For a HIPAA-covered practice, even a reply meant to correct the record can disclose protected health information (PHI). Keep the public response general, invite the reviewer to contact the practice privately, and route sensitive drafts through the organization’s privacy process.
Why a public reply can create a privacy problem
HIPAA applies to covered entities and business associates within the rule’s scope. The U.S. Department of Health and Human Services (HHS) explains that covered providers include those that conduct certain healthcare transactions electronically. PHI is individually identifiable health information held or transmitted by a covered entity or business associate, in any form or medium. See the HHS Office for Civil Rights (OCR) guidance on consumer health information and its HIPAA Privacy Rule overview.

A practice’s response is its own communication. A reviewer’s decision to describe their experience publicly does not, by itself, give the provider a basis to add or confirm information. Seemingly routine details—such as whether someone had an appointment, received treatment, paid a bill, or has a particular diagnosis—can reveal information about an identifiable person.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsHHS says covered entities generally must take reasonable steps to limit PHI use and disclosure to what is necessary for the purpose. A public reputation reply can usually acknowledge feedback without mentioning any case details. The agency’s minimum-necessary guidance is a useful reminder to avoid including information that is not needed in a public response.

What to say—and what to leave out
Use a neutral, brief acknowledgment
A safe starting point is to acknowledge the feedback, express willingness to hear more, and offer a private contact route without suggesting the reviewer is a patient. For example: “We take feedback seriously and want to learn more. Please contact our office directly so we can discuss your concerns privately.” This is an illustrative template, not an HHS-approved statement or a guarantee that any particular wording is legally sufficient.
Do not confirm or explain an individual’s experience
In the public reply, avoid confirming or elaborating on the reviewer’s patient status, care, appointment, diagnosis, treatment, payment, or record. Do not correct the reviewer by supplying your version of events, even if the review appears inaccurate or the reviewer has already shared personal details. Move the conversation to an appropriate private channel instead.

Keep the reply focused on the next step
A public response does not need a case-by-case explanation to show that the practice takes feedback seriously. Keep it short and avoid individualized medical, scheduling, billing, or record details. Do not argue about the facts or invite the reviewer to post more personal information publicly.
How to handle a draft response
- Pause before posting. Do not reply while frustrated or in an effort to rebut the review point by point.
- Remove case-specific information. Check that the draft does not confirm patient status or refer to care, appointments, diagnoses, treatment, payment, or records.
- Use a private contact invitation. Offer a neutral way to reach the practice without asking the reviewer to share sensitive details in the public thread.
- Escalate sensitive or disputed cases. If the review alleges misconduct, includes a threat, or calls for a factual rebuttal, preserve the review and send the proposed response through the organization’s privacy and legal process. Do not litigate the facts publicly.
What HHS enforcement examples show
HHS OCR has publicized enforcement matters involving disclosures made in responses to negative online reviews. In a 2023 announcement, OCR said New Jersey psychiatric services provider Manasa Health Center agreed to pay $30,000 and implement a corrective action plan to resolve potential violations after a complaint alleged that it disclosed PHI in a response to a negative review. The announcement describes an agreement resolving potential violations, not a court judgment. Read the OCR announcement on Manasa Health Center.

HHS’s 2019 HIPAA compliance report says Elite Dental Associates agreed to pay $10,000 and take corrective action after an OCR investigation found impermissible PHI disclosures in responses on its Yelp review page, among other issues. These are amounts tied to two specific matters; they do not establish a typical penalty or how often providers disclose PHI in review replies. See the 2019 HIPAA compliance report.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Build a privacy check into the response process
HHS says providers and health plans need privacy procedures, workforce training, and an assigned person responsible for privacy. A practice can use those safeguards to make public-review responses more consistent: designate who can draft or approve replies, train staff to spot disclosures, and send sensitive or disputed drafts to the appropriate privacy contact. See HHS OCR’s guidance on what the Privacy Rule requires providers and health plans to do.

HHS guidance about communicating with family, friends, and others involved in a patient’s care addresses specified care-related circumstances; it does not establish a general exception for public review replies. The OCR FAQ on those communications should not be treated as permission to discuss a reviewer’s care online.
This guidance is focused on HIPAA and does not resolve state-law requirements, each platform’s review policies, or how the law applies to a particular dispute. A practice should use its own privacy and legal process when the facts or proposed response are sensitive.
