A public repository is not, by itself, permission to modify, use commercially, or redistribute the code. To know what you can do, check the exact license and version.
What is the difference?
In the Open Source Initiative’s (OSI) usage, software is open source when its license meets the Open Source Definition (OSD). The definition sets out ten criteria, including access to source code, free redistribution, and permission to make and distribute modified versions. It also bars discrimination against people, groups, or fields of endeavor.
“Source-available” is a broad description, not a single license category or a guarantee of particular rights. It generally means the source code can be inspected or obtained. The project’s license determines whether and under what conditions you may modify, use, or redistribute it. As OSI puts it, “Open source doesn’t just mean access to the source code.”
What can you do with each kind of software?
The label alone cannot answer every practical question. Compare the actual license terms for the code and version you plan to use.

Does source-available mean open source?
No. A downloadable archive or public Git repository shows that source code is accessible; it does not grant the rights required by the OSD. A license that prohibits commercial use or restricts use to particular fields, for example, does not meet the OSD’s nondiscrimination requirements. Source availability and license permissions are separate questions.
Can you use open-source software commercially?
Yes. OSI says, “Absolutely. All Open Source software can be used for commercial purpose; the Open Source Definition guarantees this.” Open-source software may also be sold. The OSD’s free-redistribution criterion says a license must not require a royalty or other fee for the sale of the software.

Commercial permission does not mean every downstream use is unconditional. Some copyleft licenses require people who redistribute covered software or derivatives to preserve specified freedoms for recipients. Read the relevant license to understand which acts trigger conditions; simply using software and distributing copies are distinct situations.
Does “free software” mean software costs nothing?
Not necessarily. OSI’s FAQ uses “free software” and “open source software” for software released under licenses that guarantee specified freedoms. The Free Software Foundation and OSI express their definitions differently, but “free” in this context should not be read as a promise that the software has no price. Open-source software can be sold or used commercially.

How to check a project’s actual permissions
- Identify the exact project version and components. A project can include components under different licenses, and terms can change between versions.
- Read the license file and notices for that version. Look for the license name, version, and any component-specific terms. A repository’s visibility does not replace these documents.
- Check the permissions that matter to your use. Confirm whether the license allows your intended commercial use, modifications, and redistribution, and whether it imposes conditions on distributed copies or derivatives.
- Verify OSI approval if open-source status matters. Search the named license in OSI’s license directory. The directory indicates which licenses OSI has reviewed and approved; it does not establish which license applies to a particular project release.
For consequential business or distribution decisions, have the applicable license text reviewed by qualified counsel. Its effect can depend on the exact terms, version, components, and circumstances.

Calling software source-available can be accurate even when its license limits what people may do with the code. Calling it open source makes a more specific claim: the license must satisfy the OSD’s conditions. Treat the label as a starting point, not a substitute for checking the license that governs the code you plan to use.
