How to Request Public Records About a Proposed Data Center

A practical guide to finding government records on a proposed data center: identify the right offices, search public portals, and submit focused requests under the applicable law.
Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

To learn what government records exist about a proposed data center, first identify which offices may hold them, search their public project and permit pages, then send a focused written request to each relevant office under the law that applies there. Federal FOIA covers federal agency records—not files held by a city, county, or state. Because no state or project is specified here, you will need to verify the applicable local law, filing route, fees, deadlines, exemptions, and appeal process before submitting a request.

Start by identifying the project and the governments involved

Gather every identifier you can find: the developer or project name, site address or parcel number, municipality and county, project nickname, known permit or zoning number, meeting date, and approximate date range. A proposal may appear under the developer’s name or property details rather than the eventual facility name.

Search official municipal planning and zoning agendas, county development pages, and state environmental or utility agency pages. Data-center oversight is divided differently by state and project. Michigan, for example, describes state roles in electric service, water withdrawals, air emissions, wastewater, wetlands, and construction, while local governments handle land use and community impacts. Iowa similarly distinguishes resource-related permits from city or county land-use and zoning decisions. These are examples, not a nationwide assignment of authority: site conditions, design, operations, and local rules affect which reviews apply. Michigan EGLE data center guidance and Iowa DNR permits and licenses describe their respective state contexts.

Search public portals before asking for copies

Official project pages and permit portals may already provide notices, applications, supporting documents, draft or issued permits, comments, agency responses, environmental analyses, infrastructure plans, and hearing calendars. Search using combinations of the project or developer name, address or parcel, and terms such as “data center,” “server farm,” “site plan,” “zoning,” “permit application,” “public notice,” or “environmental review.”

For example, the Wisconsin DNR Port Washington project page links material on wetlands, stormwater and air permits, public hearings and comments, sewer-area documents, utility review, and environmental analyses. It lists an air-permit comment period of March 3 through April 14, 2026, and says the page will be updated as more material becomes available. Michigan’s guidance points readers to MiEnviro and EGLE public-records systems for permit documents, notices, and other records. Oklahoma DEQ says pending Tier II and III applications and supporting material are available in its permit portal, searchable by company name or county; issued-permit records may be sought from its Central Records section. See Oklahoma DEQ air permitting.

Match each record type to a likely custodian

Do not assume one office has the full file. Make a short list of offices based on the records you want, then check each agency’s public-records instructions. Common starting points include:

Notary Public Record Book
  • Simple, complete recording of notarial acts complaint in all states
  • 522 entries
  • Soft, flexible cover with sewn binding for added durability
  • Sample instructions for use of journal
  • 64 numbered pages
  • City or town planning, zoning, building, clerk, or economic-development office: development applications, site plans, staff correspondence, agendas, minutes, hearing records, and local approvals.
  • County planning, land-use, tax, road, or clerk office: county decisions, property records, and infrastructure matters handled at county level.
  • State environmental agency: records on air emissions, water withdrawals, wastewater, wetlands, stormwater, and related permit applications or compliance.
  • State utility or public-service commission: regulated utility planning, service approvals, rates, or transmission matters.
  • Regional sewer or water authority, or municipal utility: service-area changes, capacity requests, and water or sewer infrastructure plans.
  • Federal agency: records the agency itself holds, such as material about a federal permit, funding, land, or other federal action.

Oklahoma illustrates why records may be distributed even within one state: its guidance assigns air and wastewater or stormwater matters to DEQ, water quantity to the Oklahoma Water Resources Board, and utility rates to the Oklahoma Corporation Commission. Wisconsin’s project page links separate DNR and Public Service Commission material as well as municipal water and sewer submissions. Check the relevant state’s own allocation rather than relying on these examples. Oklahoma DEQ air permitting and Wisconsin DNR Port Washington project page.

Know which public-records law applies

Federal FOIA is not a general public-records law for all government offices. The U.S. Nuclear Regulatory Commission states that FOIA does not apply to records maintained by state and local governments; federal agencies respond for their own records. A federal agency’s involvement does not turn a city’s or state’s files into federal records. If a federal action is relevant, request records from the federal agency likely to hold them, and separately contact state or local offices for their files.

For state and local offices, use the applicable state’s public-records statute and the target agency’s current instructions. There is no central federal FOIA records office, as the U.S. Department of Energy’s Citizen’s Guide on Using the Freedom of Information Act explains. Local and state processes differ, so do not assume a particular response deadline, fee schedule, exemption, or appeal route without checking that jurisdiction’s current rules. The NRC’s Freedom of Information Act Guide also explains the federal/state-local distinction.

Write a narrow request for existing records

A focused request helps staff identify what you are seeking. Identify the project, developer, location, and any parcel or permit number; define the record types; and give a bounded date range. Ask for existing documents rather than asking the office to answer broad questions, conduct new analysis, or create a report. DOE’s federal FOIA guidance recommends specificity and notes that precision can reduce processing time and cost; its guidance applies to federal FOIA requests, not as a substitute for state or local instructions.

Before drafting, decide which records matter most. Depending on the proposal, useful categories may include:

  • Land use: rezoning, conditional-use or variance applications, submitted site plans, staff recommendations, notices, minutes, and approval conditions.
  • Environmental permits and review: applications and supporting files for air emissions, backup generators, stormwater, wastewater, wetlands, or water withdrawals; draft permits, analyses, public comments, agency responses, hearing materials, and final decisions.
  • Water and sewer infrastructure: service-area changes, capacity or service documents, and plans for supply mains or sewer interceptors.
  • Electricity and transmission: utility service, planning, rate, or transmission records that may be part of a utility or public-service commission proceeding rather than an environmental permit file.
  • Post-approval oversight: inspections, required reports, monitoring, and enforcement records, if construction or operations have advanced far enough for these to exist. Michigan says EGLE inspects, reviews required reports, monitors permit conditions, and may take enforcement action.

Which permits or reviews exist depends on location and project details; not every data center needs every permit. Michigan’s guidance notes that site conditions, design, and operations affect the reviews required. See Michigan EGLE data center guidance.

Illustrative request wording

Adapt this example to the applicable law and the office’s filing instructions; it is not statutory wording for every jurisdiction:

Under [state or local public-records law], please provide electronic copies of records held by [office] from [start date] through [end date] concerning the proposed [project or developer] data center at [site address or parcel]. This request includes [identify specific existing records, such as submitted site plans and zoning applications; permit applications and supporting documents; public notices and comments; meeting agendas, minutes, and staff reports; or correspondence about those submissions]. Please contact me before fees exceed [amount], if permitted by the applicable process. If any portion is withheld, please identify the applicable basis and release any portions that may be disclosed under the law.

Follow the agency’s required submission method and wording if it specifies them. DOE’s federal guide says a federal FOIA request should identify the records sought and include the requester’s name and address; do not assume that federal guidance defines state or local requirements. Track responses and handle delays or denials locally

  1. Save a copy of each request, its submission confirmation, agency contact, fee estimate, and response.
  2. Track requests separately by office and subject so you can tell which custodian has responded.
  3. If staff asks for clarification, refine the project identifiers, date range, or record categories rather than repeating an overly broad request.
  4. If records are withheld or a response is delayed, review the agency’s stated reason and the current law or instructions for that office. Follow the stated review or appeal route and applicable deadline.

There is no universal response deadline or appeal process established for an unspecified state, locality, or agency. Verify the current requirements with the records office and governing law before relying on a timeline.
