The report says Ascanio and another man told detectives they had entered a Manhattan sewer to search for valuables washed into drains. That explanation concerns this case; it does not establish why people involved in earlier New York sewer-entry sightings went underground.
What happened in the Manhattan case
According to the October 3 report, a 911 caller said three men emerged from a manhole near Park Avenue and East 61st Street at about 4:30 a.m. on September 24. The report says NYPD arrested Ascanio, 25, and charged him and Kevin Rodriguez; a third man remained at large. It describes vehicles blocking manholes and the men fleeing. These details are attributed to the report’s sources and account of the case, not independently verified here against police or court records. [c001]
The report says a criminal complaint recounted that Ascanio and Rodriguez told detectives they went underground to look for valuables washed into storm drains and sewers. That is the basis for describing this incident as a search for valuables—often rendered in headlines as “gold hunting.” It is not evidence that the earlier sewer sightings had the same purpose. The report also says Ascanio faced a suspended-license charge related to the September 24 incident. It attributes to police sources and an ICE spokesperson the account that a federal warrant had been issued two days before the sewer incident, arising from a separate September 20 arrest over alleged criminal mischief involving parts removed from a U-Haul van in Queens. The warrant and charging records were not available in the reviewed sources. [c001]

Why the judge released him—and what happened next
The report identifies the judge as Sheridan Jack-Browne and says she released Ascanio after arraignment on the trespass charge, which the report says was not eligible for bail. It does not establish that she knew about the federal warrant when she made the release decision.
Accounts differ on whether the judge was alerted to an ICE detainer in a separate earlier case: court officials reportedly said she was not notified, while police maintained she had been alerted. Those competing accounts do not establish that the judge acted improperly. The report says ICE later took Ascanio into custody after his release. [c001]

ICE Enforcement and Removal Operations New York City Field Office Director Kenneth Genalo criticized the city’s decision, saying: “New York City had a clear opportunity to transfer this individual to ICE in a secure, controlled environment.” He added: “Instead, the city recklessly released him despite his repeated arrests and unresolved criminal charges — a choice that needlessly returned an alleged public-safety threat to the streets.” These are ICE’s characterizations, not findings by a court. An NYPD spokesperson told the New York Post: “The NYPD does not participate in civil immigration enforcement, in accordance with New York City laws.” Ascanio’s defense attorney, Brian Kennedy, said he was unaware of the reported federal arrest and described the manhole matter as “petty,” according to the same report. How this case relates to other NYC sewer sightings
Associated Press reporting published June 3, 2026 described at least three nighttime sewer-entry instances captured on cameras in Brooklyn and Queens. One Williamsburg video showed roughly seven people emerging into an intersection. In Gravesend, a group emerged after police said they had entered around 11 p.m. A May 5 Queens video showed three people in waterproof gear opening and entering a maintenance hole. NYC’s Department of Environmental Protection said it inspected the two Brooklyn locations and found no infrastructure damage; the Queens incident was still under investigation at the time. The reporting did not establish that these groups were connected to one another or to Ascanio and Rodriguez. [c002]
A September 23 local report described three people seen emerging around 4:35 a.m. near Park Avenue and East 61st Street, a block from a hotel where Israeli Prime Minister Benjamin Netanyahu was expected to stay. At the time, it said there had been no arrests and authorities had not stated what the people were doing underground; it also said there was no evidence of a terrorist connection. The October 3 account later described arrests tied to a September 24 incident. The different publication dates explain why the accounts differ; the earlier report does not disprove the later one. Why entering a sewer is dangerous
Rob Wolejsza, a spokesperson for NYC DEP, warned that: “Sewers can contain numerous hazards, including noxious and potentially deadly gases, unstable surfaces, flooding risks, and confined spaces.” He added: “For these reasons, members of the public should never enter a pipe, drain, catch basin, manhole, or outfall.” [c002]
What remains unconfirmed
The October 3 report describes Ascanio’s release and subsequent ICE custody, but the underlying court docket and federal warrant, and an official ICE custody update, were not available in the reviewed sources. His current immigration-court posture and custody status therefore cannot be confirmed from them. The “lefty judge” wording is political framing; the reporting does not establish what the judge knew about the warrant at the time of release. [c001]
