Not automatically. Telegram’s current terms restrict using user-generated content for purposes beyond ordinary, legitimate use of the platform, and separately prohibit using Telegram data to develop or deploy AI/ML systems except under a narrow consent exception. Public visibility does not itself grant permission under Telegram’s terms, copyright law, privacy law, or computer-access law. Whether a particular project is lawful depends on where and how it operates, what it collects, and what it does with the data.
This is general information, not legal advice for a specific project. Telegram’s terms and applicable laws can change; the terms and primary legal sources discussed here were reviewed as of October 4, 2026.

Why “public” does not settle whether scraping is allowed
Telegram says public chats are accessible to everyone. That describes who can view them; it does not grant an unrestricted right to copy, aggregate, republish, or use their contents for any purpose. Three separate questions matter:
Recommended Free Tools
- Telegram’s terms: Does the collection fit the platform’s permitted uses?
- Applicable law: Do privacy, copyright, or computer-access rules allow the particular collection and use?
- Responsible handling: Are the data limited, secured, retained only as needed, and handled in a way that respects the people represented?
A project may satisfy one layer and still fail another. For example, a privacy-law basis does not override Telegram’s terms or grant copyright permission.

What Telegram’s terms say about collecting channel content
Telegram’s Terms of Service for Content Licensing say that access to user-generated content for purposes outside ordinary, legitimate, intended use of Telegram is prohibited. They describe a limited exception for data strictly required to launch and operate a legitimate third-party Telegram client, bot, or Mini App. That exception is conditioned on following Telegram’s terms and applicable privacy and data-protection law; its license is limited, retractable, non-exclusive, non-transferable, and non-sublicensable. It does not remove the content owner’s copyright conditions.
That exception is about operating a compliant Telegram service, not a general permission to harvest public channels for an independent database, analytics product, or other unrelated use. Telegram’s Bot Platform terms also prohibit collecting more data than is essential to a bot service and identify scraping public groups or channels to build large datasets, machine-learning models, or AI products as prohibited.

- No more exposed information in unprotected notary journals. This product shields clients' confidential information from prying eyes. It allows the Notary Public to keep the journal open during the transaction, as NO prior client information is viewable.
- Shields clients' AND Notaries Public' confidential information
- GLBA and HIPAA require strict confidentiality policies and procedures. Notary Privacy Guard is a compliance tool for the professional Notary Public.
- Decreases Notary Public's liability from exposing client information
- Journal column headers are printed on the Notary Privacy Guard, no having to peek underneath to complete the journal entry. Becomes part of the journal and also acts as a place marker.
AI and machine-learning use has a separate restriction
Telegram’s content terms expressly prohibit scraping, indexing, harvesting, aggregating, or using Telegram-derived data to train, fine-tune, validate, benchmark, or otherwise develop, enhance, or deploy AI/ML systems. The stated exception is narrow: all relevant users must give individual, explicit, informed, affirmative, continuing consent, limited to the specific content and the particular chat, channel, or other non-global context. Consent in one context does not authorize use of other chats or Telegram data generally. A lawful basis under privacy law, by itself, does not satisfy this platform-terms requirement.
Client and bot developers still have duties
Telegram’s API terms tell third-party client developers to protect user privacy and follow security guidelines. They also refer developers to its content-licensing and AI-scraping terms; client apps that access channel content must support official sponsored messages. Bot developers must handle data obtained through or in connection with the Bot Platform under Telegram’s terms, its privacy policy, and applicable law.
Privacy law may apply even to publicly viewable posts
The GDPR applies only where its territorial and material scope is met; a public Telegram channel does not automatically bring every collector or project within it. Where the GDPR does apply, collecting, storing, consulting, analyzing, or disclosing identifiable posts or account details can constitute processing of personal data.

Under the GDPR, processing must be lawful, fair, and transparent, tied to specified and legitimate purposes, limited to what is necessary, accurate, and not kept longer than needed. Article 6 requires an applicable legal basis. Legitimate interests may be considered, but they are not blanket permission: the collector must weigh the purpose against the interests and fundamental rights and freedoms of the people concerned.
Sensitive data need special caution
Do not infer that a person has agreed to unlimited use of sensitive information simply because a post is visible in a public channel. In a case concerning special-category data, the Court of Justice of the European Union emphasized that visibility alone did not establish that a person had explicitly chosen to make the information public to an unlimited audience for the GDPR exception at issue; context and the person’s choices mattered. Health, political, religious, ethnicity-related, sexual-life, and other sensitive information should therefore be excluded or assessed specifically before collection or analysis.

Plan for people’s rights
Where applicable, people may have rights including access and erasure in defined circumstances. Erasure can be required in situations such as data no longer being necessary, unlawful processing, or a valid objection prevailing. A collector needs a workable process to identify, assess, and respond to requests; neither unconditional deletion in every case nor automatic removal of downstream copies should be promised.
Copyright and computer-access rules are separate questions
A privacy-law basis does not grant copyright rights in posts, photos, or other channel content. Telegram’s terms expressly preserve content owners’ copyright conditions, so assess reuse and republication separately from personal-data processing.
Computer-access law can also depend on how data were accessed and the facts of the dispute. Official court-filed materials in the hiQ/LinkedIn litigation discuss scraping public-facing profiles, a cease-and-desist, technical barriers, and a U.S. Computer Fraud and Abuse Act authorization question. That was not a Telegram case and does not establish that scraping every public website is lawful. It is a reminder that access barriers, platform objections, jurisdiction, and conduct can matter; it is not a safe harbor for Telegram scraping.

- Define the project. Document the purpose, jurisdiction, channel-selection criteria, data fields, intended audience, and downstream uses. Check the current Telegram terms. If relying on the compliant-client, bot, or Mini App exception, collect only what is strictly required to operate that service.
- Do not bypass access controls. Do not evade technical restrictions, use credentials or private access without authorization, or continue after a clear objection without legal review.
- Minimize what you collect. Gather only fields necessary for the stated purpose. Avoid entire histories or media archives when a limited sample, aggregate, or non-identifying result would suffice. Consider whether names, usernames, IDs, profile images, links, or inferred attributes are needed at all.
- Screen for sensitive information. Exclude or specially assess sensitive material before collection and analysis; public visibility alone is not permission for unrestricted reuse.
- Set retention, security, and access controls. Establish a purpose-linked time limit, restrict who can access retained material, secure it, and remove it when no longer needed. Have a process for correction, objection, and deletion requests where applicable.
- Be transparent and prevent foreseeable harm. Consider what notice is required and how people can learn about the processing or exercise rights. Avoid republishing identifiable posts or exposing people to harassment, profiling, discrimination, or other foreseeable harm without a strong lawful reason.
- Assess copyright separately. Verify whether copying, storing, or republishing posts, photographs, or other works is permitted; a data-protection basis is not a copyright license.
- Keep AI/ML plans separate. Do not collect Telegram data for AI/ML development, benchmarking, or deployment unless the specific continuing-consent exception in Telegram’s terms is genuinely met and all other requirements are satisfied.
What to review before making a project-specific decision
There is no universal Telegram scraping safe harbor in the sources discussed here. A meaningful assessment needs the collector’s location, affected audience, access method, data categories, purpose, scale, retention period, and downstream uses. The risk changes substantially between ordinary service operation and independent harvesting, public and restricted access, non-identifying aggregates and identifiable republication, or brief analysis and persistent storage.
For a commercial or cross-border project, sensitive-data processing, large-scale monitoring, or any work involving access restrictions, seek advice from counsel familiar with the relevant jurisdictions and review Telegram’s then-current terms before collecting.
