How to Keep U.S. Customs Records That Support Your Import Declarations

U.S. importers generally retain entry-related customs records for five years, with important exceptions. Learn what supporting documents to keep and how to make them retrievable for CBP.

For U.S. imports, keep more than the entry form: retain the ordinary-course business records that support the facts declared to U.S. Customs and Border Protection (CBP), organize them so you can produce them promptly, and apply the retention period that fits each record. Under 19 CFR Part 163, the general rule is five years, but several exceptions apply. This guide covers U.S. federal customs recordkeeping; other jurisdictions, product regulators, programs and transaction types may impose different requirements.

What counts as a customs record?

Part 163 applies to a range of people whose business activities require a customs declaration or entry, including owners, importers, consignees, importers of record, entry filers and certain agents. The duty is not limited to the party whose name appears on an entry.

As an Amazon Associate I earn from qualifying purchases.

The regulation defines a record as information made or normally kept in the ordinary course of business that pertains to an activity covered by the rule. That can include paper documents, electronic information and underlying data used to derive information submitted to CBP. In practical terms, if a business record helped establish a fact in an import declaration—or relates to the import activity—it may belong in the customs file even if it was never attached to the entry.

CBP calls records required for entry “entry records” whether or not they were presented at the time of entry. A document’s absence from the original filing therefore does not, by itself, mean it is outside the recordkeeping duty. A packing list, supplier correspondence or calculation used to establish a declared value may matter even if the entry package did not include it.

  • 12-Month Warranty: Backed by a 12-month manufacturer warranty for peace of mind. Designed to meet strict quality control standards for reliable everyday performance.

This broad definition makes the recordkeeping question less about a fixed list of forms and more about what your business actually used or normally retained. If a value on the declaration came from a calculation, for example, preserving only the final number may leave no clear path back to the inputs. If another party supplied the facts, retain relevant correspondence or source material in the ordinary course rather than assuming that the filed declaration explains itself.

The rule can reach records held by different people involved in the transaction. An importer should therefore establish who has the entry data, who has supporting commercial documents, and how those materials can be retrieved. A broker’s involvement does not make it safe to assume that the broker has every invoice, internal worksheet, supplier record or other document that could support the declaration.

Build a file that supports the declaration

Use the entry or transaction as the organizing unit, then preserve the documents and data that explain how the submitted information was determined. The right contents vary with the goods and the claims made; the list below is a practical working file, not an exhaustive official checklist or a requirement that every item apply to every entry.

Core entry and shipment documents

  • The filed entry and entry-summary information, including the data submitted to CBP and the version retained by your business.
  • The commercial invoice or acceptable substitute, along with the packing list and transport documents relevant to the shipment.
  • Evidence of duties or other entry-related payments, where applicable.

CBP’s invoice guidance identifies key invoice information: an adequate description of the merchandise, quantities, values or approximate values, the appropriate eight-digit HTSUS subheading, and the name and complete address of the responsible invoicing party. Keep the invoice and the records used to establish these details. CBP says an invoice or acceptable substitute is submitted with entry documentation before release is authorized, subject to the possibility of a waiver when information is unavailable at release.

Use those invoice fields as a completeness check when you assemble the file. A description should let a reviewer understand what merchandise the entry covers; quantities and values should be traceable to the commercial records used in the transaction; and the invoicing-party information should identify the responsible party. Preserve relevant versions or corrections where they help explain how the final submitted information was reached. The important point is to retain the supporting business record, not simply to make a folder that contains documents with customs-related names.

Support for classification, value and origin

Keep the records your business relied on to determine classification, customs value and country of origin. Depending on the transaction, that may include product specifications, purchase and payment information, cost or pricing calculations, supplier communications, production details and other ordinary-course materials that explain the facts reported. The point is not to accumulate unrelated paperwork: it is to preserve a traceable basis for the declaration and any treatment claimed.

Think of the file as an evidence chain. For a classification decision, link the declared tariff subheading to the product information used to identify the merchandise. For a value, retain the relevant transaction records and calculations that support the number entered. For origin, keep the materials that explain the origin facts relied on. These are practical examples, not a claim that one particular document is required for every product or that the same evidence will answer every customs question.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Where the entry depends on information maintained outside the customs department, include a way to identify that information and its custodian. A product team may maintain specifications, while purchasing or finance may hold commercial terms or payment records. An index that points to those records can make the file more complete and help avoid reconstructing the decision from memory years later.

