How to Verify the Origin and Export-Control Status of AI Server Hardware

AI server country of origin and export-control status are separate determinations. Verify manufacturing records, exact hardware classification, and the destination, parties, and end use before shipment.
Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Verify an AI server’s customs country of origin and its export-control status as two separate questions. For U.S. import marking, trace where the server and its components were made and assess whether processing in another country substantially transformed the article. For U.S. export controls, identify the exact configuration, determine whether it is subject to the Export Administration Regulations (EAR), establish its classification, and review the destination, parties, end use, and current licensing rules. A country-of-origin label is not an ECCN or an export authorization.

What are you verifying?

“Where was this made?” and “May this be exported to this buyer for this use?” concern different legal determinations. A server can have a supportable country-of-origin conclusion and still require export-control review; neither answer establishes the other.

Question What it concerns Evidence to gather What the answer does not establish
Customs origin for U.S. import marking Manufacture, production, growth, and any later processing that may substantially transform the article. Manufacturing locations and steps, component and assembly records, and the server’s bill of materials (BOM). Its ECCN, whether the EAR applies, or whether a shipment is authorized.
Export-control status under U.S. rules EAR jurisdiction, classification, controlled content, and transaction-specific licensing requirements. Exact hardware configuration, technical classification rationale, relevant U.S.-origin content, and transaction screening records. Customs origin or authorization for a different destination, buyer, end user, or use.

This article addresses U.S. Customs and Border Protection (CBP) origin-marking principles and U.S. Bureau of Industry and Security (BIS) controls under the EAR. It does not determine the outcome under another country’s customs or export-control laws.

Where was this AI server made?

Reconstruct the manufacturing route

Start with the exact model and configuration, not a product family name such as “AI server.” Ask the manufacturer to identify where components were made, where the system was assembled, and where testing, configuration, or other processing took place. Record the manufacturer and facility for each relevant production stage, and keep dated supporting records.

CBP describes origin for U.S. marking as the country of manufacture, production, or growth. If an article is further processed in another country, that later work changes its origin only if it effects a substantial transformation. The question is whether the work produces a new article with a distinct name, character, or use. CBP’s ruling H320225 reproduces the standard: “Further work or material added to an article in another country must effect a substantial transformation in order to render such other country the ‘country of origin’ within the meaning of the marking laws and regulations.”

Do not treat final assembly as an automatic answer

Final assembly, branding, packaging, or configuration in a new country does not automatically make that country the origin. The conclusion depends on the actual production facts and the applicable customs rule; the product label alone is not enough to show how that conclusion was reached.

CBP’s ruling N357918 illustrates the type of detail that can matter in an origin submission, including manufacturer identity, production-stage information, and a BOM. A 2026 CBP ruling, N361684, concerns server cabinets returned to the United States; it is an example involving cabinets, not a ruling that determines the origin of every server system.

What documents should you ask the supplier for?

Request a traceable record for the specific units or configuration under review. A broad statement covering a product line may not establish how a particular system was built.

  • Product identity: exact model, configuration, part numbers, and relevant hardware revisions.
  • Bill of materials: components, manufacturers, and declared origins, with enough detail to connect the BOM to the configuration being shipped.
  • Manufacturing route: facilities and countries for component production, system assembly, testing, configuration, and other material processing.
  • Supporting production evidence: dated production records, supplier declarations, and, where relevant, production-stage diagrams or other facility information.
  • Export classification support: a written ECCN or EAR99 determination for the exact configuration and the technical reasoning behind it.
  • Transaction details: destination, route, buyer, consignee, installation location, ultimate end user, end use, and relevant parent-company information.
  • Review history: dates, rule versions, screening results, and any unresolved assumptions or escalation decisions.

Compare supplier declarations and compliance services on whether they identify the precise configuration, trace back to manufacturing and component records, explain the classification basis, cover relevant parties and end use, and show when the review was performed. A document’s existence is not the same as adequate support for the transaction.

What is the ECCN for this server?

Obtain a configuration-specific classification

Ask the OEM or exporter for a written classification—an Export Control Classification Number (ECCN) or an EAR99 determination—and the technical basis for it. Confirm that the determination matches the shipped configuration, including the relevant hardware and any included software or technology. “AI server” is a marketing or functional description, not a classification.

Also determine whether the item is subject to the EAR. That review may require identifying U.S.-origin parts, software, or technology and considering rules for foreign-produced items. A foreign manufacturing location does not, by itself, answer whether the EAR applies.

Use examples as prompts, not classifications

In its May 13, 2025 policy statement on controls that may apply to advanced-computing integrated circuits and other commodities used to train AI models, BIS discusses items that can be controlled in particular circumstances. Its examples include ECCNs 3A090.a and 4A090.a and certain Category 3–5 “.z” items, including servers classified as 5A992.z. These examples do not classify every AI server; the exact configuration and applicable rules must be assessed.

If the supplier cannot support its answer or the classification is uncertain, BIS explains that an exporter may help determine an ECCN and that a classification request can be submitted to BIS. A classification result is based on the facts supplied; it does not clear a shipment to every destination or buyer.

Does this server need an export license?

Classification is an input to the licensing decision, not the decision by itself. Review the operative EAR provisions against the item and the specific transaction before shipment.

  1. Confirm jurisdiction and classification. Establish whether the item is subject to the EAR and verify the supported ECCN or EAR99 determination for the shipped configuration.
  2. Check current controls. Compare the classification with the current Commerce Control List, country groups, restricted-party and end-use rules, applicable license requirements, and any available license exceptions. BIS EAR Part 740 contains specific exceptions and advanced-computing provisions; use the operative text rather than relying on an old summary.
  3. Screen the complete transaction. Record the destination and route, seller, buyer, consignee, installation location, ultimate end user, declared use, and relevant entity or parent-company information. Keep dated screening results and end-use statements.
  4. Resolve the result for these facts. Determine whether a license is required or an applicable exception is available for this particular item and transaction. Do not infer authorization from a supplier’s prior shipment or an unrelated classification.

BIS guidance dated May 31, 2026 addresses specified advanced-computing items exported to entities headquartered in Country Group D:5 or Macau, or to entities whose ultimate parent is headquartered there, even when the entity itself is elsewhere. Apply that guidance only to items and transactions within its stated scope, and verify the current EAR and any later amendments before relying on it.

What if the origin or classification is uncertain?

Unresolved facts should be treated as open questions, not filled in by assumptions about assembly location, product branding, or the server’s intended use.

  • Origin uncertainty: assemble a precise process narrative with the BOM and production records. If the facts still do not resolve the U.S. marking analysis, consider requesting a CBP ruling.
  • Classification uncertainty: seek a BIS classification determination or qualified export-control advice, supported by technical information for the exact configuration.
  • Transaction uncertainty: obtain missing end-user, parentage, destination, or end-use details before reaching a licensing conclusion.

Government determinations and supplier analyses rest on the facts presented to them. A ruling or classification result does not replace screening each transaction or checking the rules in force when a shipment is made. Because export-control requirements can change, verify current BIS and EAR requirements at the time of review.

Can you determine a particular server’s status from its label?

No specific server model, BOM, manufacturing route, destination, buyer, ultimate parent, or end use is specified here. Those facts are necessary to determine an individual unit’s U.S. country of origin, EAR status, classification, or license requirement. The reliable approach is to document the manufacturing facts for the origin analysis and separately document the item and transaction facts for export review.
