Personalize marketing by starting with a customer need, using only the first-party signals needed to address it, explaining how those signals shape messages, and making objections and opt-outs work across every channel. A purchase, stated preference, or recent interaction can help make a message relevant; it does not remove the need to consider fairness, privacy, and channel-specific rules.

What first-party data and customer intent mean in practice

First-party data is information a business collects through its direct relationship with a person—for example, details the person provides, purchases, preferences, or interactions with the business. Customer intent is the need or likely interest that a marketer interprets from such information, such as a stated product preference or recent browsing behavior.

Keep direct collection distinct from information obtained from brokers, inferred from unrelated sources, or matched against a platform’s user base. Those methods change what the person may reasonably expect and add processing or sharing steps that need their own scrutiny.

Build a personalization workflow

1. Define the purpose and the signal

Decide what customer need the campaign is meant to address, then identify the minimum signals that can help. Do not collect a field merely because it is available. For each signal, record where it came from, what the person was told, which segment or inference uses it, and what message or channel it informs. This mapping is a practical way to make collection and activation understandable and reviewable.

2. Explain the use clearly

Tell people that you want to collect and use their information for direct marketing. Explain what information is analyzed and how it affects the marketing they receive. The UK Information Commissioner’s Office (ICO) offers this kind of plain-language example: “We use your purchase history to tell you about offers and products we think you may be interested in.” The ICO states: “You must tell people that you want to collect and use their information for direct marketing purposes.” See its guidance on collecting information and generating leads.

3. Assess the lawful basis and channel rules

Consent and legitimate interests are possible data-protection lawful bases for direct marketing, but which is appropriate depends on the circumstances and the processing involved. A lawful basis under data-protection law is not the same as permission required for a particular marketing channel. In the UK, PECR may impose separate consent requirements for electronic mail or for storing or accessing information on a device. Check the rules for the specific activity, audience, and channel rather than assuming one permission covers everything. The ICO discusses these distinctions in its electronic mail marketing guidance.

4. Make objections and opt-outs work end to end

Offer a practical way to stop marketing and ensure the choice reaches every system and activation destination that uses the person’s data. The ICO says people have an absolute right to object to direct marketing at any time, including profiling related to it. Its direct marketing guidance puts it plainly: “Always respect people’s preferences. People have an absolute right to object to or opt out of direct marketing at any time.”

5. Review inferences and outcomes

Check whether the data and inferences are accurate, proportionate, and useful. Consider whether a segment could reinforce stereotypes or unjustifiably exclude people. Explain profiling rather than leaving customers to guess why they received a message, and honor objections to direct marketing and related profiling. When special-category data is used in profiling, the ICO says explicit consent is likely to be required under its UK guidance. Read its profiling guidance for direct marketing.

Choose an approach that fits the signal and expectation

These approaches are not a ranking. Evaluate each against the purpose, the customer’s expectations, the sensitivity of the inference, and whether preferences can be carried through the systems involved.

Approach What it uses Key checks
Personalization from direct interactions Information provided in a direct relationship, such as purchase history or stated preferences Is the signal necessary for the stated purpose? Have people been told how it shapes marketing? Can they object or opt out?
Behavior-based profiling Analysis of purchases or other observed behavior to infer interests Is the inference accurate and proportionate? Could it create stereotypes or unjustified exclusion? Are profiling and its marketing use explained?
Broker or other third-party enrichment Personal information acquired outside the direct relationship Can the supplier establish provenance, age, collection context, notices, consent scope, screening, and rights handling? Is the use within what people were told?
Custom or lookalike platform audiences A customer list matched to platform users, or an audience modeled from an existing audience Is the transfer and audience purpose transparent and appropriately governed? Have the marketer’s and platform’s roles been considered, and can objections be honored?

Use extra care with public, purchased, and platform-matched data

Publicly available information is not automatic permission

Information being accessible online does not mean a person expects it to be gathered and used for targeted marketing. Assess the original context and likely expectations; do not treat public visibility as consent. The ICO addresses this issue in its lead-generation guidance.

Do not silently add contact details

Matching someone to extra contact details without agreement can be unfair in most cases, according to the ICO. If a person gave one channel or detail, do not assume that authorizes adding another and marketing through it. Explain the intended use and assess the applicable permissions before activation.

Verify third-party data rather than relying on assurances

Before using broker-supplied data, ask for evidence of its origin and collection date, the context and notices shown to people, the scope of any consent, screening against preference lists, and processes for objections and other rights. The organization that uses the data remains responsible for its own processing; a vendor’s promise does not settle those checks. The ICO sets out these considerations in its guidance on buying marketing lists.

Treat audience matching as a separate sharing step

Custom audiences commonly involve uploading customer information so a platform can match it to its users; lookalike audiences use an existing audience to find similar users. Explain this use, assess fairness and the lawful basis, and account for the roles of both the marketer and platform. A 2021 Which? report cited by the ICO found that 79% of those questioned were unaware that a social media platform matches profiles to customer lists uploaded by organizations. That is a dated awareness finding, not a current or universal benchmark. The ICO discusses audience matching in its direct marketing guidance.

Keep the campaign review practical

  • Purpose: Is there a specific customer need, and is each signal necessary to serve it?
  • Source: Can you distinguish information provided directly from broker enrichment, inference, or platform matching?
  • Notice and basis: Were people told about the use, and have you assessed the lawful basis and any separate channel requirements?
  • Risk: Could the profile be inaccurate, intrusive, stereotyped, or exclusionary?
  • Control: Can a person object or opt out, and will that choice reach every relevant system and platform?
  • Third parties: Can suppliers substantiate provenance, notices, consent scope, screening, and rights handling?

The ICO is the UK regulator, and its guidance describes UK requirements; it is not universal legal advice. Rules vary by jurisdiction and channel, and ICO guidance may be updated. Review the requirements that apply to the organization, audience, and technology involved.
