Launching a crypto token takes more than deploying a smart contract. A project team must define the token’s purpose and rights, assess legal obligations for its offer and related services, choose a suitable network and standard, build and review the contract, then deploy it with controls and operational plans in place. A live contract does not, by itself, make an offering, distribution, custody, exchange, or other service compliant with applicable law.
1. Define the token’s purpose, rights, and distribution
Start by writing down what the token is for and what it actually lets a holder do. Be specific about whether it represents access, a claim, a voting or governance function, a collectible, or something else. A label such as “utility” or “community” does not determine the token’s legal treatment.

Decide who may hold the token and how it will reach them: for example, through an offer, an allocation, a reward, or another distribution mechanism. Map the promised rights to the token’s actual behavior and to the project’s commitments. If those differ, users may receive something other than what the project describes.

- Whether the contract can be upgraded, and who can authorize an upgrade.
- What governance powers exist, who can exercise them, and what those powers can change.
These choices should be settled before implementation. They shape the contract, the launch materials, and the legal analysis.
2. Assess the legal requirements before public launch
Ask qualified counsel to assess the project’s specific facts before public offers, distributions, or trading. The analysis may depend on the token’s rights and design, the issuer and other entities involved, the way it is offered or distributed, the activities the project performs, and the jurisdictions it targets. Consider transfer restrictions, fundraising, custody, exchange functions, and other services as part of the same assessment.
In the United States, the SEC staff’s 2025 statement flags securities-offering and other regulatory issues; it is not a universal classification of every token. In the European Union, Regulation (EU) 2023/1114, known as MiCA, has distinct requirements for covered crypto-asset offers and admissions to trading, with separate provisions for asset-referenced tokens and e-money tokens. The rules that apply depend on the token and activity; this guide cannot classify a hypothetical project.

What MiCA requires for certain offers
For covered offers to the public or admissions to trading in the EU of crypto-assets other than asset-referenced tokens and e-money tokens, MiCA Article 4 includes conditions such as being a legal person and drawing up, notifying, and publishing a crypto-asset white paper, subject to the regulation’s scope and exemptions. Article 6 lists disclosure areas including the offeror or issuer and project, the token and its rights, the technology, risks, and environmental impacts of the consensus mechanism. These are specific provisions, not a complete checklist for every token or service.
Check the current consolidated regulation and relevant competent-authority guidance with counsel. The project’s public materials should not imply that a particular label, contract feature, or launch route removes legal obligations.
3. Choose the network and token standard
Select a network based on the users and applications the project needs to support, wallet and integration compatibility, developer tooling, security assumptions, fees, and the team’s ability to operate it. The available technical references establish Ethereum standards; they do not support a current numerical comparison of fees across networks. Deployment steps and standards should be tailored to the selected network and framework.

On Ethereum-compatible networks, the relevant standard depends on what the token represents:

| Standard | Typical fit | Design distinction |
|---|---|---|
| ERC-20 | Fungible tokens | Defines a common interface for tokens whose units are interchangeable. |
| ERC-721 | Unique items | Supports non-fungible tokens where individual items are distinct. |
| ERC-1155 | Projects needing multiple token types | Supports a multi-token design, including batching. |
These standards address different token needs; none is a universal choice for every chain or product. Ethereum.org’s token standards documentation describes the interfaces and their intended use.
4. Specify and implement the contract
Turn the design into a written specification before coding. Include supply behavior, decimals, minting and burning permissions, transfer restrictions, administrator roles, upgradeability, and the events the contract emits. Specify what happens in ordinary transfers as well as exceptional cases, including failed operations and changes to privileged settings.

For an Ethereum-compatible Solidity project, established reusable components can reduce the need to implement common primitives from scratch. OpenZeppelin Contracts provides reusable Solidity contracts, including token standards and access-control components. Using a library does not validate the way the project combines or configures those components; the resulting contract still needs project-specific testing and review.
Plan for token-reception failures
An ERC-20 transfer to a contract that is not built to recognize or handle ERC-20 tokens can result in permanent loss. Ethereum.org reported that, as of June 20, 2024, at least $83,656,418 worth of ERC-20 tokens had been lost due to this specific reception issue. That is a figure with a 2024 cutoff for this failure mode, not a current total of all token losses. Identify contracts and integrations that may receive tokens, and ensure they are designed to handle the relevant token standard.

Security preparation also includes deciding who controls privileged keys, how those keys are secured, who can exercise governance powers, and how the team will respond to an incident. OpenZeppelin’s mainnet guidance covers audits and security, source verification, secure key management, and governance, and recommends planning well before release. Ethereum.org also recommends access controls and independent review.
OpenZeppelin documentation puts the audit limitation plainly: “Audits do not ensure the absence of bugs, but having several experienced security researchers go through your code certainly helps.” Treat an audit as additional scrutiny, not proof that the contract is bug-free. Testing and independent review reduce risk but do not establish that every possible defect has been found.
6. Deploy, verify, and preserve the release record
For Ethereum, the official deployment guide lists four practical requirements: compiled bytecode, ETH to pay gas, a deployment script or plugin, and access to an Ethereum node. Framework-specific instructions vary, so follow the deployment process for the framework and network the team actually chose.

- Confirm the release inputs. Check the deployer account, contract version, constructor values, network, and the permissions that will exist immediately after deployment.
- Deploy to the intended network. Use the project’s deployment script or plugin and the required network access and gas.
- Verify the deployed source where supported. Confirm that the source and compiler settings correspond to the deployed bytecode; verification makes the contract’s published source easier to compare with its on-chain deployment.
- Document the result. Record the network, contract address, deployment details, source and compiler settings, and the project’s assigned administrative roles.
Keep this release record with the operational materials the team will need to monitor and maintain the token.
7. Publish accurate information and operate the token
Ensure the public description matches the contract’s actual rights, supply rules, administrative controls, and behavior. For covered MiCA white papers, the regulation requires information to be fair, clear, and not misleading, with specified subject areas. Other disclosure duties and continuing obligations depend on the token type, offer structure, jurisdiction, and activities.
After launch, operate the token according to the controls and commitments the project has disclosed. Keep authorized-key and governance procedures usable, monitor integrations and incidents, and make changes only through the governance and upgrade mechanisms the team has specified. If the project changes token behavior, supply policy, or its services, assess whether its technical documentation and legal obligations also need to change.
