H-1B and PERM are not two names for the same immigration benefit. H-1B is a temporary, employer-sponsored nonimmigrant work classification for qualifying specialty occupations. PERM is a U.S. Department of Labor (DOL) labor-certification process that usually supports a later employment-based immigrant case; it is not a visa and does not grant a green card by itself.
The practical difference is purpose: H-1B authorizes qualifying temporary employment, while PERM tests the U.S. labor market for a permanent job before the employer can usually pursue the next immigration stage.
PERM vs. H-1B at a glance
| Question | H-1B | PERM |
|---|---|---|
| What is it? | A temporary, nonimmigrant work classification for specialty occupations. The DOL describes the program as allowing employers to temporarily employ foreign workers in the United States in specialty occupations (and, under the program description, fashion models of distinguished merit and ability). DOL H-1B overview | A permanent labor-certification process administered by the DOL for a qualifying permanent job opportunity. It generally supports a later employment-based immigrant petition. DOL Permanent Labor Certification |
| Who leads the filing? | The employer submits the Labor Condition Application (LCA) and, after the labor step, the required petition and related filings. | The employer is responsible for the labor-certification application. DOL expressly says filing applications is the employer’s responsibility, not the employee’s. |
| What labor-market issue is addressed? | The employer attests to wages and working conditions through the LCA. | The employer must show that the permanent job meets DOL labor-market requirements, including the applicable prevailing-wage and recruitment steps. |
| Does approval itself grant permanent residence? | No. H-1B is temporary status. | No. A certified PERM application normally must be followed by immigration authorization steps, usually beginning with an employer’s Form I-140 petition to U.S. Citizenship and Immigration Services (USCIS). |
| Key validity or numerical rule | The DOL overview lists a statutory annual limit of 65,000 qualifying workers plus a 20,000 advanced-degree exemption. Whether a particular petition is cap-subject or exempt depends on current rules and the case. | DOL says a certified labor certification expires if it is not submitted to USCIS within 180 days. That is a filing-validity deadline, not the total time required to obtain a green card. |
These programs can appear in the same person’s long-term plan, but neither is automatically a prerequisite for the other. H-1B is a temporary work route; PERM is one possible labor-certification step in a permanent employment-based strategy.

H-1B is designed for temporary employment in a “specialty occupation.” In the DOL’s description, that means work requiring specialized knowledge and at least a bachelor’s degree or equivalent in the specific specialty. The employer—not the worker acting alone—starts the process.
The H-1B labor step: the LCA
Before proceeding with the USCIS petition and any applicable visa processing, the employer files a Labor Condition Application, Form ETA-9035/9035E. DOL reviews an LCA for completeness and obvious errors. The LCA contains the employer’s attestations about the job, pay and working conditions.

The wage obligation is not simply “pay the offered salary.” Under the DOL’s explanation, the employer must pay at least the greater of the actual wage paid to similarly experienced and qualified workers or the prevailing wage for the occupation and area. The detailed wage-and-working-condition rules are summarized by the DOL’s Wage and Hour Division at H-1B Labor Condition Application.
What happens after the LCA
Once the labor condition step is completed, the employer may proceed with the H-1B petition through USCIS and, when relevant, visa processing through the Department of State. The exact path depends on whether the worker is changing status inside the United States, applying for a visa abroad, or using another procedure allowed by the worker’s circumstances. The H-1B overview is available from DOL at https://www.dol.gov/agencies/eta/foreign-labor/programs/h-1b.
The annual cap is a rule to check, not a promise of availability
DOL’s program overview lists 65,000 H-1B numbers for qualifying workers and an additional 20,000 exemption for people with qualifying advanced degrees. Those figures are statutory figures shown on the current DOL overview; they do not guarantee a place for every petition. Current registration procedures, cap exemptions, employer type and the worker’s facts determine whether a particular case is subject to the cap. Check current USCIS and DOL instructions before treating a filing as cap-subject or cap-exempt.
What PERM does
PERM stands for the permanent labor-certification process. It is a DOL determination tied to a specific permanent job opportunity, not an immigration status. The employer generally uses a certified labor application as support for a subsequent employment-based immigrant petition.

