One free scan finds every outdated or missing driver and matches the right update for your exact hardware.Free scan · exact hardware matchTo seek cross-examination in a GST adjudication, send the adjudicating authority a written, case-specific request before the hearing or final order. Identify the show-cause notice, the exact relied-upon statement, the allegation it supports, the factual dispute, and why questioning that statement’s maker could test the evidence. In the same filing, request any missing relied-upon documents and ask the authority either to schedule cross-examination or explain the refusal and not rely on the untested statement.
What a cross-examination request is meant to achieve
Cross-examination is not a general demand to question everyone connected with a case. It is a procedural request aimed at testing a witness statement that the department is actually using against you. The useful question is not simply whether a person gave a statement, but whether the statement supplies a disputed fact needed for the proposed tax, interest or penalty decision.

A well-framed request gives the adjudicating authority four things it needs to decide the issue:
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errors- the identity and date of the statement;
- the precise passage, page or paragraph being relied on;
- the allegation or computation that passage is said to prove; and
- the factual reason questioning the maker could reveal a mistake, contradiction, lack of personal knowledge, pressure, or another reliability problem.
Ask separately for copies of relied-upon statements and documents that were not supplied with the notice. Access to those materials is necessary to prepare a meaningful reply; it is a different request from cross-examination.

Statutory hearing rights and the limits of the request
Section 75(4): written request for a hearing
Section 75(4) of the Central Goods and Services Tax Act, 2017 (CGST Act) provides an opportunity of hearing when the person chargeable with tax or penalty makes a written request, or when an adverse decision is contemplated. A cross-examination application should therefore expressly request a hearing and connect the request to the statements on which an adverse finding may be based.
The provision does not create an automatic opportunity to cross-examine every person named in an investigation. The practical argument is strongest when the authority proposes to rely on a third-party statement for a disputed factual finding and the maker has direct knowledge of that fact.
Section 75(5): adjournment for sufficient cause
Section 75(5) permits an adjournment for sufficient cause. The authority must record reasons for granting or refusing it, and no more than three adjournments may be granted to a person during the proceedings. If you need more time to obtain documents, instruct a representative, or prepare questions, make a separate adjournment request explaining the cause, the period sought, and why the existing date is impractical.
What recent decisions indicate
The courts treat cross-examination as a fact-sensitive part of natural justice, not as a universal checklist item. The following decisions illustrate how to frame the request.

| Decision | What it supports | Important qualification |
|---|---|---|
| Delhi High Court, W.P.(C) 4853/2025, 2025:DHC:6181-DB, decided 29 July 2025 | Where an adverse decision was based on a third-party statement, the person affected should have an opportunity to cross-examine its maker. The court linked that requirement to the hearing contemplated by Section 75(4) of the CGST Act. | The ruling arose from its particular facts. Your request should still identify the statement, the disputed allegation and the reason cross-examination could affect the result. |
| The Joint Commissioner v. Nishad K.U., Kerala High Court, 2025 | In appropriate proceedings under Section 74, cross-examination of witnesses whose statements form the basis of the case can be integral to natural justice. | The court rejected a request framed to include co-noticees as witnesses and indicated that copies of their replies could instead be sought. Do not treat every co-noticee or participant as a witness you may automatically cross-examine. |
| Madhya Pradesh High Court, GST matter, 2024 | The court recognised that certified copies of relied-upon documents are needed to prepare a defence and, on the facts before it, directed access to seized non-relied-upon originals and cross-examination of witnesses relied on in the notices. | The directions concerning non-relied-upon seized originals were tied to that case. They are not a universal disclosure rule for every GST proceeding. |
| Andaman Timber Industries, Supreme Court | Background authority on natural justice where statements are used as evidence. | The judgment concerned excise adjudication, not GST. Describe it as persuasive background, not as a GST-specific holding. |
The Delhi High Court stated in W.P.(C) 4853/2025: “This requirement flows from the opportunity of hearing required to be given as per section 75(4) of the CGST Act.” Use the quotation only in the context of that third-party-statement dispute; it is not a promise that every cross-examination request will be allowed.
Assess each witness before asking
When a notice cites several statements, evaluate them separately. A short issue map prevents a broad, unfocused application and shows the officer why a particular witness matters.
| Question | What to record |
|---|---|
| Is the statement actually relied upon? | Quote or identify the paragraph, page or annexure in the notice. A person merely mentioned in the narrative is not necessarily a relied-upon witness. |
| What fact is disputed? | State the transaction, date, quantity, classification, supply, receipt, authorship or other fact you contest. |
| Could questions test that fact? | Explain the maker’s personal knowledge, source records, timeline, contradiction, or inability to identify your business or documents. |
| Were supporting materials supplied? | List missing statements, invoices, ledgers, panchnamas, electronic records, reports or annexures and explain their relevance. |
| Is the request timely and specific? | File before the hearing or final order, identify the notice and hearing date, and avoid a generic request for all witnesses. |
This comparison is a practical framework drawn from the reasoning in the cited decisions; it is not a statutory five-part test.
Documents to collect before filing
Assemble a working file in the same order as the notice. Keep the original electronic files and proof of service, not only screenshots of a portal summary.

