Employers should choose the least intrusive way to meet that purpose, assess risks before deployment, limit and secure the data, and explain clearly what is collected and how it is used. Whether a particular use is lawful depends on the jurisdiction and what the system actually does.
Can an employer use AI to monitor work messages?
Sometimes, but buying or enabling an AI feature does not by itself make monitoring appropriate. Employers need to identify a concrete purpose, establish an applicable lawful basis, and consider whether a less intrusive method can achieve the same result. The UK Information Commissioner’s Office (ICO) puts the principle plainly: “Just because a form of monitoring is available, does not mean it is the best way to achieve your aims.”

AI-powered communications features can involve different kinds of processing: examining message content, analysing communication metadata, or producing aggregate information. The privacy impact depends on the data collected, the outputs generated, who can see them, and how those outputs may affect workers. A tool that flags or summarises communications can still raise monitoring concerns even if it does not present itself as a surveillance product.
The ICO’s worker-monitoring guidance is UK-specific and is under review following the Data (Use and Access) Act. EU employers must also assess whether an employment AI system falls within a high-risk use under the EU AI Act. Other jurisdictions may have different privacy, employment, communications, or AI requirements, so a UK or EU assessment is not a universal legal test.

Choose the least intrusive approach that works
Start by writing down the business objective and the AI’s intended role. Then compare possible approaches against the same criteria: whether the purpose is specific and legitimate, how much data is used, what workers may be exposed to, and what safeguards and legal duties apply.
| Approach | What it uses | Privacy consideration |
|---|---|---|
| Aggregate analysis | Combined or summarised information rather than individual message content, where that can answer the stated question | Can be less intrusive when individual identification is unnecessary. Confirm that the aggregation really serves the purpose and does not simply conceal individual-level monitoring. |
| Metadata analysis | Information about communications, such as network or communication records, without routinely examining message text | Consider whether metadata alone can answer the question before turning to message content. Metadata is still information about workers and should be limited to what is needed. |
| Content analysis | The text or substance of emails and messages | Particularly intrusive. The ICO says email and message monitoring requires a DPIA, advance information to workers, and a clear purpose. |
These are options to assess, not a declaration that any one configuration is automatically compliant. If a less intrusive method genuinely meets the objective, do not default to reading message content just because the platform makes it easy.

Assess risks before monitoring emails or chat
For email and message monitoring, the ICO says employers should complete a data protection impact assessment (DPIA), inform workers in advance, and define a clear purpose. Use the assessment to document why the proposed processing is needed, what data and outputs are involved, and how the effects on workers will be reduced. Consider input from workers or their representatives during that process. If high residual risks cannot be reduced, ICO guidance says to consult the ICO before proceeding.

A useful assessment should consider more than the AI model’s technical operation. It should cover the monitoring purpose, collection method, potential consequences of outputs, access, retention, security, and the vendor’s role. It should also test whether the proposed method is proportionate in the real workplace context, rather than treating a feature’s availability as justification.

Tell workers what the system does
Give workers clear information before monitoring begins. The notice should describe what is monitored, why it is processed, the data and AI-generated outputs involved, who can access them, how long information is kept, and the circumstances in which message content may be examined. Explain how the monitoring works in terms workers can understand, and update privacy information when practices change.
Where an EU employer deploys an AI system that is high-risk under the AI Act’s employment provisions, the employer must inform worker representatives and affected workers before use. Employers need to determine whether a particular system falls into that category rather than assuming every workplace AI feature has the same status.

Minimise, secure, and govern the information
- Collect only what the purpose requires. Limit the data and outputs rather than gathering communications broadly for possible future use.
- Restrict access. Give access only to people who need it for the stated purpose, and define what they may do with the information.
- Set retention periods. Decide how long each category of information is needed and justify the period; avoid indefinite retention by default.
- Apply appropriate security. Protect communications data and derived outputs with measures suited to their sensitivity and potential effects.
- Check accuracy and consequences. Establish a way to review questionable outputs and let workers challenge consequential inferences.
- Reassess changes. If the purpose, data collected, outputs, or access arrangements change, revisit the privacy information and risk assessment.
Protect personal, union, and home-working contexts
Work communications can include personal correspondence and sensitive information. Monitoring may also capture communications with union representatives, a context that calls for particular care. Employers should define safeguards for these situations rather than treating every message as ordinary work data.
Remote work adds another risk: workplace monitoring can expose information about a worker’s home, family, or personal life. Assess whether the proposed collection reaches beyond the work purpose, and use limits that reduce that exposure.

Check the communications provider and AI vendor
An employer remains responsible for monitoring features supplied through a third-party platform. Before deployment, establish the supplier’s role and document instructions, contract terms, security arrangements, data-use settings, and any international data transfers. Do not assume that a commercial communications platform is compliant by default.
Vendor-specific facts matter. The information available here does not establish what any particular provider collects, whether it trains models on customer data, what retention defaults apply, or which people can access outputs. Employers should verify those details against the actual configuration and contract rather than relying on a general product description.
A practical deployment checklist
- Define the purpose: record the specific reason for processing communications and what the AI will generate or support.
- Establish the legal basis: identify and document the applicable lawful basis and any additional condition required if sensitive data is involved.
- Compare less intrusive methods: assess whether aggregate or metadata approaches can meet the purpose before considering content analysis.
- Assess risks: complete a DPIA for email and message monitoring in line with ICO guidance; consider worker or representative input and consult the ICO if high residual risks cannot be reduced.
- Set safeguards: decide collection limits, access controls, retention, security, accuracy checks, and a route to challenge consequential inferences.
- Inform workers: explain what is monitored, the purpose, data and outputs, access and retention, and any exceptional circumstances for examining content.
- Review the supplier: check roles, written instructions, contract terms, security, data-use settings, and international transfers.
- Account for context: address personal and union communications and the added exposure that can arise during homeworking.
- Check EU AI Act scope: for EU deployments, determine whether the employment system is high-risk and, if so, inform worker representatives and affected workers before use.
What workers can ask their employer
Workers who are unsure how AI is being used in workplace communications can ask for the monitoring purpose, the types of information and AI outputs involved, who can access them, and how long they are retained. They can also ask whether message content is examined, what safeguards apply to personal or union communications, and how to raise a concern about an inaccurate or consequential inference. The applicable rights and response obligations depend on local law.
