To prepare for arbitration, first check the arbitration agreement, applicable rules, and the arbitrator’s directions. Then map each claim or defense to the facts and records that matter, build a labeled and indexed exhibit set, and plan how witnesses and exhibits will be presented. There is no universal arbitration procedure: deadlines, information exchange, evidence format, and hearing arrangements depend on the case.
Start with the rules and case instructions
Before collecting or formatting exhibits, read the arbitration clause or agreement, the case notice, the administering provider’s rules, and any procedural orders. Together, these establish which process applies and may set deadlines for exchanging documents, identifying witnesses, submitting pre-hearing materials, and delivering final exhibits. The American Arbitration Association (AAA) explains that information exchange and evidence submission depend on the case; some expedited matters may involve no discovery beyond exchanging exhibits intended for the hearing.

Do not assume that court discovery or evidence procedures apply automatically. If an instruction is unclear, ask the case administrator or arbitrator using the communication process allowed in your case. Note the answers and deadlines in one working checklist so you can track requirements without relying on memory.
- Which rules and deadlines apply?
- How and when must the parties exchange documents and witness information?
- Are exhibits paper, electronic, or both, and are there required naming, numbering, or submission conventions?
- Are originals, copies, a joint exhibit set, or specific pre-hearing submissions required?
- What hearing format is authorized, and what arrangements are needed for witnesses, interpreters, transcripts, or post-hearing briefs?
Turn the dispute into a claim-and-evidence map
Start with the result you are asking the arbitrator to order. For each claim or defense, list the factual points that need to be established, the records or testimony that support them, and anything that could undermine them. This keeps the presentation focused on the dispute rather than the size of an archive.

| Issue or factual point | Supporting or challenging evidence | Why it matters |
|---|---|---|
| What the parties agreed to | Signed agreement, amendments, related notices | Shows the terms that govern the dispute |
| What happened, and when | Emails, letters, invoices, dated records, photographs | Establishes sequence and context |
| What loss or other result followed | Reports, invoices, calculations, relevant records | Connects the events to the remedy requested |
| What the other side may dispute | Contrary records, gaps, inconsistent dates or statements | Helps prepare a fair, responsive presentation |
These are organizing prompts, not a universal list of required evidence. Include a document when it has a clear purpose tied to an issue, and be ready to explain that purpose. A large unfiltered collection can make important evidence harder to find.
Gather and preserve relevant records
Depending on the dispute, useful records may include the agreement and amendments, notices, correspondence, invoices, reports, photographs, and other documents tied to the events at issue. Keep originals or reliable copies intact. Preserve metadata when it may matter, particularly for electronic records; coordinate any electronic information exchange with the other side as the rules or arbitrator require.

The AAA’s preparation guide says original documents or certified copies tend to carry more weight. Treat that as general preparation guidance, not a universal admissibility rule: what the arbitrator may consider depends on the applicable rules, orders, and law. Do not alter source files while organizing them; make working copies for labeling, highlighting, or other preparation.
Build an index and a usable exhibit set
Create a master index before the hearing. Give every proposed exhibit a consistent identifier and record its date, description, source, and the issue it relates to. If the arbitrator or rules specify numbering or format, follow those instructions rather than imposing your own system.

| Identifier | Date | Description and source | Issue supported or challenged |
|---|---|---|---|
| Exhibit 1 | May 4 | Signed agreement; party file | Terms of the agreement |
| Exhibit 2 | May 18 | Email from the parties; email archive | Notice and response |
The sample is illustrative; use the actual dates, identifiers, descriptions, and issues for your case. Sort exhibits chronologically when sequence is central, thematically when the arbitrator needs to compare separate issues, or use a combined approach when distinct issues unfold over time.
For a permitted paper set, numbered divider tabs and clearly labeled binders can make documents easier to locate. For electronic exhibits, use descriptive filenames and, if allowed, bookmarks or an agreed index. The AAA’s guide puts the principle simply: “Organized, labeled files—whether in digital form or printed binders—help you stay prepared and show the arbitrator that you are well-prepared.” The format is a case-specific choice, not a universal requirement.

Follow exhibit exchange and hearing directions
Confirm the deadline, delivery method, numbering convention, and any instructions about copies or originals. Some cases call for party-specific exhibit sets; others may use a coordinated or joint set. Coordinate with the other side when practical to reduce duplicate documents, but identify disputed exhibits clearly and follow the arbitrator’s directions on numbering and admission. An exhibit’s inclusion in a set does not by itself establish that it is admitted or proves its contents.

Prepare witnesses and plan the hearing
For each witness, identify what the person knows firsthand and which records relate to that testimony. Prepare a concise outline of the topics and documents, and make sure the witness understands the hearing format and how to locate relevant materials. Rehearsing likely questions and the sequence of exhibits can help with readiness; testimony should remain truthful and the witness’s own, not scripted to fit a preferred account.
Confirm whether testimony will be live, remote, or submitted in another permitted form, whether the witness must be available for questions, and whether notice deadlines apply. Raise practical needs such as witness availability, remote access, an interpreter, a transcript, expert evidence, or post-hearing briefing at the preliminary or final pre-hearing conference when relevant. The ABA’s guidance for preliminary hearings identifies these as matters for case planning, but the arbitrator’s directions and applicable procedure control.
Practice the presentation and locate evidence quickly
Prepare an opening that identifies the dispute and requested result, and a closing that connects the evidence to that result. Build a short hearing outline that shows where each key exhibit fits and how to move between documents and witnesses. Practice answering likely questions and retrieving the cited page or file without delay. A mock hearing can help reveal gaps in the sequence or indexing before the actual hearing.

AAA’s process information describes AAA-administered proceedings and should not be treated as a rulebook for other providers. Likewise, the ABA’s Model Rules for Fee Arbitration are a model for fee-arbitration programs, not a universal standard. If the dispute could substantially affect your finances, employment, consumer rights, or other legal interests, consider advice from a lawyer qualified in the relevant jurisdiction.
