How to Read a Utility Rate Case and Find Out Whether Data Centers Pay Their Share

A step-by-step method for reading a utility rate case, testing data-center cost claims, and checking the tariff protections that decide who pays if large loads shift.
Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Whether a data center pays its share of the cost it causes cannot be settled from a single document. A rate case can show whether the commission has assigned that cost to a specific class, contract, or tariff charge, and which protections apply if the load shrinks or leaves. It often does not show, in public form, the full dollar comparison between what a data center costs the system and what it pays over its life. The answer depends on the utility, the state, the tariff, and the record. The steps below show how to read each layer and where the public record stops.

What a rate case decides

A rate case settles three separate questions that readers often blur together. The first is the revenue requirement, the total amount the utility is authorized to collect. The second is class allocation, the division of that total among residential, commercial, industrial, and any separate large-load class. The third is rate design, the tariff charges that turn each class’s share into bills: fixed monthly charges, energy charges per kilowatt-hour, demand charges per kilowatt, time-of-use periods, and minimum bills. Each layer answers a different question, so a finding on one does not settle the others.

In some states these decisions arrive in separate phases; in others they appear in one filing. The commission’s final order, not the utility’s request or a party’s testimony, records what the commission adopted.

  • Overload protection: When the power of the appliance exceeds the overload power, the LCD will display “OVERLOAD” to warn the user. All the buttons will quit working and can only be workable when you lower or remove the load power. The default overload power is 3680W and is adjustable from 0 to 3680W. In general, you need to set the overload power to 1800W before using. Just press the "function" button for more than 3 seconds to enter the setting

1. Confirm what the commission is deciding

  • The utility, the docket number, and the type of proceeding.
  • The rate classes at issue, and whether a separate large-load class is proposed.
  • The testimony cutoff, which fixes the evidence on the record when parties argued their positions.
  • Whether the document is a proposal, a settlement, an interim decision, or a final order. Status words describe different things: “proposed,” “approved,” “conditionally approved,” “effective,” and “under review” are not interchangeable.

2. Find the revenue requirement and cost-of-service evidence

Look for operating costs, capital investment, depreciation, financing costs, and the load forecast that drives them. Find the cost-of-service or marginal-cost study, which shows how the utility says costs vary by class. Check whether the forecast includes the new large load and, if it does, whether that load’s revenue is credited against the costs it creates. Filing structure varies by state, so the labels here may not match your state’s schedules.

3. Trace class allocation

For each major cost, identify the allocator: the measure used to spread that cost across classes, such as peak demand, energy use, or customer count. Then ask two questions. Is any identifiable cost assigned directly to the customer that triggered it? And does a large-load class receive its own allocation, or is it grouped with other large customers?

4. Read rate design and the tariff sheets

Tariff sheets show the charges a customer actually pays. Comparing one customer’s bill with the class’s total cost share is a different test, and a tariff can satisfy one without satisfying the other. A large customer may face a steep demand charge while the class-level allocation still leaves other costs unassigned, so both views need to be read.

5. Read testimony and challenges

Set the utility’s evidence beside testimony from consumer advocates, public staff, environmental groups, large customers, and other intervenors. Note each disputed assumption, each adjustment a party requested, and whether the parties reached a settlement. A settlement shows agreement among the parties; it becomes a commission decision only when the commission approves it.

6. Read the order, then the tariff

The final order records which recommendations the commission accepted, rejected, modified, or deferred. Read that list before the proposed tariff. Then check the approved tariff and any compliance filings for the effective date and final wording, since the tariff can differ from the version argued in testimony.

7. Check the cost-shifting safeguards

Search the order and tariff for the following provisions. Whether they exist, and how their terms are set, determines how much of the risk of a customer leaving or shrinking stays with that customer.

  • Direct assignment of dedicated facilities, and customer contributions toward construction.
  • Minimum contract terms and any optional ramp schedule.
  • Minimum bills or demand charges that apply regardless of use.
  • Collateral, and how it is sized.
  • Exit fees and early termination payments.
  • Treatment of unused or stranded assets if the customer cancels, delays, or scales down.

Separate direct costs from shared costs

Cost causation asks which customer or group caused a cost and how that cost should be assigned. Some facilities serve a single connection; others are shared across the system and need an allocation method. Keep four cost types apart:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Direct interconnection or dedicated facilities, built for a single customer.
  • Broader network upgrades, such as transmission or distribution work that serves several customers.
  • Capacity or generation investment, planned around peak demand and reserve margins.
  • Ongoing energy and operating costs, which vary with use.

A finding that a customer pays its direct connection costs says nothing by itself about the other three. The U.S. Department of Energy identifies fair allocation, stranded-asset risk, resource adequacy, technology risk-sharing, and differing large-customer needs as central rate-design issues in this area. Those issues are a checklist of what a rate case should address, not evidence of how any particular case resolved them.

