PERM and H-1B are not competing versions of the same visa. PERM is an employer-controlled Department of Labor (DOL) labor certification used in a possible employment-based green-card case. H-1B is a temporary, nonimmigrant work classification for a specialty occupation. One tests the U.S. labor market for a permanent job; the other authorizes qualifying temporary employment. An employer may use both for the same worker at different stages, but neither automatically produces a green card.
The difference in one table
| Question | PERM labor certification | H-1B classification |
|---|---|---|
| What is it? | A DOL certification concerning a permanent job opportunity. | A temporary, nonimmigrant employment classification. |
| Main purpose | To support a later employment-based immigrant petition, usually Form I-140. | To let an eligible employer employ a worker in a specialty occupation. |
| Who files? | The sponsoring employer controls and files the PERM application. | The employer submits the Labor Condition Application (LCA) to DOL and the petition to U.S. Citizenship and Immigration Services (USCIS). |
| Labor-market test | DOL examines whether able, willing, qualified and available U.S. workers exist and whether the hire would harm wages or working conditions. | The employer attests to wage and employment conditions; the required wage is at least the greater of the actual wage or prevailing wage. |
| What do you receive? | A certification, not a visa, status or green card. | Temporary nonimmigrant work authorization, subject to petition approval and the rules for visa issuance and admission. |
| Typical duration | It is not an immigration status. A certified application has a 180-day validity period for submitting the I-140 to USCIS. | Generally up to three years initially and six years in total, with statutory and case-specific exceptions. |
Because the two items perform different legal jobs, asking which one is “better” can produce the wrong answer. The practical question is which stage the employer and worker need: temporary specialty-occupation employment, a permanent-residence sponsorship step, or both.

What PERM actually does
PERM, formally the permanent labor certification process, is a DOL certification for a specific permanent job opportunity. The employer must show that there are not sufficient able, willing, qualified and available U.S. workers for that opportunity and that employing the foreign worker will not adversely affect the wages and working conditions of similarly employed U.S. workers.

PERM does not grant a green card, immigrant status, work authorization or permission to enter the United States. If the labor certification is approved, the employer generally uses it as the foundation for an employment-based immigrant petition, Form I-140, filed with USCIS. The worker still must satisfy the immigrant category requirements, and the case remains subject to visa availability and the later immigrant process.

The employer is the controlling filer
The sponsoring employer—not the worker—owns the PERM filing. The worker can provide information and should understand every stage, but the employer is responsible for the job description, recruitment record, attestations and submission. A worker cannot independently file a PERM certification for a job that has no sponsoring employer.
How the PERM sequence works
- Define the permanent opportunity. The employer identifies the offered position, duties, minimum requirements, work location and other terms that will govern recruitment and the certification.
- Request a prevailing wage determination. DOL establishes the prevailing wage for the occupation and location. The employer must be prepared to offer at least the wage required for the certification.
- Complete required notice and recruitment. The employer follows the recruitment and notice rules applicable to the occupation. The purpose is to test the U.S. labor market, not merely to document that a preferred candidate exists.
- Evaluate U.S. applicants. The employer must consider applicants against the stated minimum requirements and retain the required recruitment record. A lawful rejection must relate to the job’s requirements and circumstances.
- File ETA-9089 with DOL. The employer submits the PERM application after completing the required steps. DOL may certify it, request an audit, or otherwise require additional handling.
- Use an approval promptly. A certified labor certification is valid for 180 days for submission with the employer’s Form I-140 filing to USCIS. Missing that period can require the employer to address the case again rather than simply relying on the old certification.
The certification is therefore one link in a chain: labor-market test first, immigrant petition next, and the remaining green-card process afterward. Approval at one link does not approve the next.
What H-1B actually does
H-1B is a temporary employment classification for a qualifying specialty occupation. The position and the worker must meet the applicable requirements, and the employer must follow wage and working-condition obligations.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Scan for outdated or missing drivers - takes under a minute3Repair Windows errors before they cause bigger problemsThe employer’s H-1B filings
- Submit an LCA to DOL. The employer attests to required employment conditions and the wage it will pay. The wage must be at least the greater of the actual wage paid to similarly situated workers or the prevailing wage for the occupation and location.
- File the petition with USCIS. After the LCA process, the employer files the relevant H-1B petition with USCIS, including evidence that the job is a specialty occupation and that the worker qualifies.
- Complete visa processing when necessary. An approved petition is not the same thing as a visa stamp. Where the worker needs a visa to seek entry, the worker applies through the Department of State process. Visa issuance and admission to the United States are separate decisions.
H-1B status is tied to the approved employment and the terms of the petition. Changes in employer, position, worksite or duties can require a new filing or other compliance step. The exact action depends on the facts, so a general comparison cannot tell a worker whether to change jobs, travel or remain in the United States while a case is pending.
How long H-1B lasts
The ordinary framework is up to three years for the initial period and generally up to six years total. Exceptions can extend or alter that framework in some circumstances, so six years is not a universal guarantee or an automatic expiration date for every case.

