The Scot from Dumbarton was arrested in 2017 over alleged terrorism offences.
When was Johal released?
| Date | What happened |
|---|---|
| 2017 | Johal was arrested in India, weeks after his wedding, over alleged terrorism offences. |
| 18 September 2026 | ITV News reported that the Delhi High Court had overturned an earlier decision and granted him bail in seven cases. |
| 1 October 2026 | Johal walked out of prison on the morning of 1 October, according to The Irish News and Press Association Scotland. Reprieve said his family had filed a habeas corpus petition before the prison released him. |
The Irish News report described him as having spent nearly nine years in detention without conviction in the terror-related cases then at issue.
What remains of the legal case?
Bail allowed Johal to leave prison; it did not decide whether he was guilty or end the proceedings. The Irish News reported that he remained on trial in several cases, which could carry the death penalty. It did not provide a complete list of the pending charges or the Delhi High Court’s reasoning.
A separate case accusing Johal of financially supporting a terror group ended in his acquittal last year. That result did not dispose of all the other proceedings: the Irish News reported that federal charges related to similar allegations remained.

What bail conditions have been reported?

How have Scottish and Indian officials responded?
Scottish First Minister John Swinney welcomed Johal’s release, saying: “It’s a significant step forward and a welcomed one.” He said the Scottish Government had consistently called for Johal’s release and raised concerns about his prolonged detention, including in light of findings by the UN Working Group on Arbitrary Detention.

UN experts characterized Johal’s imprisonment as arbitrary detention and described it as “a form of psychological torture,” according to The Irish News. Indian authorities have denied the torture allegation and said due process was being followed. These are competing attributed positions; the reports do not resolve them.
Reprieve deputy executive director Dan Dolan said that, despite Johal’s release, “he still has the threat of a death sentence hanging over him.” Johal’s brother, Gurpreet Singh Johal, said he did not dare believe the release had happened until he saw his brother walk out of the prison gates.
