For businesses, the practical changes are product-specific tariff preferences, formal origin evidence and customs-facilitation commitments—not an automatic discount or guaranteed clearance time for every shipment.
What is the status of the India–New Zealand FTA?
Both countries have completed their domestic processes. New Zealand’s commencement order sets 20 October 2026 as the start date for its implementing Act and identifies the same date as the agreement’s entry into force. India’s Ministry of Commerce has also announced that date. As of 13 October 2026, it is still a forthcoming change. New Zealand’s Ministry of Foreign Affairs and Trade (MFAT) agreement page and India’s Press Information Bureau announcement provide the official status.

What customs rules change on 20 October?
Tariff preferences depend on the product
Check the tariff treatment for the exact product, destination and date. New Zealand Trade and Enterprise (NZTE) says India’s tariff outcomes are set by national tariff line at the eight-digit level. The product’s HS classification, any phase-in schedule, quota and other product conditions can change the rate that applies. Use the official Tariff Finder to check the tariff line and product-specific terms; a headline figure for the agreement is not a shipment’s duty rate.

NZTE says 57% of New Zealand’s current exports to India will be tariff-free from entry into force and 95% will be tariff-free or have sharply reduced tariffs. MFAT separately summarizes the agreement as making more than half of New Zealand exports tariff-free on day one and over 80% tariff-free once fully phased in. These are aggregate estimates, not a prediction for any one product. NZTE cautions: “Do not price, contract, delay a shipment or claim a preference using a headline tariff figure alone.”

Origin is a separate test from where the goods ship
Shipping a product from New Zealand does not, by itself, make it eligible for a preference. The product must meet its specific rule of origin under Chapter 3 and the agreement’s Annexes 3A, 3B and 3C, referenced in New Zealand’s implementing regulations. Imported inputs do not automatically disqualify a finished good; the applicable product rule determines whether it qualifies. If classification or origin is uncertain, seek advice from New Zealand Customs or a customs adviser.
Initially, exporters need a Certificate of Origin
NZTE says New Zealand exporters must obtain a Certificate of Origin from an authorised certifying body when the agreement starts. Although the agreement provides for approved-exporter self-declaration, NZTE says that scheme is not initially available. Its implementation FAQ states: “When the NZ–India FTA enters into force, New Zealand exporters will need a Certificate of Origin issued by an authorised certifying body.” Check current Customs and MFAT implementation guidance before relying on any later change or deciding how to claim a preference: NZTE says the detailed claiming procedure is to be confirmed through that guidance.

What do the customs-facilitation commitments mean?
MFAT summarizes the agreement as requiring India Customs to release all goods within 48 hours and to endeavour to release perishable goods and express consignments within 24 hours. The 24-hour wording is an endeavour, not a guaranteed deadline. Neither commitment promises that a particular shipment will clear in a set time; its actual release can depend on the shipment and applicable checks.

Which other checks can affect a shipment?
Tariff preference does not equal permission to sell
A preferential duty rate does not establish that a product is approved for sale in India. Depending on the goods, separate import permissions, biosecurity or food-safety rules, registration, testing, certification, marking or labelling requirements may apply. Check the relevant Indian import rules for the product and route as well as the tariff.
Some goods have quota or product conditions
The agreement includes quota arrangements for apples, kiwifruit, albumins and certain mānuka honey. Conditions can include quota allocation, seasonal windows for apples and kiwifruit, minimum import prices, and certification for mānuka honey. Confirm the applicable product conditions before relying on a preferential rate. NZTE’s FTA guidance and FAQ outlines the product checks.

How do the benefits differ by direction of trade?
The figures for each country describe different export flows and should not be conflated.

What should exporters check before shipping?
- Identify the product and classification. Confirm the product description and HS classification, then check the relevant eight-digit Indian tariff line.
- Check the rate and conditions. Use the Tariff Finder to verify the rate on the expected import date, any phase-in, and any quota or product-specific condition.
- Test origin eligibility. Find the product-specific origin rule and assess the product and its inputs against it; do not rely on the export location alone.
- Arrange origin evidence. For New Zealand exports at launch, obtain a Certificate of Origin from an authorised certifying body and retain supporting records.
- Check separate import requirements. Confirm any applicable Indian permission, safety, biosecurity, testing, certification, marking or labelling rules. NZTE points to MPI as a potentially relevant agency for food and primary products.
- Confirm the current claim procedure. Consult New Zealand Customs and the latest Customs or MFAT implementation guidance for the preference-claim process. Use a customs adviser where classification or origin is unclear.