Support for special tariff treatment and other claims

If an entry claims preferential tariff treatment, retain the relevant certification and the supporting records used to substantiate the claim. Part 163 specifically includes records supporting a USMCA claim among covered recordkeeping activities and also addresses other trade-agreement claims. A certificate by itself may not establish every fact relevant to a transaction; keep the materials used to support the claim and check the rules of the applicable agreement.

Do not treat a preference claim as a stand-alone checkbox in the entry file. Preserve enough of the transaction documentation used to support the claim to connect it to the goods and entry concerned. Which records matter depends on the agreement and facts; Part 163’s broad recordkeeping duty does not replace the need to check the specific agreement rules.

Also retain ordinary-course correspondence, instructions, worksheets or source data that materially informed what was filed. This can help connect the final declaration to the business facts behind it, particularly if the filed figure came from a calculation or information held by another party.

How long to keep each record

Five years is the general U.S. customs retention period, not a universal period for every record. Under 19 CFR § 163.4, an entry-related record is generally kept for five years from the date of entry; another covered record is generally kept for five years from the activity that required it to be created. The regulation sets different periods for several categories:

Record category Retention period under Part 163 How the period is measured or qualified
Entry-related records Five years From the date of entry
Other covered records Five years From the activity requiring the record
Records relating to a drawback claim Until the third anniversary of payment of the claim Specific period under the regulation
Packing lists 60 calendar days From the end of release or conditional release, whichever is later, subject to the regulation’s redelivery-demand timing rule
Certain consignees on informal entries Two years From the informal entry date, where the consignee is not the owner or purchaser and appointed a customs broker
Certain duty-free low-value articles and exempt manifested-cargo records Two years From entry or the activity requiring the record

Use the rule that applies to the specific record rather than assigning one deletion date to an entire shipment folder. A file can contain records with different retention periods. In particular, the regulation’s 60-day packing-list period has qualifications tied to release and redelivery demands; it should not be generalized to invoices or all shipment documents. Likewise, the two-year periods apply only to the described categories and conditions, not to every informal entry or every low-value shipment.

For a practical retention schedule, record the triggering event and category alongside the file’s entry identifier. A calendar reminder based only on the date a document was scanned or uploaded could calculate the period incorrectly, because the relevant date may be entry, release, claim payment or the activity requiring the record. If the category or starting event is uncertain, verify the applicable provision before disposing of the record.

These are minimum periods under the cited federal customs rule, not a complete company retention policy. Another applicable regulation, tax or contract obligation, a customs program, or a litigation hold may call for a longer period. Coordinate retention schedules across the relevant requirements instead of assuming that Part 163 sets the longest deadline for every file. If another customs regulation establishes a different period for a particular record, that rule controls.

Organize files so you can retrieve them quickly

A retention period only helps if the record can be located and produced. Choose a consistent key that joins the declaration to its supporting material—for example, importer, entry number, entry date, supplier and product or SKU. Store the documents in a controlled repository and maintain an index that links important declared data to its source documents.

  1. Capture the filed record. Save the submitted entry and entry-summary information with a clear identifier and the transaction documents that support it.
  2. Connect evidence to declared facts. Index the invoice, shipment documents, classification and valuation support, origin materials and claim evidence under the relevant entry or transaction key.
  3. Preserve readable records. Keep originals unless you use a storage method permitted by the regulation. Prevent unauthorized edits and make sure stored information remains readable and retrievable.
  4. Control access and maintain backups. Limit changes to authorized staff, preserve backup copies and establish how records can be exported or reproduced if requested.
  5. Test retrieval periodically. Have someone other than the file’s usual custodian locate a sample entry and reproduce its supporting documents. A test can expose broken links, unclear naming or access problems before a deadline arrives.

Scanning paper documents can be one way to digitize a file, but using a scanner alone does not establish compliance. The storage method must satisfy the applicable requirements for preservation, retrieval and production. A document-management choice should be judged by whether records remain intact, legible, indexed, secure and producible—not simply by whether paper has been converted to a digital image.

An index can be simple, provided it works. For example, an entry identifier can point to the filed summary, invoice, transport record, payment evidence and any classification, valuation, origin or preference support that applies. Where a document supports more than one entry, make the relationship clear rather than relying on a file name that only one employee understands. Keep the index and access instructions with the records so a staff change does not sever the link between the declaration and its evidence.

