How U.S. Export Controls Affect Access to AI Chips and Cloud Computing

U.S. chip export controls can affect hardware shipments and some cloud AI-training arrangements. Learn how classification, headquarters, end use, exceptions, and BIS guidance shape access.

U.S. export controls can limit access to certain advanced AI chips—and, in some circumstances, cloud computing that uses them. Whether a transaction needs a license depends on the item’s classification, where it is going, the recipient’s and ultimate parent’s headquarters, the end use and end user, what the parties know, and whether an applicable exception or authorization is available. The rules are not a blanket ban on cloud access. This explanation reflects Bureau of Industry and Security (BIS) material available through October 13, 2026; it is not a determination for any specific transaction.

Why AI chip controls can affect cloud access

Export controls are not limited to a chip crossing a national border in a box. BIS’s rules and guidance address controlled items, their destinations and end users, certain transfers within a country, and some support or AI-training arrangements involving infrastructure-as-a-service (IaaS) providers. As a result, a company can encounter export-control questions whether it buys a chip, receives a server, or uses computing capacity provided by another organization.

As an Amazon Associate I earn from qualifying purchases.

That does not mean every GPU, server, cloud account, or AI workload is controlled or prohibited. A specific determination depends on the item and transaction facts. A product name or model number alone is not a substitute for determining the item’s classification under the Export Administration Regulations (EAR). Nor does the cited BIS guidance establish that an ordinary cloud customer is forbidden from using a particular service.

Two ideas are especially important: the location of a shipment is not always the only relevant geography, and cloud access is assessed through facts such as knowledge, end use, and end user—not simply because a workload runs in a data center.

Which geography and company relationships matter?

For specified advanced-computing items, BIS’s May 31, 2026 guidance says a license requirement applies when the recipient is headquartered in a destination in Country Group D:5 or Macau, or when the recipient’s ultimate parent is headquartered there. The rule described by BIS can therefore matter even when the entity or equipment is physically located in a different country.

This is why “the server is outside China” is not, by itself, enough to resolve the question. The analysis may also require identifying the legal recipient, its headquarters, and its ultimate parent’s headquarters. Country Group D:5 is a regulatory designation; it should not be treated as shorthand for every country, every company with some connection to a listed destination, or every person physically present there. Consult the current EAR and country-group information for a live transaction.

BIS’s summary of the October 2023 advanced-computing updates also describes licensing controls connected with Macau and arms-embargoed destinations, including China, and foreign subsidiaries of entities headquartered in those destinations. The exact reach depends on the applicable control and transaction details. The May 2026 guidance specifically clarifies the headquarters and ultimate-parent link for the specified items; it does not establish that every technology or entity is subject to the same rule.

What makes a chip subject to controls?

BIS describes the advanced-computing framework using technical performance parameters, including performance and performance-density tests. The applicable classification is determined under the EAR, not by whether a manufacturer or customer markets a product as an “AI chip.” BIS’s May 2026 guidance identifies Export Control Classification Numbers (ECCNs) including 3A090.a and .b, 4A090.a and .b, and related .z items in describing the earlier control history. That is not proof that every GPU, server, or cloud instance falls within those entries.

Classification matters because licensing requirements, exceptions, and restrictions can turn on the precise item and its technical characteristics. An organization assessing a transaction should use reliable classification evidence for the hardware and any relevant items, then apply the current EAR provisions to the destination, parties, and proposed use. The BIS public summary of the 2023 updates is useful context, but a summary should not replace operative regulations for a specific classification or license decision.

The rules also include anti-circumvention measures and address diversion risks. A change in shipping route or the use of an intermediary does not necessarily remove a control. The relevant facts can include who ultimately receives or uses the item and whether the transaction changes the end user or end use.

How the controls can reach cloud and AI-training arrangements

BIS’s May 13, 2025 industry guidance describes circumstances in which licensing questions may arise for exports, reexports, or in-country transfers of advanced-computing integrated circuits and certain other commodities used to train AI models. It discusses transfers to IaaS providers where the provider will train AI models for, or on behalf of, parties headquartered in D:5 countries—including China—or Macau. The guidance also addresses changes in end use or end user and certain support by U.S. persons.

The framework is fact-dependent. A provider or other party’s knowledge of a covered end use or end user can be relevant, as can the item’s classification, the customer being served, the relationship between that customer and its ultimate parent, and what the provider is doing with the computing capacity. The guidance does not say that all cloud services or all AI training require an export license. It also does not say that a customer’s mere access to a generic cloud service establishes a violation.

For a company using cloud computing, the practical implication is to avoid treating the cloud provider’s location as the whole analysis. Depending on the transaction, relevant questions may concern the controlled items in the infrastructure, who is receiving or using them, whether the service is being provided for or on behalf of a covered party, the planned model-training activity, and what the involved parties know. The cited material does not decide those facts for an individual account or workload.

Did the 2025 AI Diffusion Rule cancel earlier chip controls?

No. The distinction between the 2025 AI Diffusion Rule and preexisting advanced-computing controls is essential.

Date What BIS said What it means for readers
October 2023 BIS summarized updates to advanced-computing controls, including technical performance parameters, destination licensing changes, anti-circumvention measures, and the Notified Advanced Computing (NAC) exception for certain lower-performance items. These preexisting controls remain relevant; use the current EAR to assess their operative terms.
January 15, 2025 BIS said the AI Diffusion Rule had been issued, with compliance requirements scheduled to take effect May 15, 2025. The rule’s planned compliance date does not establish that those requirements later took effect.
May 13, 2025 BIS announced that enforcement officials would not enforce the AI Diffusion Rule’s new compliance requirements and said it planned to formalize rescission and issue a replacement rule in the future. This announcement concerned the new requirements of that rule; it did not itself erase every earlier control.
May 31, 2026 BIS clarified that preexisting license requirements for specified advanced-computing items linked to D:5- or Macau-headquartered entities continued, including where the entity was physically located elsewhere. For the specified transactions, BIS said exporters should continue to seek licenses unless a specified exception is available.