If a relied-upon item is missing, name it precisely rather than asking for “all documents.” Explain whether the missing item is needed to verify a date, reconcile a figure, identify the maker’s source, or prepare questions.
Step-by-step procedure for making the request
- Read the notice’s procedural directions. Note the adjudicating authority, demand provision, tax period, reply date, hearing date, filing channel and any prescribed document format. The channel may differ between proceedings; the sources reviewed do not establish one universal filing method for every State or Union Territory GST case.
- Address the correct officer. Use the designation and office shown on the notice. Put the GSTIN, legal name, notice number and date in the subject line so the application is matched to the case file.
- Request the hearing in writing. Cite Section 75(4), state that an adverse decision is contemplated or that you require an opportunity to present your defence, and ask for a hearing date if one is not already fixed.
- Create a separate entry for every witness. Give the person’s name or identifier, statement date, document or page reference, and the allegation supported. Do not combine unrelated witnesses in a single vague paragraph.
- Explain the factual dispute. Set out your position briefly and identify the contradiction, missing foundation, timeline problem or lack of personal knowledge that questioning could test. The application is not the place for a complete final submission, but it must show why the request is material.
- List missing relied-upon material. Request a copy of each item and state why it is necessary to answer the notice. Ask for certified copies where authenticity or completeness is material and the case circumstances justify that form.
- Ask for a practical schedule. Request cross-examination at the hearing or on a specified later date, with reasonable time to review documents and prepare questions. You may suggest that the authority first identify which witnesses it intends to produce.
- Preserve the consequence of refusal. Ask that, if cross-examination is refused, the authority give written reasons and not rely on the untested statement for an adverse finding. This preserves the procedural objection without assuming that the authority must accept your legal conclusion.
- File through the stated channel and retain evidence. Save the acknowledgement, diary number, email delivery record, portal receipt, courier tracking or other proof permitted by the notice. Keep the filed version exactly as submitted.
- Follow up before the hearing. If there is no response, send a concise reminder enclosing the earlier acknowledgement and attend or seek directions in accordance with the notice. Do not assume silence means the request was granted.
A practical drafting model
The following sequence is a drafting aid, not a prescribed statutory form. Adapt the bracketed details to the notice and remove any paragraph that does not apply.
To: [designation and office of adjudicating authority]
Subject: Request for hearing, relied-upon records and cross-examination — [notice number, date, GSTIN and tax period]
1. I refer to the show-cause notice dated [date]. I request an opportunity of hearing under section 75(4) of the CGST Act before any adverse decision is made.
2. The notice relies on the statement of [name/identifier], dated [date], at [page/paragraph]. It is relied on for the allegation that [state the allegation]. I dispute [specific fact]. The maker’s personal knowledge, the source records and the conflict with [identify your record or other passage] can be tested only by questioning the maker. I therefore request that [name/identifier] be produced for cross-examination at [hearing/date or a date fixed by the authority].
3. The following relied-upon materials have not been supplied: [item, date, page or identifier]. Each is required to [explain its relevance]. Please provide copies, preferably certified where appropriate, with sufficient time to respond.
4. If the request for cross-examination is declined, please record the reasons and do not rely on the untested statement for an adverse finding. If additional time is required because [sufficient cause], I separately request an adjournment until [period/date] and ask that the decision and reasons be recorded.
5. Please acknowledge this application and communicate the hearing arrangements.
[signature, name, capacity, address, contact details and date]
Attach an index and the issue map. Marking the precise statement passages is more persuasive than attaching a large, unindexed bundle.