Test the entire retrieval path, not just whether a record appears in search results. Check that the item opens, is readable, corresponds to the right entry, includes relevant pages or data, and can be exported or reproduced. For shared drives or document systems, include permissions and backup restoration in periodic checks: a file that exists but cannot be accessed by the person assembling a response is not practically retrievable.

Paper, electronic and alternative storage

Part 163 generally requires records to be maintained as originals unless a permitted alternative method is used. Electronic storage is possible, but the method must preserve the record’s integrity and readability and allow retrieval on lawful request. The regulation’s alternative-method requirements address security, indexing, annual testing, backups and the ability to produce hard copies when CBP requires them.

There is also a specific 120-calendar-day original-format rule for certain importer-held entry records under the conditions in 19 CFR § 163.5(b)(2)(iii). It is not a general statement that every customs record may be discarded or converted after 120 days. Determine whether the particular records and storage arrangement meet the provision’s conditions, and keep originals longer when another requirement or an active matter calls for them.

When deciding how to store a record, consider whether the chosen method preserves the required format for the applicable period, protects integrity and readability, controls access, has working backups, provides a usable index and can produce a copy in the form CBP requests. If an inquiry, detention or proceeding creates a need for original material, follow the applicable requirements for that matter rather than relying on a routine digitization schedule.

The choice between paper and electronic storage is therefore a question of capability, not a universal preference. Paper may be simple to retain but can be difficult to search or produce if files are poorly indexed. Electronic storage can make indexing and retrieval more practical, but only if records stay readable, protected against unauthorized changes, backed up and exportable. Neither method is compliant merely because it is customary for the business.

If you use an alternative storage method, document who administers it and how the business will test it each year, maintain backups and reproduce hard copies when required. Treat a system migration as a recordkeeping event: verify that historical records and their indexes remain accessible in the new arrangement. The 120-day provision is narrow and conditional, so do not use it as an automatic destruction date or as a substitute for checking which records it covers.

What to do when CBP demands records

Under 19 CFR § 163.6(a), the general production period is 30 calendar days after CBP’s demand. CBP may set a shorter period when the records concern admissibility or release. Treat the stated deadline in the demand as controlling and confirm who is responsible for gathering company-held, broker-held and other relevant records.

  1. Log the demand and deadline. Record when it was received, the records requested, the response format and the due date. Identify whether CBP has set a shorter deadline.
  2. Assign one coordinator. Make a records owner responsible for collecting materials from the teams, agents or service providers that hold them. The business should know where broker-held and company-held records are located before a demand arrives.
  3. Gather the complete responsive file. Use the entry key and index to collect the filed declaration and records that support the requested facts. Check for linked calculations, electronic data and correspondence, not only the documents submitted with entry.
  4. Check readability and completeness. Confirm files open, pages are legible, electronic records can be exported and the response corresponds to the scope of the request. Preserve the records and a copy of what was sent.
  5. Request more time before the deadline if needed. Submit a reasoned extension request before the applicable due date and explain the circumstances. Filing a request does not itself grant an extension, so continue preparing the response unless CBP confirms otherwise.

Keep contact details and export procedures current so a designated employee can reach relevant custodians and produce files without relying on one person’s memory. If the business changes systems or service providers, verify that historical records remain accessible and can still be retrieved in a usable form.

Thirty days is the general period stated in the regulation, not permission to wait until the final days to start collecting records. A shorter deadline may apply to records related to admissibility or release, so read the demand carefully and organize the response around the records actually requested. If the demand covers materials held by more than one department or service provider, begin collection promptly and keep track of what has arrived and what remains outstanding.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

An extension request should be made before the applicable deadline and explain the circumstances that make more time necessary. The request itself does not change the due date. Until CBP grants additional time, plan against the original deadline and continue preparing the records. Keep a copy of the request and any response with the demand file so the business can show how it handled the timeline.

What if records were returned or waived at entry?

Do not treat a returned document or a waiver of production at entry as permission to discard the record. Under 19 CFR § 163.3, when entry records submitted to CBP without a demand are returned, or CBP waives production at the time of entry, the person must continue to maintain those records under Part 163.

This distinction matters because filing and recordkeeping are separate obligations. A document may not have been transmitted, may have been returned, or may have been waived at the entry stage and still need to remain in the records system for the applicable retention period. Keep the file complete according to the recordkeeping rule rather than treating the contents of the submission package as the whole record.

