Before using it to train, fine-tune, or operate an AI system, UK organisations should define the purpose of each stage, assess whether reuse is compatible with the original collection purpose, and limit the data and system access to what the task requires. Reuse is not automatically prohibited either: the answer depends on the purposes, people’s reasonable expectations, the applicable lawful basis, and the safeguards.
When does reusing old data for AI create a new privacy risk?
The risk arises when information collected or held for one reason is later processed through a different model, application, or access path. The new activity may serve a different purpose, involve a different audience, or make different inferences possible. That can change what people reasonably expect and raises questions about purpose limitation, necessity, transparency, lawful basis, retention, and access control.

The age of the data does not answer those questions. Nor does the fact that an organisation already holds it. Under the UK Information Commissioner’s Office (ICO) approach, organisations should assess the relevant processing at each stage of the AI lifecycle rather than treating a dataset’s original collection as blanket permission for every later use. The ICO’s second call for evidence on generative AI sets out policy analysis and a consultation position; it is not a determination that a particular organisation’s processing is compliant.

Why each AI stage needs its own purpose
Purpose statements should describe what the organisation is actually doing with personal data, not rely on a catch-all such as “AI development” that obscures distinct activities. The ICO says that developing a generative-AI model and developing an application based on that model are different purposes under data protection law. Initial collection, adapting a model, and operating an application can also need to be considered separately.

Different parties may control different parts of the chain. Map purposes and responsibilities to the organisations that actually determine or carry out the processing; do not assume a single vendor controls collection, model development, application development, and deployment.

In its purpose-limitation analysis, the ICO states: “We consider that developing a generative AI model and developing an application based on such a model (fined-tuned or not) constitute different purposes under data protection law.” The quotation preserves the source’s spelling.

How to assess whether a new use is compatible
When personal data collected for one purpose is reused to train another model or support a different activity, assess whether the further purpose is compatible with the original one. The circumstances matter; “AI” is not, by itself, a sufficient explanation of compatibility. The ICO identifies people’s reasonable expectations at the start of processing as a key consideration. If the further purpose is incompatible, the organisation needs to establish a separate purpose and an applicable basis for the processing under the relevant rules.
The ICO’s purpose-limitation guidance explains the principle. Its AI-specific analysis also notes that a new use may be possible where it is compatible, or where a separate basis—such as specific consent or a legal obligation—applies. These are not shortcuts to approval: the organisation still needs to assess the actual processing and relevant legal constraints.

- Compare the new purpose with the reason people’s data was originally collected.
- Review what people were told and what they could reasonably expect when processing began.
- Record the reasoning for compatibility, or identify the separate purpose and applicable basis where the further purpose is incompatible.
- Explain unexpected processing and the safeguards used to reduce its effects.
Minimise the data and restrict what the system can reach
A dataset’s availability does not establish that every field or record is needed. The ICO says the amount and type of personal information should be justified against the use case, and data should not be retained merely because it might be useful in the future. Set retention periods to match the stated purpose and remove unnecessary fields, records, and duplicates.
Apply the same discipline to an AI system’s access. In its analysis of agentic AI, the ICO says: “Organisations should not give agentic AI systems access to information just because it might be useful in the future.” Select the tools and databases needed for the task, and use measures such as permissions, masking, observability, and human approval for sensitive access where appropriate. A clear notice can help people understand the processing, but it does not replace purpose assessment or access controls.

The ICO’s AI security and data-minimisation guidance addresses these controls. The ICO says this guidance is under review following the Data (Use and Access) Act, so check the current version when applying it.

A practical review before reuse
- Describe the processing stage. State whether the proposal involves collection, repository creation, model training, fine-tuning, application development, or deployment and operation.
- Write a specific purpose for that stage. Avoid broad wording that makes it difficult to explain what the activity covers.
- Recover the original context. Record why the data was collected, what people were told, and the expectations that were reasonable at that time.
- Assess compatibility and lawful basis. Document how the proposed purpose relates to the original one, identify an appropriate basis for the actual processing, and check other relevant legal constraints.
- Reduce data and access. Keep only the fields and records needed for the stated outcome; set purpose-based retention and restrict the AI system to necessary tools, databases, and information.
- Set safeguards and explain the use. Consider permissions, masking, monitoring, human approval for sensitive access, and clear notices in light of the processing and its effects.
- Reassess when something changes. Review the decision if the model, application, purpose, data, or access path changes.
This is a practical governance checklist, not a case-specific legal determination. The ICO’s 2024 consultation-response page reports 46 organisational responses on purpose limitation; among 16 survey respondents, 12 (75%) agreed with the ICO’s overall analysis. That percentage describes those survey respondents only, not the public, all organisations, or the prevalence of AI risk. See the ICO consultation response.