Test a claim that data centers pay their share

When someone says a data center “pays its way,” put the claim through these questions:

  1. Which costs does the claim cover? Direct facilities only, or network, capacity, and energy costs as well.
  2. Has the commission acted on it? Determine whether the rule is approved, conditionally approved, or still a proposal, and confirm its effective date.
  3. Who carries the assigned costs? A separate class, a special contract, and a general class allocation each produce a different answer.
  4. What happens if the load is smaller than forecast or leaves? Check for the safeguards listed in step 7. Where they are absent, the stranded portion of the investment may fall to other customers.
  5. Can the amount be checked? If customer usage and contract pricing are confidential, the claim can be assessed for its structure but not recalculated to the dollar.

How current proceedings differ

The examples below reflect official materials available as of October 2026. They illustrate different mechanisms; they do not establish a national rule.

California: fixed, energy, and demand charges in Phase II

The California Public Utilities Commission describes a general rate case as the proceeding that addresses a utility’s operating and maintenance costs and how they are allocated among customer classes. For the three large investor-owned electric utilities, Phase I determines the total amount authorized for collection, and Phase II determines each class’s share and its rate schedules. The commission says large utilities file a general rate case every three years. Phase II may include fixed charges in dollars per month, energy charges in dollars per kWh, and demand charges in dollars per kW for large nonresidential customers. If a data center is served on such a schedule, its bill would be built from those charge types, so Phase II is where to look for how its costs are divided.

Virginia: a separate large-load class and minimum obligations

In Case No. PUR-2025-00058, involving Dominion, the Virginia State Corporation Commission describes a separate GS-5 class for qualifying large-load customers. Its account also covers alternative cost-allocation proposals for future proceedings and minimum contract and payment obligations for qualifying new customers. According to the SCC’s account, those obligations apply to contracts entered into on or after January 1, 2027. The account is a summary, so thresholds, applicability, and start dates should be confirmed against the order and tariff. The values are set out in the comparison table below.

Michigan: conditional approval and a planned DTE proposal

The Michigan Public Service Commission describes conditional approval of special contracts with Google, along with conditions meant to keep other customers from covering the cost of serving that customer. The commission also points to a future DTE rate-case proposal intended to ensure that future large-load interconnection customers pay the full costs associated with interconnection. Conditional approval and a proposal are different statuses, and the Michigan example shows both, so the conditions attached to a contract need to be read alongside the contract approval itself.

Missouri: approved tariffs with long commitments

The Missouri Public Service Commission reports that Ameren Missouri and Evergy have approved large-load tariffs, while Liberty’s case remains in progress. Its summary describes minimum service contracts, financial security, exit and early termination fees, a demand charge within the minimum bill, and cost stabilization recovery intended to ensure full cost of service. The values are set out in the comparison table below. These are Missouri tariff provisions as the commission summarizes them.

Pennsylvania: cost causation in the PUC’s May 30, 2026 final order

The Pennsylvania Public Utility Commission’s final order on interconnection and tariffs for large-load customers, docket M-2025-3054271, was published May 30, 2026. The proceeding addressed cost causation and avoiding unreasonable cost shifting. The commission lists the topics it considered: load-size thresholds, deposits, construction contributions, minimum terms, study fees, ramp schedules, exit fees, firm versus interruptible service, standby rates, transparent interconnection costs, and customer-built infrastructure options. The order states:

“Overall, there was broad consensus regarding the fundamental principle of cost causation and the need to protect ratepayers from unreasonable cost shifting.”

That sentence describes the principle the proceeding reflects. It is not a finding that any specific data center pays all of its costs. The list above names topics considered, not terms adopted, so the final model tariff and each utility’s implementing tariff should be checked before stating what applies to a particular project.

South Carolina: a bill, not a rule

Bill 902 proposes commission jurisdiction over data-center electric-service agreements, infrastructure cost recovery, cost-allocation methods, and related utility investment. The text lists possible structures, including direct infrastructure contributions, hybrid recovery, and minimum contract obligations. Bill text shows what was proposed, not what was enacted. Confirm its enactment status through the South Carolina General Assembly’s records before describing these provisions as law.

What the public record can and cannot prove

Public orders and tariffs usually show the rules a commission approved, the conditions attached, and the charge types. They often do not show customer-specific load, contract pricing, or the supporting cost workpapers an outsider would need to calculate the full cost-to-payment match.

Michigan’s case shows the mechanism. The Michigan Public Service Commission describes a protective order under which parties had access to unredacted case materials, while commercially sensitive information could not be made public. A reader can therefore verify that conditions exist and what they require, but may be unable to verify the amounts they produce.

Several conclusions go beyond what current official sources support:

  • That data centers pay their share in general, in any state, or in aggregate. No official source in this guide provides a comprehensive national comparison of data-center payments against all generation, transmission, distribution, reliability, and stranded-asset costs attributable to those facilities.
  • That a percentage, term, or collateral level from one state applies in another jurisdiction or to another customer.
  • That a proposal or bill is law.