Why “PERM vs. H-1B” is an imperfect comparison
PERM is a labor-certification stage; H-1B is a nonimmigrant classification. They can appear in the same worker’s history without replacing one another. For example, an employer may first employ a person in H-1B status, then begin PERM sponsorship for a permanent position. The H-1B provides a temporary work framework while the employer pursues the immigrant process. Conversely, a worker may be pursuing permanent sponsorship without needing H-1B if another lawful work or immigration arrangement applies.
The two filings also answer different government questions:
- PERM asks: Has the employer tested the U.S. labor market for this permanent opportunity, and would the hire protect rather than undermine U.S. wages and working conditions?
- H-1B asks: Is this a qualifying specialty occupation, does the worker qualify, and has the employer made the required wage and employment attestations?
An approved H-1B does not waive PERM recruitment. An approved PERM does not authorize employment or admission. Treating either approval as a shortcut around the other process is a common source of costly mistakes.
Current PERM processing figures
DOL’s OFLC processing page reported an average of 336 calendar days for PERM analyst review in August 2026. The same DOL information, reported as of October 5, 2026, showed December 2025 as the priority-date month for PERM analyst review and audit review.
These are dated queue snapshots, not service guarantees for an individual application. Actual timing can differ by filing date, whether the case is selected for audit, the completeness of the record and later USCIS and visa-processing steps. Recruitment occurs before filing, and the I-140 and any subsequent immigrant-visa or adjustment process add time beyond DOL’s analyst-review figure. Check the current OFLC page before making a deadline or relocation decision.

Why the number cannot predict a green card date
The 336-day figure covers a DOL review stage. It does not include the employer’s prevailing-wage and recruitment work, USCIS adjudication of the I-140, visa-number availability, consular processing or adjustment of status. A case can therefore take longer even when the PERM review itself matches the published average.

How the green-card path continues after PERM
- PERM certification. DOL certifies the labor-market application if the employer meets the requirements.
- Form I-140. The employer generally files the immigrant petition with USCIS, using the certified labor certification within its 180-day validity period.
- Visa availability and immigrant processing. The worker must qualify for the employment-based category, and an immigrant visa number must be available. Depending on the worker’s situation, the final stage may involve adjustment of status in the United States or immigrant-visa processing through a U.S. consulate.
- Permanent residence decision. Only the appropriate final immigrant process can grant permanent residence. PERM approval alone never does so.
Each stage has its own eligibility rules, evidence and agency decision. An employer can have a certified PERM while the I-140 is pending, approved or denied; visa availability can also change the timing of the final step.
Who does what: employer and worker responsibilities
| Task | Employer | Worker |
|---|---|---|
| PERM strategy | Chooses the permanent role, controls recruitment, keeps records and files ETA-9089. | Provides accurate background information and reviews whether the stated job and requirements match reality. |
| H-1B compliance | Files the LCA and petition, pays at least the required wage and follows the approved employment terms. | Works only under authorized conditions and reports material changes promptly. |
| Immigrant petition | Generally files Form I-140 after PERM certification. | Supplies evidence of qualifications and monitors personal eligibility and deadlines. |
| Travel and status decisions | May need to coordinate amended or new filings when employment facts change. | Must assess status, admission, visa and pending-filing effects before travel, resignation or a job move. |
Immigration outcomes depend on the worker’s current status, the employer’s filings, the offered job and the timing of each action. A general article cannot safely answer whether an individual should leave a job, change employers or travel.
Wages and labor-market protections compared
PERM’s labor-market test
PERM focuses on a permanent opportunity and the availability of U.S. workers. The employer’s recruitment and evaluation must support the claim that no sufficient able, willing, qualified and available U.S. workers were found under the stated requirements. DOL also considers whether the employment would adversely affect wages and working conditions.
H-1B’s wage attestation
H-1B does not use PERM recruitment to certify the absence of U.S. workers. Instead, the employer attests through the LCA to required wage and employment conditions. The wage obligation is the greater of the actual wage for comparable employees or the prevailing wage for the occupation and location. The distinction matters: an H-1B petition can be approved without a PERM certification, while a PERM approval does not substitute for an H-1B LCA or petition.

