There is no single regulatory pathway for selling an in vitro diagnostic (IVD) across “allied countries.” Replace that broad label with a list of named countries and territories, then verify each market’s product authorization, local legal roles, records, labeling, and post-market obligations separately. An FDA decision, CE mark, or audit certificate may be relevant evidence where a destination regulator allows it, but none should be assumed to authorize sale everywhere.
Start with the exact IVD, intended purpose, and claims
Before comparing countries, define what you plan to place on each market. A product described simply as a “test kit” is not enough to establish its regulatory status. Classification and evidence requirements can turn on the intended purpose and risk, as well as how and where the test is used.

Prepare a product record that captures:
- Intended purpose, target analyte or condition, and the exact performance and clinical claims.
- Specimen type, intended user, and setting, such as a laboratory, point of care, or self-testing.
- Every component in the offer: instrument, assay, calibrator, control, accessory, software dependency, or service.
- Product configurations, manufacturing sites, labeling, and instructions for use associated with each claim.
The Therapeutic Goods Administration (TGA) says intended purpose and risk underpin IVD classification and that the manufacturer is responsible for classification. Do not assume that a classification or evidence package transfers unchanged between markets.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitchesTurn “allied countries” into separate jurisdiction checks
Write down the specific countries and territories where the product will be offered, imported, or supplied. Treat the European Union, Great Britain, and Northern Ireland as separate destinations where relevant: their applicable frameworks are not interchangeable. For every destination, identify the current regulator, governing rules, product classification, market-access route, local legal roles, and official records to verify.

A regulator’s decision does not automatically authorize sale in another market. The U.S. Food and Drug Administration (FDA), for example, says it does not recognize regulatory authorizations from other countries as a substitute for applicable U.S. requirements. Foreign decisions may still be useful evidence if the destination regulator’s rules permit their use.
Keep authorization, registration, and establishment obligations distinct
“Registered” can refer to different things. Depending on the market, an IVD may need product authorization or inclusion in a market register, while the manufacturer, importer, or other establishment may face separate registration, licensing, audit, or quality-system obligations. A distributor’s or importer’s record does not, by itself, establish that the particular device is authorized.
In its Overview of IVD Regulation, the FDA distinguishes establishment registration and device listing from device authorization. Registration and listing do not authorize marketing when premarket authorization is required; a device must meet applicable U.S. requirements, including premarket requirements unless exempt. The FDA also identifies IVD-specific labeling, quality-system, and reporting obligations. Its safety-and-effectiveness assessment considers how false-negative and false-positive performance can affect patients.

Health Canada likewise distinguishes medical device licences (MDLs) from medical device establishment licences (MDELs). Check both the device’s status and the relevant establishment or importer obligations rather than treating one licence as a substitute for the other.
Compare the destination markets that matter to your launch
These examples show why a country-by-country matrix is more reliable than a shared “allied” pathway. Confirm current requirements with the relevant authority before relying on a route or transition provision.
| Destination | Product-market check | Local role or separate check |
|---|---|---|
| United States | Determine applicable FDA requirements, including whether premarket authorization is required or an exemption applies; foreign authorization does not replace U.S. requirements. | Check applicable establishment registration, device listing, quality-system, labeling, and reporting duties. FDA registration is not device authorization. |
| Great Britain | MHRA says devices, including IVDs, must be registered before placement on the Great Britain market. Great Britain remains under UK MDR 2002, with applicable transition provisions for certain CE-marked devices. | A manufacturer based outside the UK must appoint a UK responsible person. Verify the device’s MHRA registration and current eligibility for any transition route. |
| Northern Ireland and EU Member States | EU IVDR has applied in EU Member States and Northern Ireland since 26 May 2022. Confirm the applicable requirements for the specific destination and device. | Confirm the locally applicable manufacturer, representative, importer, and registration obligations for that destination. |
| Australia | Devices generally must be included in the Australian Register of Therapeutic Goods (ARTG) before lawful supply or import. Verify classification and conformity evidence; some self-testing IVDs are currently prohibited from supply. | Identify the Australian sponsor, the person or company legally responsible for supply, and verify the relevant ARTG entry. |
| Canada | For commercial imports, Class II, III, or IV devices generally require an MDL. Class I devices generally do not require an MDL. | The importer generally needs an MDEL covering import activity, subject to exemptions. Check Health Canada’s active device-licence and establishment-licence databases. |
| Japan | Determine Japan-specific IVD authorization and evidence requirements using official Japanese regulatory resources. | MDSAP materials can point to Japan’s PMDA information, but an MDSAP audit certificate alone does not authorize a particular product for sale. |
For Great Britain, MHRA guidance updated 20 February 2026 lists transition provisions for certain CE-marked IVDs: some EU IVDR-compliant IVDs may qualify through 30 June 2030, while some EU IVDD-compliant IVDs may qualify only until the earlier of certificate expiry or 30 June 2030. Eligibility has qualifications and exceptions, so confirm the current MHRA criteria for the exact device before relying on a transition.