The labor-market finding
DOL describes the required finding this way: there must not be sufficient U.S. workers who are able, willing, qualified and available for the job in the area of intended employment, and employing the foreign worker must not adversely affect the wages and working conditions of similarly employed U.S. workers. This is why PERM is fundamentally different from the H-1B LCA: PERM tests the availability of U.S. workers for a permanent position, while the LCA records the employer’s wage and working-condition attestations for a temporary specialty-occupation job.
Employer-controlled preparation
The employer must identify a qualifying permanent, full-time job; obtain a valid prevailing-wage determination; complete the recruitment steps that apply to the occupation; and file the PERM application with DOL. DOL’s program page and FLAG’s PERM guidance describe those components at https://www.dol.gov/agencies/eta/foreign-labor/programs/permanent and https://flag.dol.gov/programs/perm.

The employee supplies information and documents, but the legal filing responsibility belongs to the employer. A worker cannot independently file a PERM application for a job that an employer has not sponsored.
What certification changes—and what it does not
A certified PERM application gives the employer the labor-certification result needed for the next stage when labor certification is required. In most instances, the employer submits the certified application with Form I-140 to USCIS. DOL’s general foreign-labor information explains that certification is followed by the employer’s request for immigration authorization; see DOL Foreign Labor.
PERM approval does not itself provide a visa, work authorization, lawful permanent-resident status or a green card. It is also not required for every employment-based green-card category. DOL uses the qualifier “in most instances,” and some immigrant categories have different eligibility rules or do not require labor certification.

The 180-day submission deadline
DOL states that a certified labor certification is valid for 180 days and expires if it is not submitted to USCIS within that period. This deadline concerns submission of the certified application; it is not a 180-day promise for the entire green-card process, and it does not measure how long DOL or USCIS will take in a particular case.
How the two processes differ step by step
| Stage | H-1B path | PERM-based permanent path |
|---|---|---|
| 1. Define the job | Employer identifies a qualifying specialty occupation and the worker’s position and qualifications. | Employer identifies a permanent, full-time job opportunity and the requirements for that position. |
| 2. DOL filing | Employer files the LCA, Form ETA-9035/9035E, with the required wage and working-condition attestations. | Employer obtains the prevailing wage, completes the applicable recruitment process and files the PERM labor-certification application. |
| 3. Government review | DOL checks the LCA for completeness and obvious errors; the employer then proceeds with the USCIS petition and any applicable visa step. | DOL determines whether the labor-market requirements are met for the permanent position. |
| 4. Immigration filing | Employer files the H-1B petition with USCIS; visa processing may be needed depending on the worker’s location and status. | Employer generally files Form I-140 with USCIS after certification when labor certification is required. |
| 5. Final outcome of this stage | Temporary H-1B employment authorization or status, subject to the applicable rules. | A labor certification that supports, but does not complete, an employment-based permanent-residence case. |
Is PERM required before H-1B?
No general rule makes PERM a prerequisite to H-1B. The official program descriptions treat them as separate programs with different purposes: H-1B covers temporary specialty-occupation employment, while PERM concerns labor certification for a permanent job. An employer may pursue H-1B without first obtaining PERM, and a permanent case may be structured through a category that does not require PERM.
Employers sometimes use both at different points because a worker may need temporary work authorization while a permanent employment strategy is evaluated or pursued. That sequencing is case-specific. The existence of an H-1B petition does not by itself prove that a PERM case is required, and a PERM filing does not by itself create H-1B eligibility.
Can someone have H-1B while a green-card case is pending?
This is a common question, but the DOL program pages cited here do not establish an answer for every individual’s circumstances. Whether a person can remain in H-1B status, change status, obtain a visa, or continue working while an employment-based case is pending can depend on the worker’s current status, petition history, filing sequence, priority-date and visa-availability issues, travel, employer changes and other facts governed largely by USCIS and Department of State rules.

Use current USCIS guidance for the specific benefit being requested and obtain advice from a qualified immigration lawyer for a case-specific answer. Do not treat “PERM approved,” “I-140 filed” or “green card pending” as interchangeable labels; each describes a different stage and carries different legal consequences.
Timing, deadlines and what cannot be inferred
There is no reliable one-size-fits-all timeline
The DOL materials establish the 180-day validity period for a certified PERM submission, but they do not establish a total PERM-to-green-card duration. Processing time can vary with agency workloads, the employment-based category, the worker’s country of chargeability, visa availability, priority-date movement and individual case facts. Quoting a single number of months for every applicant would be misleading.
Do not confuse a filing deadline with a case duration
The 180-day PERM rule means the employer must submit the certified application to USCIS within that window. It does not mean the green card will be approved within 180 days, nor does it mean every preliminary step takes 180 days. Keep the certification date and the USCIS submission date in the employer’s case records.
H-1B cap figures are not processing times
The 65,000 cap and 20,000 advanced-degree exemption are numerical limits, not promises about when a petition will be filed, selected or approved. A petition can be exempt from the cap or governed by a different current procedure. Verify the applicable fiscal-year instructions before relying on the figures.

