The key distinction is how you access the prices: Shopify’s terms expressly restrict automated monitoring by Shopify users, and its API terms restrict systematic or automated collection through the API. For a public storefront, check its terms and access restrictions, avoid bypassing controls, and use manual review, written permission, or a properly documented data source.
What Shopify’s terms say about automated price collection
Shopify’s Terms of Service, last updated August 1, 2026, say: “You agree not to access the Services or monitor any material or information from the Services using any robot, spider, scraper, or other automated means.” This is a restriction in the terms for Shopify users. It is a strong reason not to use a Shopify account or Shopify services to automate competitor monitoring, but it does not establish that every person visiting a public storefront is bound by the same contract.

Shopify’s API Terms separately prohibit systematic or automated data collection through the API, including scraping, data mining, extraction, and harvesting. They also limit API access to data needed for an authorized application and its permissions. Do not use the Shopify API as a route for building an automated competitor-price collector or product index.
Choose an approach that matches the access you have

Check the storefront before collecting anything
Read the store’s terms
Review the target store’s posted terms for restrictions on automated access, reuse, or monitoring. The fact that a product price is visible without signing in does not, by itself, settle whether collecting it repeatedly is permitted.

Inspect robots.txt, but do not treat it as permission
Shopify explains that robots.txt rules are “directional and advisory” and that not all crawlers are guaranteed to follow them in its robots.txt guidance. A robots.txt file is a signal about a site’s preferences, not a license to collect data or a complete answer to contract, privacy, copyright, or computer-access questions. Respect disallow rules and other objections; compliance with robots.txt alone does not establish that a collection is lawful.
Stop at technical controls or an objection
Do not try to get around a login, paywall, CAPTCHA, crawler block, rate limit, or other restriction. Do not rotate proxies to defeat a block or continue after the store objects. Shopify describes using web application firewall and DDoS protections against much automated traffic in its bot-protection information. If access is blocked or challenged, stop and seek permission or legal advice rather than finding another way through.

Why public visibility is not a blanket scraping license
The Ninth Circuit’s 2022 hiQ opinion concerned public LinkedIn profiles, a cease-and-desist notice, and whether continued access was “without authorization” under the federal Computer Fraud and Abuse Act (CFAA). It was not a Shopify case and does not create general permission to scrape public storefronts. It does not resolve whether a particular store’s terms form a contract, or questions under state law, privacy and data-protection rules, copyright, trespass, interference, or laws in other jurisdictions.

The answer can depend on where you and the store are located, the collection method and scale, the information collected, and the store’s terms and responses. If any of those details matter to a planned recurring collection, get jurisdiction-specific legal advice or written permission.

A practical, lower-risk workflow
- Define the need. Decide which public prices you need, why you need them, and whether a recurring feed is necessary. Avoid collecting personal information.
- Ask first where recurring collection is important. Request written permission or a price feed from the competitor, with agreed limits on fields, frequency, and use.
- If reviewing public pages manually, check the store’s terms and robots.txt. Do not assume that public access or an allowed robots.txt path settles every legal question.
- For a third-party service, verify provenance before relying on it. Request an explanation of the source, authorization basis, collection behavior, and contractual assurances. If the provider cannot document these, do not treat its service as a compliance shortcut.
- Honor restrictions immediately. Stop if the store blocks access, presents a challenge, or objects. Do not evade controls; seek permission or legal review.
