Indian nationality does not by itself determine eligibility.
The practical distinctions matter: an H-1B visa stamp is used to seek entry, while H-1B status governs authorized employment inside the United States. Job changes, international travel, visa interviews, and the September 2025 payment proclamation each affect those pieces differently.

What H-1B status means for an Indian IT worker
H-1B is an employer-sponsored, temporary classification for a specialty occupation. The job must require the theoretical and practical application of specialized knowledge and at least a bachelor’s degree, or equivalent, in the specific specialty. A software, systems, data, cybersecurity, or similar role therefore needs evidence tying the duties and degree requirement to a qualifying specialty; a job title alone is not enough.

The employer files the petition. Your passport country does not decide whether the position is a specialty occupation, although it can affect visa-processing logistics and reciprocity terms. The Department of Labor describes an annual 65,000 regular cap and a separate 20,000 exemption for beneficiaries with qualifying advanced U.S. degrees. Those are program-wide statutory numbers, not a prediction of an Indian worker’s approval odds or a quota reserved for Indian nationals.
Status, petition and visa stamp are different documents
- Petition: The employer’s filing asks U.S. Citizenship and Immigration Services to classify you for the described job, employer and work locations.
- Status: Once admitted or approved for a change of status, H-1B status authorizes work under the approved terms for the authorized period.
- Visa stamp: A State Department visa is an entry document. It lets you ask for admission at a port of entry during its validity; it does not itself extend your authorized stay or guarantee admission.
Keep the petition, approval notice, passport, visa stamp, admission record and LCA details together. A mismatch between the approved job, worksite, employer or dates can create a problem even when the visa stamp has time remaining.

Pay and workplace protections under the LCA
Before employing you in H-1B status, the employer generally must obtain an LCA and attest to paying at least the higher of two rates: the actual wage paid to workers with similar experience and qualifications in that employment, or the prevailing wage for the occupational classification and area of intended employment. The Department of Labor states the rule this way: “You must be paid the actual wage, which is the same wage rate your employer pays other workers with similar experience and qualifications, or the local prevailing wage for the occupation in the area of intended employment, whichever is higher.”
Protections that can affect your paycheck and working conditions
- Employer-caused nonproductive time: The wage obligation can cover time you are unable to work for reasons attributable to the employer, subject to the governing rules and facts.
- Benefits: H-1B workers must generally receive fringe benefits on the same basis as comparable U.S. employees.
- Deductions and costs: Employers cannot shift certain petition expenses or business costs to the worker in ways prohibited by the H-1B rules. Whether a particular deduction is lawful depends on what the cost was, why it was charged and the surrounding circumstances.
- Working conditions: The employer must provide working conditions comparable to those offered to similarly employed workers.
- Records: Required LCA documentation must be available for public inspection, and you can request information relevant to your employment.
- Retaliation: The rules protect workers who raise compliance concerns or cooperate with an investigation.
Keep pay statements, time records, the legal employer’s name, each worksite, job duties, changes in duties or location, and a copy of the LCA if you can obtain one. If pay, hours or deductions look wrong, preserve the evidence before confronting the issue; a wage dispute can involve both immigration and employment-law consequences.

Can I change jobs on an H-1B?
Often, yes, through H-1B portability, but a job offer alone does not authorize the move. Portability is designed for an H-1B worker already employed in valid H-1B status. The prospective employer must file a qualifying Form I-129 petition before your authorized stay expires and must have an approved, unexpired LCA that covers the offered work.

The Department of Labor describes the purpose of the rule as enabling an H-1B worker to change to a different job without the risk of being “out of status.” That protection depends on meeting the statutory and filing conditions; it is not a blanket permission to work for any company.
Portability decision checklist
- Confirm that you are currently in valid H-1B employment and that your authorized stay has not expired.
- Have the new employer prepare the I-129 petition and obtain an LCA covering the job, occupation, pay and work area.
- Verify that the filing is nonfrivolous and is received before the end of your authorized stay.
- Coordinate the start date with the new employer and retain the filing receipt and a complete copy of the petition package.
- Continue tracking the case after starting. A portability start is tied to the qualifying filing; it is not the same as final approval.
Under the cited portability guidance, a worker who meets the conditions may begin the new employment after the petition is filed and before USCIS adjudicates it. If the petition is denied, withdrawn, materially changes the job, or fails an LCA or status requirement, the ability to continue working can be affected. Get case-specific advice before resigning when your status, maintenance of status or filing timing is uncertain.
| Situation | What it usually means | Key question to verify |
|---|---|---|
| Current H-1B job; new employer has filed a qualifying petition and LCA | Portability may permit work for the new employer before adjudication | Was the filing timely, nonfrivolous and based on an unexpired approved LCA? |
| Offer accepted, but no petition filed | An offer by itself does not authorize H-1B employment | When will the new employer file, and will your authorized stay still be valid? |
| Current status or authorized stay has expired | Do not assume portability cures the lapse | What filing and status-restoration options exist for your facts? |
| Job, duties, pay or worksite differs substantially from the approved terms | The petition and LCA may not cover the proposed work | Does the employer need an amended filing or new LCA? |
Does the September 2025 $100,000 rule apply to my current H-1B?
The State Department’s September 21, 2025 notice describes a presidential proclamation restricting visa issuance and entry for specified H-1B employment petitions filed with USCIS after September 21, 2025, at 12:01 a.m. Eastern Daylight Time. The condition is a $100,000 payment accompanying or supplementing a covered petition, subject to exceptions determined by the Department of Homeland Security.

