The American Copyright Protection Act of 2026 (H.R. 10364) expressly includes virtual private networks in a proposed court process for blocking access to foreign piracy sites. It is an introduced bill, not a law: as of October 3, 2026, the official record shows it was referred to the House Judiciary Committee.
What H.R. 10364 proposes
Introduced by Representative Darrell Issa on September 14, 2026, H.R. 10364 would add a process to federal copyright law for identifying a foreign online location as a “foreign piracy site.” It does not create a general prohibition on VPNs or VPN use. Its focus is court-ordered access blocking for sites determined to meet that definition.

Under the bill, a copyright owner could first bring an action in federal district court seeking a declaration that a location is a foreign piracy site. After that declaration, the owner could petition for a blocking order naming service providers. The order would require each named provider to take “all commercially reasonable steps” to prevent users or subscribers from using its systems or networks to access the site “from the United States.” The introduced bill text sets out this proposed process.

The bill’s definition expressly includes broadband internet access providers, domain-name resolution providers and virtual private networks. It excludes root nameserver operators and top-level domain registries. It also excludes entities providing services to fewer than 100,000 monthly users or subscribers in the United States. That number is a proposed statutory coverage threshold, not a measure of the VPN market or the number of providers currently operating in the country.

Being included in the definition would not automatically mean a provider receives an order. A copyright owner would have to pursue the bill’s court process, and the court would assess whether to name particular providers.
What VPN blocking might mean—and what the bill leaves open
A VPN can route a user’s traffic through servers in different countries. The bill’s stated objective is to prevent access to a targeted site “from the United States,” but the introduced text does not specify how a VPN must identify or block that access. It does not say whether a provider should block the site on US exit servers, block users it identifies as connecting from the United States, or use another method.

That distinction matters: the bill proposes a required outcome while leaving the technical approach open. Coverage by TorrentFreak and Ars Technica discusses possible approaches, but these are interpretations, not instructions written into the bill.

Safeguards and potential consequences
Before naming a provider, the bill directs the court to consider factors including the burden on that provider, technical feasibility and efficacy, likely harm to copyright owners, incidental harm to other online services or users, and public benefit or harm. It also says an order may not prescribe a specific technical method.

Those factors are relevant to the risk that blocking a targeted site could also disrupt access to legitimate services or affect users beyond the intended target. Critics quoted in coverage have raised concerns about such collateral effects, including disruptions reported in other countries. Those concerns should not be mistaken for proven effects of this unpassed US bill; the proposed court review is intended to weigh incidental harm, but how any future orders would work is not yet known.

No. H.R. 10364 was introduced on September 14, 2026, and referred to the House Committee on the Judiciary. As of October 3, 2026, it remains a proposal, so it does not currently require VPN companies or other providers to block websites. Legislative status can change; the official bill record is the place to check for updates.
