Start by identifying whether the fintech vendor works for a healthcare organization or receives records at a patient’s direction. Then limit the data, people, purpose, and duration of access to what that specific workflow needs; configure the narrowest controls the EHR supports; document the rules in the appropriate agreement or authorization; and monitor and revoke access. “Fintech” alone does not determine the vendor’s legal role. This is general U.S. information, not a determination for a particular product or integration.
First establish who is sharing the data and why
Draw the complete data path: the EHR, provider or health plan, fintech vendor, any intermediary or subcontractor, the patient-facing app, and any downstream recipient. For each transfer, note who initiates it, what data moves, the purpose, where it is stored, and whether the vendor acts for the covered entity or at the individual’s direction. A company’s branding or business model does not settle its HIPAA status.

| Access model | What to determine | Why it matters |
|---|---|---|
| Vendor provides a service for a covered entity | Whether it creates, receives, maintains, or transmits protected health information (PHI) on the entity’s behalf, and what service it performs. | The vendor may be a business associate, with duties shaped by HIPAA and the business associate arrangement. |
| Consumer app receives records at an individual’s direction | Whether the person directs a transfer to an app for personal use, and whether that app has technical capacity to draw identifiable health data from multiple sources. | The app may operate outside the covered entity’s HIPAA relationship; FTC rules may apply to consumer personal health record services. |
| Vendor serves both roles | Which service, data store, and transfer belong to each role. | A company that provides business-associate services and also offers a consumer personal health record may have obligations under more than one regime. |
HHS’s health-app scenarios describe circumstances in which a company given PHI by a covered entity to provide or manage that entity’s portal or personal health record service may be a business associate. The FTC’s mobile health app tool explains indicators for consumer personal health records, including technical capacity to draw identifiable health information from multiple sources. Apply the facts of the particular service rather than assuming either source makes every app the same kind of entity.
Choose the narrowest data scope the workflow can support
Before turning on access, specify the transaction and the minimum practical information needed to complete it. Depending on the actual workflow, that might mean identity or eligibility confirmation, a defined date range, particular encounter or billing information, or continuing access. Do not grant a broad record scope solely because it is the default or simplest integration. The appropriate fields cannot be determined without knowing the vendor’s purpose and the EHR’s capabilities.

- Strict tolerances offer ultimate in strength and durability
- Provide an added layer or protection for your most valuable assets from keys and utillity knves to medical equipment, cash tills and more.
- Rings cannot be opened without detection, thus preventing asset substitution.
- Stamped with unique serial number to audit rings and assets and prevent substitutions.
- Key rings crimp to smooth seal and keys are able to rotate the full 360 degrees to prevent bunching.
- Separate one-time checks from workflows that genuinely require ongoing access.
- Decide which records, dates, and actions are necessary; distinguish read access from any write or update capability.
- Record who approved the scope and the reason for it so later reviews can compare actual access with the original need.
Configure authorization, identities, and monitoring
Use distinct vendor identities rather than shared accounts, restrict who can approve or change access, and select the narrowest supported API scopes and resources. Where the EHR offers them, use short-lived credentials with controlled renewal and set an intended end date or review point. Log grants, reads, exports, failed authorization attempts, and scope changes; assign someone to review those records and investigate unexpected activity. Test both revocation and termination before production.
HHS’s healthcare API guidance describes OAuth 2.0 and SMART authorization as mechanisms for enforcing organizational policy, including read-only patient-directed access to all or part of available information. That guidance discusses a historical Sync for Science implementation using FHIR DSTU2; it illustrates a control pattern, not a guarantee that a particular current EHR supports the same features. Verify the actual scopes, resources, consent flow, and revocation behavior with the EHR vendor.

Match the legal basis to the access path
For a patient-directed transfer, determine whether the disclosure is based on the individual’s HIPAA right of access, a valid authorization, a business-associate arrangement, or another permitted basis. Do not assume every API flow uses the same form. If an authorization is required, HHS says it may cover an “entire medical record” or “complete patient file” when the authorization describes the information in a specific and meaningful way; an undefined authorization for “all protected health information” might not be sufficiently specific. A notice of privacy practices does not replace a written authorization when HIPAA requires one. See HHS’s authorization FAQ and notice and authorization FAQ.

Put the limits and offboarding duties in writing
If the vendor acts as a business associate, use the required business-associate framework. For any relevant vendor relationship, make the operational boundaries explicit and consistent with the configured access. Terms to address include:
- Permitted purpose, data categories, users, and access duration.
- Restrictions on unrelated reuse, sale, advertising, or onward disclosure, plus approval rules for subprocessors.
- Security safeguards, cooperation with audits, and prompt escalation of suspected incidents.
- Return or deletion of data at termination, credential revocation, and a transition plan that preserves needed records.
HHS says a business associate may not impermissibly block a covered entity’s access to PHI maintained on its behalf. Where the agreement provides for return at termination, the return must preserve reasonable accessibility and usability. Plan offboarding so vendor credentials end without cutting the covered entity off from its own records. See HHS’s business associate access FAQ. Have privacy/security staff and counsel adapt the agreement to the vendor’s role and applicable law.

Plan for incidents and sensitive records
For HIPAA-covered entities, breaches of unsecured PHI must be reported. HHS says an event affecting 500 or more individuals must be reported to HHS without unreasonable delay and no later than 60 calendar days after discovery; business associates should follow their agreement and applicable HIPAA reporting requirements in notifying the covered entity. Confirm the event, affected people, security status of the data, and duties with incident-response staff and counsel. HHS breach reporting.
For non-HIPAA consumer health apps and related entities, the FTC’s amended Health Breach Notification Rule, effective July 29, 2024, clarified coverage for health apps and that unauthorized disclosures can be breaches; it also updated notification content and timing. FTC guidance says the rule can cover vendors of personal health records, PHR-related entities, and their service providers. A business acting solely as a HIPAA business associate is generally handled under HHS rules, but a business associate that also offers personal health record services to the public may face both regimes. Consult the FTC rule announcement and FTC compliance guidance.

Quick Recap
Use this decision path before enabling access
- Map the route: identify every system, organization, recipient, and purpose in the transfer.
- Classify the service: determine whether the vendor acts for a covered entity, receives data at an individual’s direction, or does both in separate capacities.
- Specify the need: document the data elements, time period, actions, users, and duration the workflow requires.
- Set the boundaries: configure the narrowest supported access and align the agreement or authorization to it.
- Operate and close access: monitor activity, review exceptions, respond to incidents, and revoke credentials and handle retained data when access is no longer needed.