Deadlines: what is known and what must be checked
There is no single cross-examination-request deadline established for every GST adjudication, and the material available does not support a universal 30-day reply period. The applicable demand section, the version of the Act in force for the proceeding, and the individual notice control the response date. Use the date printed in your notice and file the request promptly; if the period is close to expiring, seek case-specific professional advice immediately.

Do not wait for a hearing date to be announced if the notice already discloses a relied-upon statement. Early filing allows the officer to decide whether the witness is available and gives you time to examine the documents. If a new statement or document appears later, identify it in a supplemental request and explain when you received it.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. What to do at the hearing
Take a controlled record
Carry the notice, your filed application, acknowledgement, marked statements, document index and a short list of proposed questions. Note the officer’s directions and any statement about whether the evidence will be relied upon. If permitted, have the representative record the date and substance of the direction in the written submission filed afterward.
Keep questions tied to the relied-upon issue
Questions should establish what the witness personally saw, when and where, which record was used, whether the witness can identify the taxpayer or transaction, and how the statement fits with contemporaneous documents. Avoid argumentative speeches or questions about matters unrelated to the allegation.
Ask for missing material on the record
If a witness refers to a document that you have not received, identify it immediately and request a copy and reasonable time to respond. A request made orally should also be confirmed in writing so the file shows exactly what was sought.

If the authority refuses or ignores the request
Ask for a written order or a recorded reason, identify the statement that would otherwise be used, and renew the request in your reply or hearing note. Explain the prejudice: for example, that a disputed transaction depends solely on the statement or that a cited record has not been supplied. Preserve every acknowledgement and order.
A refusal is not automatically unlawful; the outcome depends on whether the statement is relied upon, whether the disputed point is material, and whether the requested questioning could realistically test it. The cited decisions support a stronger objection where an adverse finding turns on an untested third-party statement, while a broad request for co-noticees or peripheral persons may be rejected.
If an adverse order follows, the preserved application, the authority’s reasons, the notice passages and proof of filing become important for whatever statutory appeal or judicial remedy may be available. The correct remedy and time limit depend on the order and governing provision, so obtain advice promptly rather than assuming that filing a cross-examination request suspends any appeal period.
Common mistakes that weaken the application
- Seeking every witness. Limit the request to makers of statements actually relied upon for disputed findings.
- Failing to identify the passage. A name without a date, page or paragraph forces the officer to search and obscures materiality.
- Arguing the entire case in the application. Give enough facts to show why questioning matters, then reserve the full merits reply for the response to the notice.
- Ignoring missing documents. Cross-examination cannot cure the absence of a relied-upon record needed to understand the allegation.
- Using a generic filing channel. Follow the notice’s directions and retain proof; there is no single channel established for all GST adjudications.
- Waiting until after the order. Ask before the hearing or final decision and supplement the request if new evidence appears.
- Assuming a co-noticee is automatically a witness. A co-noticee’s reply may be requested as a document, while cross-examination depends on how the authority uses the person’s statement.
- Requesting an adjournment without cause. State the concrete reason, the time needed and the work that cannot be completed by the current date.
Worked example: turning a broad demand into a useful request
Suppose a notice proposes tax and penalty by relying on a transporter’s statement that goods were delivered to your premises on a particular date. Your records show that the vehicle was elsewhere and that the invoice was cancelled. A weak application would say, “I want to cross-examine the transporter and all department witnesses.”
A stronger application identifies the transporter, statement date and paragraph; quotes the delivery assertion; identifies the disputed date and vehicle; lists the missing delivery challan, GPS extract or inspection record cited in the notice; and explains that questioning can test whether the transporter personally drove the vehicle, saw the recipient, relied on a dispatch record, or confused consignments. It then requests production at a specified hearing, reasons if refused, and non-reliance on the untested assertion.
