The result depends on whether the cost is an eligible operating expense or a capital improvement, whether a qualifying conservation plan covers the work, and how any government payment is treated. Donated conservation easements follow a separate charitable-deduction route.
Are farm conservation expenses tax deductible?
Sometimes. The IRS describes a special deduction for certain soil or water conservation expenses, erosion prevention on farmland, and endangered-species recovery. A farmer in the business of farming may elect to deduct qualifying costs when the work is consistent with a conservation plan approved by the USDA Natural Resources Conservation Service (NRCS), or a comparable state-agency plan if no NRCS plan exists. Keep the plan and records linking the costs to the covered work. These rules are described in the IRS Publication 225 (2025), Farmer’s Tax Guide; use the publication and forms for the tax year being filed.

The land must be used, or have been used, for farming. Costs for land still being developed into a farm do not qualify under this provision while the land is not yet in farming use. Eligibility also depends on the nature of the cost: a conservation purpose alone does not make every project expense deductible.

Publication 225 lists practices such as land leveling, grading, terracing, contour furrowing, restoring soil fertility, constructing diversion channels, drainage or irrigation ditches, earthen dams, watercourses, outlets and ponds, brush eradication, and planting windbreaks. The plan, the land’s use, and the specific work still need to meet the rule.

Costs that may need capitalization instead
The guide excludes expenses to drain or fill wetlands and prepare land for center-pivot irrigation from this special conservation deduction. Depreciable structures and facilities generally must be capitalized and recovered through depreciation rather than deducted as soil and water conservation expenses. Ordinary maintenance and repairs to completed conservation structures may instead qualify as ordinary and necessary farm expenses, depending on the facts.
How does the 25% limit and carryforward work?
The special deduction is limited each year to 25% of gross income from farming. Qualifying expenses above that year’s limit may be carried forward, but the 25% ceiling applies when the carryforward is deducted in a later year. The gross-farm-income calculation for this rule is specific; it should not be assumed to mean Schedule F profit or taxable income.

Publication 225 generally requires a farmer who adopts this treatment to use it consistently in current and later years. A change in method requires IRS approval. Keep records of eligible expenses, the applicable annual limit, and any carryforward used or remaining.

The key comparison is whether a payment covers a deductible operating conservation expense, a capital improvement, or a separate charitable contribution. A project can have a conservation purpose yet fall into a different tax category because of what was built or paid for.

Are conservation-program payments taxable?
Usually, government payments for approved conservation practices are included in income. Some cost-sharing payments for capital improvements may qualify for a partial or full exclusion under federal rules when statutory tests are met. Among other conditions, the payment must be for a capital expense, must not substantially increase the affected property’s annual income, and must be certified by the Secretary of Agriculture as primarily serving specified conservation or environmental purposes. An expense deduction and a related payment exclusion are separate questions: if the farmer deducts the underlying conservation expense, the related cost-share payment generally must be included in income, subject to the separate exclusion rules. A grant or cost-share should not be treated as tax-free merely because it supports conservation.
How are CRP payments taxed?
The Conservation Reserve Program (CRP) has specific treatment. The IRS says its annual rental payments are not rent for federal tax purposes because the government does not use or occupy the land. Individuals generally report CRP payments on Schedule F, and annual payments may be subject to self-employment tax. The IRS identifies an exception to self-employment tax for taxpayers receiving Social Security retirement or disability benefits.

Payments for permanent retirement of cropland base and allotment history are treated differently from annual CRP payments. CRP cost-sharing payments are taxable unless they qualify for the cost-sharing exclusion described above. Check the instructions for the filing year and the forms issued for the payment rather than assuming all CRP receipts share one treatment.
Are conservation easement donations tax deductible?
A donated conservation easement is not a farm operating expense. It may support a charitable contribution deduction if a qualified real-property interest is donated to a qualified organization for a qualifying conservation purpose and the technical requirements are satisfied. IRS Publication 526 describes a conservation restriction as granted in perpetuity. Listed purposes include preserving farmland or forest open space that provides significant public benefit and is preserved for public scenic enjoyment or under a clearly defined government conservation policy. The recipient must be able to monitor and enforce the restriction.

Valuation and compliance matter. The IRS has warned about promoter-driven easement arrangements and inflated valuations; a deduction can be reduced or disallowed, and penalties may apply. The IRS’s 2026 settlement announcement reported more than 1,100 cases, including around 740 docketed in Tax Court and 400 in Exam. It also said 405 cases had been resolved and 32% of offers had been accepted in prior settlement initiatives. Those are counts and outcomes for the IRS’s reported easement-case initiatives, not a measure of whether conservation easement deductions generally are valid or a prediction of any taxpayer’s result. Easement contributions call for property-specific valuation and careful review of current rules.
What should a farmer check before claiming a deduction or exclusion?
- Identify the tax item. Separate conservation work expenses, depreciable improvements, program payments, and donated easements; each follows a different rule.
- Confirm the land and farming status. Determine whether the land is being used, or was previously used, in the farming business and whether it is still only being developed into a farm.
- Match the work to a conservation plan. Retain the NRCS-approved plan or, where no NRCS plan exists, the comparable state-agency plan, and document which work it covers.
- Classify and document each cost. Keep invoices and records that distinguish eligible conservation expenses from capital assets, ordinary repairs, and other farm expenses.
- Reconcile payments with costs. Identify whether a receipt is a CRP payment, a cost-share, or another government payment; assess income inclusion and any exclusion independently of the expense deduction.
- Apply the annual ceiling and track carryforwards. Calculate the special deduction’s limit using the rule’s gross-farm-income measure, not a substitute figure, and retain records of any unused eligible expense.
- Use the correct year’s rules and forms. IRS Publication 225 (2025) is the guide discussed here; verify the relevant filing-year publication, instructions, and requirements before filing.
What about state farm conservation tax credits?
Federal rules do not establish whether a farmer qualifies for a state credit or incentive. State programs are jurisdiction-specific, and eligibility, covered practices, application timing, and tax treatment depend on the state and current agency rules. Without a particular state, no state credit can be identified or promised.