Check whether foreign approvals can support the local route
Do not treat a foreign approval as mutual recognition unless the destination authority says the specific route provides that effect. The TGA’s version 2.1 guidance, dated April 2026, describes overseas market-authorisation evidence it may consider for medical devices, including IVDs. Examples include certain FDA 510(k) or PMA decisions, Health Canada licences, EU certificates, and Japanese MHLW or PMDA approvals. This is evidence the TGA may consider under its conditions; it is not a blanket acceptance of those approvals or a replacement for Australian market-access requirements.

For each market, record whether foreign evidence is accepted, for what purpose, under what conditions, and whether the destination regulator still requires its own assessment, application, or register entry. If an authority’s current guidance does not establish that a particular foreign decision can be used, do not assume it can.
Identify the local party responsible for each obligation
Map the legal roles in the supply chain: manufacturer, authorized representative or responsible person, sponsor, importer, distributor, and establishment-licence holder. One company may perform multiple roles, but a commercial distributor does not automatically satisfy every legal obligation. Confirm the appointment, scope, and responsibilities required by the destination regulator.

For example, a non-UK manufacturer needs a UK responsible person for Great Britain registration and specified tasks. In Australia, the sponsor is the person or company legally responsible for supply. In Canada, determine whether the importer needs an MDEL and whether an exemption applies. Record who maintains regulator communications, complaint handling, incident reporting, and any required submission or registration.

Use regulator databases and records rather than relying on a distributor’s marketing statement, certificate image, or a search result alone. Match the record to the product and the party that will actually supply it.
- Legal manufacturer and manufacturing site, where relevant.
- Device name, model, configuration, intended purpose, and class.
- Authorization, licence, registration, or certificate number and scope.
- Validity or expiry status and any restrictions or conditions.
- Local representative, sponsor, importer, or establishment details where recorded.
Health Canada provides active device-licence and establishment-licence databases. Save a dated extract or screenshot and note the database and date checked in the market-entry file. A record that exists but does not match the offered model, intended purpose, manufacturer, or scope should not be treated as confirmation for that product.

Include labels, vigilance, and change control in the launch decision
Market entry is not complete when an initial authorization is obtained. Check local requirements for language, label and instructions-for-use content, claims, importer information, traceability or UDI, complaint handling, incident reporting, field actions, and changes to the product or its evidence. The FDA identifies labeling and quality-system requirements for IVDs; MHRA says manufacturers must report certain incidents in the UK and take appropriate safety action after placement on the UK market.
Assign an owner and a review trigger for each obligation. Product changes, new claims, a site change, revised labeling, an authorization-status change, or a regulatory update may affect the market-entry basis. Verify the applicable change-notification and reauthorization rules for each destination rather than assuming a change accepted in one country is accepted in another.
Build a dated market-entry matrix
Use one row per country or territory. Keep evidence and decisions specific enough that another team member can retrace the check.
- Jurisdiction and applicable regulation or guidance version.
- Product classification and the intended-purpose basis for it.
- Market authorization route, review body, and required technical or performance evidence.
- Foreign evidence relied on, if permitted, and the conditions attached to its use.
- Authorized legal manufacturer, covered site, certificate or licence scope, and official record checked.
- Required local representative, responsible person, sponsor, importer, or establishment licence.
- Label and instructions-for-use version, vigilance contact, and change-control owner.
- Date checked, source record, launch status, and next review date.
Use the matrix to compare real choices—such as review route, local-party requirements, language work, evidence burden, ongoing duties, and transition eligibility—before selecting launch markets. The sources cited here do not establish comparable review timelines, so obtain current timing information directly from each authority rather than ranking markets by an assumed approval speed. For Japan, FDA’s MDSAP international-regulations resource is a directory pointer to official resources, not a substitute for checking Japan-specific IVD requirements; MDSAP is an audit program, not product authorization.
Make the launch decision jurisdiction by jurisdiction
Proceed only when the product’s intended purpose and configuration are fixed, the destination-specific route is documented, required product and establishment obligations are satisfied, local legal roles are in place, the official records match the offer, and labeling and post-market responsibilities are assigned. Recheck volatile transition provisions and authorization status before launch and whenever the product, claims, supply chain, or applicable rules change. For a specific IVD, this process supports a market-entry decision; it does not replace a product-specific determination under the current law of each destination.