Penalties make retrieval part of recordkeeping

Part 163 provides statutory maximum penalties per release for failure to maintain, store or retrieve entry records. For willful failure, the maximum is the lesser of $100,000 or 75% of appraised value. For negligence, it is the lesser of $10,000 or 40% of appraised value. These are ceilings described by the regulation, not a prediction that every recordkeeping error will result in the maximum penalty.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Failure involving records for goods claiming certain special tariff rates can also affect the applicable duty rate. The practical implication is that the file should preserve the supporting basis for a claim and be retrievable when required, rather than merely existing somewhere in an archive.

These consequences explain why recordkeeping includes storage and retrieval, not simply initial collection. A business may have received and saved a document, yet still face a practical problem if it cannot identify which entry it supports, open it, or produce it in a usable form. A consistent index, assigned file owner and periodic retrieval test help address those operational risks; they do not guarantee an outcome in a particular enforcement matter.

Common recordkeeping mistakes to avoid

  • Keeping only the entry form. The ordinary-course records and data used to determine declared facts may also be covered.
  • Starting every clock from the same date. Entry-related records and other covered records have different triggering events, and exceptions use their own timing rules.
  • Assuming a broker holds the whole file. Establish which party holds each record and how the importer can retrieve it in time to answer a demand.
  • Digitizing without testing. An image that cannot be found, opened or read when needed does not solve the retrieval problem.
  • Deleting after a routine period despite an active matter. A separate legal, regulatory, contractual or proceeding-related requirement may call for continued preservation.
  • Treating a certificate as the entire basis for a trade claim. Keep the other records used to establish relevant transaction facts and verify the rules for the specific agreement.

Other avoidable errors include treating the 120-day original-format provision as a universal rule, applying the 60-day packing-list period to an entire shipment file, and counting a retention period from the date a record entered a digital system rather than the event specified by the regulation. Build the schedule around the record category and its trigger, then make sure any other applicable requirement or hold is accounted for before destruction.

Which rules control?

This guide addresses U.S. CBP recordkeeping under 19 CFR Part 163, not customs law in other countries or every product-specific requirement. The eCFR text for Part 163 was shown as up to date as of October 7, 2026; the eCFR is authoritative but unofficial, while the formal Code of Federal Regulations is the official legal edition. CBP’s informed-compliance publication says the regulations control if its explanation differs from them. Check the current regulation and requirements applicable to the product, entry type and claims at issue; a general file checklist cannot determine every transaction’s legal obligations.

For an unusual entry, special tariff claim, regulated product or question about a particular record category, verify the applicable requirements rather than relying on a general retention summary. The invoice details discussed here come from CBP invoice guidance, while retention duties and production rules come from Part 163. The exact records that support a transaction depend on its facts, and other legal or program requirements may add obligations beyond the federal customs baseline.

Frequently Asked Questions

How long should I keep U.S. customs records?

The general Part 163 period is five years: from the date of entry for entry-related records, and from the activity requiring creation for other covered records. Exceptions include certain drawback, packing-list, informal-entry and low-value or manifested-cargo records. Check the category and triggering event before setting a destruction date.

Do I need to keep documents that I did not submit with the entry?

Potentially, yes. CBP’s definition of entry records includes records required for entry whether or not they were presented at entry, and Part 163 also covers ordinary-course information related to covered import activities. Keep supporting calculations, source data or correspondence when they help substantiate declared facts.

Can I rely on my customs broker to keep the file?

Do not assume the broker holds every relevant record or that you can retrieve broker-held material promptly. Establish which party keeps each document and data set, how to access it, and who will coordinate a response if CBP demands records.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Can I store customs records electronically?

Yes, electronic storage is possible, but the applicable method must preserve integrity and readability and allow retrieval on lawful request. Alternative methods have requirements addressing security, indexing, annual testing, backups and hard-copy production when CBP requires it. The specific 120-calendar-day original-format rule applies only to certain importer-held entry records under stated conditions.

How quickly must I respond to a CBP demand for records?

The general period is 30 calendar days after demand, but CBP may set a shorter period for records concerning admissibility or release. If you need more time, submit a reasoned request before the deadline; filing the request alone does not extend it.

If CBP returned a document or waived production at entry, can I discard it?

No. Under 19 CFR § 163.3, returned entry records and records for which CBP waived production at entry must still be maintained under Part 163.

The Bottom Line

Build a traceable file around each entry, preserve the ordinary-course records that support what was declared and claimed, and set retention dates according to each record’s category and trigger. Five years is the general rule, not the only rule. Make sure the records remain readable, indexed and producible, and verify the current requirements for the specific goods, entry and claims.