Common misunderstandings and the accurate correction
- “PERM is my green card.” No. PERM is a DOL labor certification. It is generally followed by an I-140 petition and additional immigration steps.
- “H-1B is a green-card application.” No. H-1B is temporary, nonimmigrant employment classification.
- “Every employment green card needs PERM.” Not necessarily. DOL says labor certification is required “in most instances”; category-specific exceptions exist.
- “The employee files PERM.” The employer is responsible for the PERM filing.
- “The LCA and PERM are the same labor test.” They are not. The LCA addresses H-1B wage and working-condition attestations. PERM addresses whether qualified, available U.S. workers can fill a permanent job without adverse effects on comparable workers.
- “A certified PERM can be held indefinitely.” No. DOL gives a 180-day period for submission to USCIS.
- “The H-1B cap applies to every H-1B petition.” Not automatically. The cap and exemptions must be checked under current rules and the facts of the petition.
- “An H-1B automatically guarantees a future green card.” No. A future permanent case requires its own eligibility analysis, employer sponsorship and required filings.
Choosing the right question for your situation
If you need authorization for a temporary specialty-occupation job
Start by asking whether the position qualifies as a specialty occupation, whether the worker meets the position’s specific educational or equivalent requirements, whether the employer must file an LCA, and whether the petition is cap-subject or exempt under current rules. Those are H-1B questions, not PERM questions.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitchesIf the employer wants to sponsor a permanent position
Ask whether the job is permanent and full-time, whether labor certification is required for the intended immigrant category, what prevailing wage applies, which recruitment steps are required, and how the employer will meet the 180-day submission deadline after certification. These are PERM and employment-based immigrant-case questions.
If both objectives matter
Separate the temporary-work plan from the permanent-residence plan in your records and conversations with the employer. Confirm which entity is sponsoring each filing, which job description applies, what has actually been filed, and which agency is responsible for the next step. A temporary H-1B filing and a PERM-based case can involve different forms, standards and deadlines even when they concern the same worker.
Employer and employee checklists
Employer checklist for H-1B planning
- Confirm that the position fits the specialty-occupation definition and document the required specialty knowledge and degree or equivalent.
- Determine whether the case is subject to the annual cap or a current exemption.
- Prepare and file the ETA-9035/9035E LCA with accurate wage and working-condition attestations.
- Check that the wage meets at least the greater of the actual wage for similarly experienced and qualified workers or the prevailing wage for the occupation and area.
- After the LCA step, prepare the USCIS petition and any applicable visa or status filing.
Employer checklist for PERM planning
- Define a permanent, full-time job and its minimum requirements.
- Obtain a valid prevailing-wage determination.
- Complete every recruitment step that applies to the occupation and retain the required records.
- File the PERM application as the employer, not as an employee self-filer.
- If certified, submit the application to USCIS with the I-140 process within the 180-day validity period.
- Track later immigrant-case steps separately from the DOL certification.
Employee checklist
- Ask the employer which process is being pursued: H-1B, PERM, I-140 or another immigrant category.
- Request the filing dates and receipt or certification information for each stage.
- Keep copies of job descriptions, offered duties and the documents used to show education or equivalent qualifications.
- Do not assume that an employer’s statement that it will “sponsor a green card” means PERM has been filed or approved.
- For questions about status, travel, work authorization, visa issuance or a pending green-card case, consult current USCIS and Department of State guidance or qualified counsel.
Bottom line: temporary work authorization versus a permanent-case labor step
Choose H-1B when the immediate issue is temporary employment in a qualifying specialty occupation and the employer can satisfy the LCA and petition requirements. Think of PERM when the employer is pursuing a permanent job-based immigration case that requires labor certification. PERM is not a visa, H-1B is not a green card, and approval of either stage does not eliminate the later filings and eligibility checks that may apply.