Common mistakes and how to avoid them
Mistake: calling PERM a visa
PERM is a DOL certification. It does not provide a visa, work authorization or an immigration status. Use the term “labor certification” and identify the later I-140 and immigrant process separately.
Mistake: treating PERM approval as a guaranteed green card
A certified application supports a possible immigrant petition. USCIS must still decide the I-140, the worker must qualify for the category, and an immigrant visa number must be available. None of those outcomes is guaranteed by DOL certification.
Mistake: treating an H-1B approval as admission
USCIS petition approval, Department of State visa issuance and admission at a U.S. port of entry are distinct events. A worker should identify which event has occurred before relying on it for travel or work.
Mistake: quoting the 336-day figure as a promise
The August 2026 average is a dated agency snapshot. It is not a case-specific deadline, and it excludes recruitment and later stages. Record the date and review type whenever you quote a processing figure.
Mistake: overlooking the 180-day PERM validity period
After certification, the employer generally must submit the I-140 within 180 days. Calendar that deadline immediately; an approved certification that is not used in time may not remain usable for the intended filing.
Best Value
Mistake: assuming six years applies in every H-1B case
Three years initially and six years total describe the usual framework, not an unconditional promise. Exceptions and individual circumstances can change the calculation. Review the approval notices and prior periods of H-1B admission rather than relying on a rough count.
A practical decision framework
If the immediate need is lawful specialty-occupation work
Examine H-1B eligibility, the employer’s LCA obligations and the USCIS petition. Confirm the offered role, wage, worksite and requested validity period. If the worker will seek entry from abroad, keep petition approval, visa issuance and admission in separate checklists.
If the employer wants to sponsor permanent residence
Determine whether the offered position is genuinely permanent and whether the employer can complete the prevailing-wage, recruitment and recordkeeping requirements. Plan the I-140 filing before the 180-day certification validity expires, then evaluate visa availability and the worker’s final immigrant-processing route.
If both goals apply
Map the cases on one timeline without treating them as interchangeable. The H-1B governs temporary employment; PERM and the I-140 build a potential permanent-residence case. Keep copies of LCAs, approval notices, recruitment records and filing receipts, and have counsel review any job, location, travel or status change before acting.
Questions to ask the sponsoring employer or lawyer
- Is the offered position temporary for H-1B purposes, permanent for PERM purposes, or being described differently in the two filings?
- Who is responsible for each filing, government notice and deadline?
- What wage was used, and is it the greater of the actual and prevailing wage where required?
- What recruitment and notice steps will be completed for PERM, and how will the employer retain the record?
- When will the I-140 be filed if PERM is certified, and how will the 180-day validity deadline be tracked?
- Which event is currently pending: DOL review, USCIS petition adjudication, visa issuance or admission?
- What facts would require a new or amended filing if the worker changes employer, duties, location or travel plans?
Bottom line
H-1B is the temporary work classification; PERM is an employer-side labor certification that can precede an employment-based green-card petition. An employer may use H-1B to employ a worker now and PERM to pursue permanent residence later, but the processes remain legally distinct. Keep the agencies, filings, deadlines and outcomes separate, and treat every published processing figure as a dated estimate rather than a promise.