The May 2025 announcement should therefore not be read as a general cancellation of chip controls. In its May 2026 guidance, BIS said the older license requirement remained for the specified items and entity relationships. Because regulations, country groups, entity lists, and exceptions can change, check the current EAR rather than relying only on these dated announcements.

When can an exception or data-center authorization apply?

Notified Advanced Computing exception

BIS’s summary of the October 2023 updates describes the NAC exception for certain lower-performance items, subject to its terms. For exports and reexports to Macau and arms-embargoed destinations, including China, BIS described a notification process. For some other uses where the exception applies, the summary says shipments may proceed without prior notification. Eligibility cannot be assumed from a chip’s marketing description or performance in isolation: the current EAR sets the exception’s conditions and scope.

Data Center Validated End User program

The Data Center Validated End User (VEU) program is a separate route for eligible data-center operators. BIS describes it as facilitating predictable exports and reexports of eligible items to approved entities after interagency review. Authorizations are specific to the approved entity and eligible items, and may include commitments involving physical and logical security, on-site reviews, and reporting.

A VEU authorization is not a blanket exemption for every data center, its tenants, or every item used in a facility. A cloud customer should not infer that it qualifies merely because its provider operates a data center or has an authorization; the scope of an authorization and the transaction still matter.

BIS’s May 31, 2026 guidance also says bona fide data-center operators otherwise engaged in activities consistent with the EAR were not required, until further notice from BIS, to cease ongoing use, storage, disposal, or servicing of advanced-computing items because of that guidance. This is a limited statement about those ongoing activities. It is not a general authorization for new exports, new users, or any otherwise restricted transaction.

What due diligence does BIS identify for cloud and data-center transactions?

BIS’s May 2025 guidance discusses indicators that can help assess diversion risk. They are compliance considerations, not a universal checklist that independently decides whether a license is required. Relevant review may include:

  • Customer identity and ownership: Check the customer’s incorporation date and ownership structure, including relevant headquarters and ultimate-parent relationships.
  • Business purpose and proposed use: Consider whether the proposed end use is consistent with the customer’s business and stated plans, and whether the transaction could involve a change in end use or end user.
  • Transaction parties: Review who is involved in the sale, transfer, service, or AI-training arrangement, rather than focusing only on the named account holder.
  • Supporting information: Consider customer certifications and attestations from data-center operators, while assessing whether the information is credible and consistent with other facts.
  • Infrastructure capability: Examine server infrastructure and the facility’s capabilities. BIS identifies a data center capable of operating servers containing advanced ICs above 10 megawatts as a reason for additional scrutiny. That figure is a risk indicator in the guidance, not a universal licensing threshold.

These factors can inform diligence but do not replace classification, end-use, destination, and licensing analysis. A facility’s power capacity by itself does not establish that its equipment is controlled or that a particular customer is prohibited.

A practical way to assess a proposed transaction

For a business evaluating a chip purchase, data-center operation, or AI-training service, the following sequence organizes the questions raised in BIS materials. It is not a substitute for legal advice or a transaction-specific EAR review.

  1. Identify the items and classify them. Determine which chips, servers, or other commodities are involved and obtain classification evidence under the current EAR. Do not infer an ECCN solely from a product name or intended AI use.
  2. Map the parties and geography. Identify the exporter, recipient, end user, IaaS provider, and other relevant transaction parties. Check destination as well as the recipient’s and ultimate parent’s headquarters where the applicable control makes that relationship relevant.
  3. Describe the end use and service arrangement. Establish whether items will be used for AI training, whether a provider is acting for or on behalf of another party, and whether there is any proposed change in end user or end use.
  4. Assess knowledge and diversion indicators. Review what the involved parties know and the customer, ownership, business-purpose, infrastructure, and facility information relevant to the transaction.
  5. Check the current licensing path. Determine whether a license is required and whether a specific license exception or entity-specific VEU authorization actually covers the item, parties, destination, and activity. Do not assume that an exception or authorization applies because a similar transaction received one.
  6. Recheck before acting. Confirm current EAR text, country groups, entity lists, and authorizations at the time of the transaction. If the facts are unclear, seek qualified export-control advice before shipment, transfer, or provision of a potentially covered service.

What this means for individual cloud users and companies

An individual user should not conclude from the cited BIS guidance alone that a cloud account, AI model, or workload is banned. The guidance is focused on specific items, parties, uses, and knowledge-dependent circumstances; it does not establish a categorical prohibition on ordinary cloud access.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Companies that export or reexport relevant chips, operate data centers, sell IaaS capacity, or arrange model training have more direct compliance questions to resolve. They may need to establish classification, examine the customer and ultimate-parent relationship, assess intended use and knowledge, and determine whether a license or exception applies. For a concrete transaction, the controlling regulations and facts—not a general summary—determine the result.

Primary BIS materials discussed here are the May 31, 2026 Guidance Regarding Enforcement of License Requirements for Advanced Computing Items for Entities Headquartered in Country Group D:5 and Macau; the May 13, 2025 Controls that May Apply to Advanced Computing Integrated Circuits and Other Commodities Used to Train AI Models; BIS’s May 13, 2025 announcement concerning the AI Diffusion Rule; BIS’s public information summary of the October 2023 advanced-computing updates; and BIS’s explanation of the Data Center VEU program.