- [Dont Hesite to Order] 24 hours customer services and professional technology team are standing by
This is described as a condition attached to specified petitions and entry, not as a personal fee that every H-1B worker must pay. USCIS’s September 20, 2025 memorandum says the proclamation is prospective. It does not apply to beneficiaries of petitions filed before the effective date, beneficiaries of currently approved petitions, or holders of validly issued H-1B visas. The memorandum also says it does not prevent current visa holders from traveling to or from the United States.
How to analyze a case under the proclamation
- Identify the date USCIS received the relevant H-1B petition, not merely the date an employer discussed the job.
- Check whether the filing is for a beneficiary or petition category covered by the proclamation.
- Determine whether an exception applies and who, under DHS instructions, must make any required payment.
- Separate the proclamation question from ordinary H-1B eligibility, LCA compliance and visa-screening requirements.
Because proclamations and agency implementation can be amended or litigated, use the latest State Department and USCIS instructions at the time of filing or travel. Do not infer from the $100,000 figure that an existing H-1B worker automatically owes money or that every transfer is blocked.

Leaving the United States can expose a difference that is easy to miss: your status may remain valid while your visa stamp has expired. Status controls whether you are authorized to work while in the United States. A visa stamp is generally needed to seek admission after travel abroad, and admission remains a decision made at the border. Visa validity does not extend the authorized period of stay.

Can I travel to India and return with an expired visa stamp?
An expired stamp normally cannot be used as a current entry visa. Before traveling, check whether you need a new H-1B visa appointment and whether any narrow exception applies to your circumstances. Also check the petition validity, your authorized stay and whether the job and worksite remain unchanged. The September 2025 USCIS memorandum’s statement that the proclamation does not affect current visa holders’ ability to travel does not turn an expired stamp into a valid one.

Yes, under the State Department notice updated September 18, 2026, H-1B and H-4 visa applicants are subject to online presence review and are instructed to make social-media profiles public or open. This is a visa-screening instruction. It does not itself change the underlying H-1B status of someone already in the United States, and compliance does not guarantee visa issuance.

Where should I book my visa interview?
State Department instructions dated July 15, 2026 say nonimmigrant applicants should generally schedule interviews at a U.S. embassy or consulate in their country of nationality or residence. If you apply based on residence, you must be able to demonstrate that residence. Applying elsewhere can make it more difficult to qualify, and the post may apply its own appointment capacity and document instructions.
For an Indian national living in India, that normally means selecting the designated U.S. visa post in India through the current appointment system. An applicant legally resident in another country should be prepared to prove that residence rather than assuming nationality alone determines the correct post.

1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minuteHow long is an H-1B visa stamp valid for Indian citizens?
The India reciprocity schedule lists H-1B and H-4 visas as multiple-entry visas with a listed validity period of 35 months. That is a country schedule, not a promise that every applicant receives exactly 35 months. Consular issuance remains discretionary, and the period printed on a visa only describes when it may be used to seek entry.
| Term | What it answers | What it does not answer |
|---|---|---|
| Visa validity | When the visa can be presented to request admission | How long you may remain after admission |
| H-1B petition validity | Whether the employer’s approved classification covers the job and dates | Whether a consular officer will issue a visa |
| Authorized stay | How long you may remain in the United States under the admission or approved status | Whether a visa stamp can be used after it expires |
| Admission decision | Whether you are allowed to enter on a particular trip | A guarantee based solely on a 35-month reciprocity listing |
H-4 dependents: what this guidance does and does not establish
H-4 applicants are included in the September 2026 online-presence-review instruction, and the India reciprocity schedule lists H-4 alongside H-1B as a multiple-entry visa with 35 months shown. Those facts do not establish when an H-4 spouse qualifies for employment authorization. Employment eligibility depends on current USCIS rules and the individual’s underlying case, so do not rely on an old checklist or assume that an H-4 visa automatically permits work.
A practical preparation checklist
Before changing employers
- Check the end date of authorized stay and collect the latest approval notice.
- Ask the new employer for confirmation that the I-129 was filed and that the LCA is approved, unexpired and covers the proposed work.
- Compare duties, salary, worksite and employment dates with the petition.
- Keep the receipt, petition copy, pay records and communication about your start date.
Before international travel
- Confirm visa-stamp validity, petition validity and authorized stay separately.
- Check the current interview-location rule and gather proof of residence if applying outside India.
- Review the online-presence instruction and make required profiles public or open before the appointment.
- Carry the documents requested by the consulate and evidence that the continuing job matches the approved petition.
When to obtain individualized advice
Speak with a qualified U.S. immigration lawyer when a transfer filing is late, your status may have lapsed, the employer changed materially, you were benched or unpaid, a worksite moved, a petition was withdrawn or denied, or a travel date intersects with a new proclamation or consular instruction. Official rules describe the framework; eligibility and outcomes still turn on the facts in your record.
