Send your request to the public agency that operates or controls the Flock Safety camera system—not automatically to Flock. Flock says its customer agencies own and control their data and directs people seeking customer data to those agencies. The agency’s records custodian can tell you which disclosure office and law apply. Whether particular records can be released depends on the jurisdiction, the records’ status, and any applicable exemptions.
Find the agency and records custodian
Start with the police department, sheriff’s office, city or county, or other public entity that owns or administers the local system. Check its website for a public-records, public-disclosure, or records-request office. If you are unsure which department holds the records, ask the agency’s records custodian to route your request to the appropriate office.

Use the agency’s published request channel and confirm which state or local public-records law applies. People often call a request a “FOIA request,” but requests to local agencies are generally handled under the applicable state or local disclosure rules, not automatically under the federal Freedom of Information Act. The process for a member of the public may also differ from an interagency law-enforcement data request.

Everett Police Department provides one local example: its policy manual, revised April 2, 2026, says non-law-enforcement requests for stored Flock camera data are referred to its public disclosure manager and processed under applicable law. That is Everett’s procedure, not a nationwide rule.

Describe the records so the agency can search
Make the request specific enough to locate existing records. Include a bounded date and time range, the street, intersection, or camera location if known, and brief incident context if it helps distinguish the records. Ask for records held by the agency; do not assume staff must create a new report or answer broad questions about system operations.
Depending on your purpose, you can request existing records in categories such as:

- ALPR images or other responsive stored data for a defined place and time;
- search logs, access records, or preservation records associated with that period or incident;
- the current ALPR or Flock system policy, contract and amendments, retention schedule, or data-sharing agreements;
- public audit or annual reports relevant to the system; and
- any disclosure orders or other records documenting release of responsive data.
These are possible record types, not a promise that every agency creates or retains them, or that each can be disclosed. Flock’s Trust Center describes ALPR records as potentially including license-plate images, vehicle characteristics, timestamps, and camera-location identifiers. An agency may hold access logs or oversight records separately from the underlying camera data.
Ask for preservation promptly
If the records may still be within the system’s retention period, ask the agency to preserve responsive data immediately, identifying the same dates, locations, and incident context as in your request. A preservation request does not itself guarantee that the agency will preserve or release the data; applicable law and agency procedures control. Some data may already have been deleted or may have been retained separately as evidence.

Do not assume there is one retention period for every Flock customer. As of October 4, 2026, Flock’s focused Evidence Policy states a standard retention period of seven calendar days from capture, unless the customer agreement specifies otherwise. Other published materials differ:
| Published period | What the source says | How to interpret it |
|---|---|---|
| Seven calendar days | Flock Safety’s Evidence Policy states this as its standard period from capture, subject to the customer agreement. | Flock’s stated standard, not a universal customer period. |
| Thirty days | Flock Safety’s posted Privacy Policy describes cloud footage storage for 30 days. | This conflicts with the focused Evidence Policy and should not be treated as the current universal rule. |
| Twenty-one days | Everett Police Department’s policy manual, revised April 2, 2026, says the vendor purges its hosted data after 21 days. | Everett’s stated local period, not a national standard. |
Ask the local agency which period applies under its contract, policy, and law, and whether responsive records have been archived as evidence. Flock’s Evidence Policy also says data is permanently deleted and irretrievable after the applicable period; confirm how that statement applies to the particular agency and any separately retained evidence.

Understand why records may be withheld or unavailable
A denial, redaction, or statement that records are unavailable does not by itself establish whether the agency acted properly. Some information may be exempt or confidential under local law; other material may be withheld because it is no longer held or is maintained separately as evidence. The legal treatment varies by jurisdiction and record type.
For example, a North Carolina agency-policy compilation treats ALPR data as confidential criminal-investigation records under cited state law. That is a state-specific example, not a rule that applies across the United States. Everett’s policy, meanwhile, describes local handling and annual oversight practices. These differences are why the agency’s jurisdiction and current policy matter.

Review the response and decide what to do next
When the agency responds, compare the production with the scope and categories in your request. Keep the response letter and any records inventory, and note what was produced, redacted, withheld, or described as nonexistent or deleted.
- Check whether the date, time, and location scope matches what you asked for.
- Note which requested categories were supplied and which were not addressed.
- Look for stated retention, deletion, evidence-archive, access, or sharing practices in any policies, logs, contracts, or reports you received.
- If material was withheld or redacted, ask for the specific legal basis and the review or appeal procedure that applies in that jurisdiction.
If you believe the response missed a record category or misunderstood the scope, ask the records office to clarify or search the defined request again. Follow the agency’s stated review route and deadlines; appeal rights and procedures differ by state and locality.
