeal rights and cash flow.
- File the response through the stated channel, retain acknowledgement and attend the hearing if one is offered or required.
- Have an Indian GST professional review a live notice, particularly where fraud is alleged, limitation is close, records are incomplete or a reduced-penalty payment is being considered.
The practical rule is simple: start with the factual reason for the demand, not the penalty percentage. Section 73 is the non-fraud route; Section 74 depends on a sustainable allegation that fraud, wilful misstatement or suppression of facts to evade tax caused the demand. The period, evidence and current law then determine what the notice can validly do.
