Ireland’s “Rape Shield” Is Not Preventing Applications to Use Complainants’ Sexual History

A new Irish study says the legal safeguards around complainants’ sexual-history evidence are not stopping applications to introduce it. But the headline figure—at least 39% of sexual-offence trials in 2025 involved such an application—does not show how many applications judges granted or how many complainants were ultimately questioned. The report offers evidence about courtroom practice, not a complete count of outcomes.

What the new report says about Ireland’s rape shield

In a report launched on 1 October 2026, Dr Sinéad Ring, Associate Professor of Law at Maynooth University, examines how section 3 of the Criminal Law (Rape) Act 1981 operates in practice. Supported by Rape Crisis Ireland (RCI), it is described as the first qualitative study of that provision.

The report’s headline statistic, presented in RCI’s summary, is that at least 39% of sexual-offence trials in 2025 involved an application to introduce evidence of a complainant’s sexual history or to cross-examine them about it. That is an application figure—not the proportion of applications granted, nor proof that 39% of complainants were questioned. The Irish Times reported on 1 October 2026 that data on how many applications were granted were unavailable.

Ring’s study draws on 21 in-depth interviews with barristers, solicitors, policy specialists, court accompaniment workers and Legal Aid clerks who had direct experience of the provision. The interviews provide insight into how applications are argued and handled, but they are not a representative survey of all trials or an administrative count of courtroom outcomes.

What the law does—and does not—prohibit

Section 3 of the Criminal Law (Rape) Act 1981 is the sexual-experience provision at the centre of the report. Ireland’s law does not create an absolute ban on sexual-history evidence. The rules give judges a role in deciding whether evidence or questions may be admitted, with the interests of justice relevant to that decision.

Section 21 of the Criminal Justice (Victims of Crime) Act 2017 also gives courts a victim-protection power. Where the court is satisfied that protection from secondary or repeat victimisation, intimidation or retaliation is needed, and that a direction would not conflict with the interests of justice, it may direct how evidence about private life unrelated to the offence is handled and limit related questions in cross-examination. The power is conditional: it is not an automatic exclusion of every question about a complainant’s private life.

In criminal proceedings, “complainant” is the legal term for the person who reports the alleged offence. It does not imply that the allegation has already been proved or disproved.

Changes made in 2024

Parts of the Criminal Law (Sexual Offences and Human Trafficking) Act 2024 commenced on 31 August 2024. The Department of Justice said the right to separate legal representation for a victim facing an application to question them about previous sexual experience was extended to sexual-assault trials, which had not previously been covered. This expanded access to representation; it did not, by itself, replace the underlying section 3 framework.

Why older descriptions of Irish law need a date

A 2021 Oireachtas Justice Committee report said Ireland then had no formal rape-shield legislation in the comparative sense, while describing judge-controlled safeguards, including the requirement that the trial judge first allow sexual-history questioning. That account is historical. It should not be treated as a description of the law after subsequent statutory changes.

What Ring’s interviews say happens in practice

According to the report, arguments for admitting sexual-experience evidence can continue to rely on two discredited inferences: that previous consent predicts consent on a later occasion, and that a complainant’s sexual history makes them less credible. The report says overt character attacks have declined, but that these older assumptions remain relevant to arguments about what evidence is admitted.

The report identifies adults who were previously in a relationship with the accused, as well as child and adolescent complainants, as especially exposed to intrusive questioning. It says young complainants may be asked about matters such as social-media use or accessing pornography. These are findings from interview accounts and the report’s analysis; the study does not quantify how often each practice occurs across all trials.

Short notice and representation

Interviewees described applications being made with little notice, sometimes on the first day of trial. The report says late applications can limit a complainant’s ability to engage with the process and leave the Legal Aid Board under pressure to find a Separate Legal Representative (SLR) at short notice. It also reports considerable variation in SLR quality and experience.

An SLR represents the complainant’s interests in the application concerning sexual-history evidence; this is a distinct role from representing the accused or prosecuting the case. The report’s account points to practical questions as well as statutory ones: whether notice arrives early enough, whether the lawyer can review the material, and whether suitably experienced representation is available.

What Ring recommends changing

The report calls for section 3 to be repealed and replaced with a more tightly defined provision. It also recommends procedural and resourcing changes:

  • Require written notice of applications.
  • Give SLRs a right to see the application and the evidence underlying it.
  • Require courts to provide written reasons for decisions.
  • Create a dedicated Legal Aid Board panel of experienced barristers for the SLR role.
  • Provide ongoing specialist training for SLRs and the judiciary.

These are recommendations in the report, not reforms shown as enacted in the materials available as of 1 October 2026. They address different parts of the problem: a replacement statutory test would shape what evidence may be admitted, while notice, access to material, reasons and experienced representation concern how applications are handled.

What the 39% figure can—and cannot—tell readers

The figure establishes that applications were made in at least 39% of sexual-offence trials in 2025, according to RCI’s summary of the report. It does not establish how often judges allowed them, whether questioning took place, or whether application or questioning rates differed by complainant group. The sources reported no dataset of grants and refusals, so the figure cannot be used as a measure of the rule’s success rate or of the share of complainants questioned.

The report’s interviews add detail about arguments, timing and representation, but they do not establish the frequency of each practice across every Irish court or prove that the law caused changes in reporting or conviction rates. Its central claim is narrower and still significant: the existing safeguards have not prevented applications, and interviewees described practices the report says can expose complainants to intrusive questions grounded in discredited assumptions.
