What happens if a giveaway winner doesn’t claim the prize?
It depends on the original giveaway terms and the law that applies to the promotion. The terms may authorize contacting an alternate winner after a stated deadline, but a creator should not assume that an unclaimed prize can automatically be kept, redrawn, or given to someone else. If the rules do not say what happens, pause before deciding what to do with a valuable prize and get advice specific to the promotion.

Start by finding the original announcement and full rules as they appeared when entries opened. Check who organized the promotion, what the prize was, how and when a winner had to claim it, any eligibility conditions, and whether the rules describe an alternate winner or another outcome if no valid claim arrives.

How long should you wait for a giveaway winner to respond?
Use the claim window stated in the published rules. The available guidance does not establish a default deadline for a private livestream giveaway, so do not substitute an assumed 24-hour, 48-hour, or seven-day period. If the rules specify a deadline, apply it consistently rather than shortening or extending it arbitrarily.

If the rules are silent or unclear about the deadline or what happens after it, do not invent a forfeiture date and treat it as binding. The answer may depend on the promotion’s jurisdiction, platform, prize, and entry mechanics; seek jurisdiction-specific advice before disposing of the prize or selecting someone else.
What to do when a winner stops responding
- Locate the original terms. Preserve the announcement and rules as they appeared when entries opened. Note the claim method, response deadline, requirements for a valid claim, and any disclosed alternate-winner or unclaimed-prize procedure.
- Check the contact route. Confirm that your notice went through the channel or account identified in the rules. If the rules or your established procedure allows a reminder, send one without changing the deadline arbitrarily.
- Keep a dated record. Save the drawing result, copies and timestamps of notices, any replies, and the date the stated claim window expires. Keep these records private; do not expose a winner’s personal information while trying to reach them.
- Apply the disclosed next step. Once the stated claim period expires, follow the procedure the rules actually provide. If they authorize an alternate winner, follow that process consistently. If no next step was disclosed, pause and seek advice relevant to the organizer’s jurisdiction and promotion before deciding how to handle the prize.
- Arrange safe delivery if the winner responds. Request only information reasonably needed to deliver the prize. Do not charge a claim, processing, or shipping fee as a condition of receiving it, and do not request bank or credit-card details to send it.
- Close the loop carefully. If useful, post a brief factual update that does not reveal private messages or personal details. Do not say the winner forfeited unless the published rules and applicable requirements support that statement.
Keep the prize claim safe
The Federal Trade Commission’s consumer guidance says, “If you have to pay to get your prize, it’s a scam.” The FTC also warns about requests for financial information in prize scams. Do not require a winner to pay a fee to claim a prize or ask for financial details to deliver it. Ask only for information needed for delivery, such as an appropriate mailing address for a physical prize.

The FTC guidance also explains that real sweepstakes are free and by chance and discusses disclosures associated with certain promotions and communications. It is useful for communicating safely with a winner, but it does not establish a waiting period for a livestream giveaway. Read the FTC’s guidance on fake prize, sweepstakes, and lottery scams.
Why lottery deadlines do not automatically apply to a stream giveaway
Government lottery claim procedures are not a universal rule for private creator promotions. For example, North Carolina General Statute 18C-132 concerns lottery drawings and lottery claims; it says lottery prizes unclaimed after the applicable claim period are not abandoned property and are handled under that chapter. That is a lottery-specific rule, not permission for every streamer to keep or reassign a private giveaway prize.

Federal law also addresses certain sweepstakes sent through the mail. The available Title 39 source is a preliminary code page that showed maintenance when accessed, so it should not be used here to claim a general rule for private stream giveaways. For a promotion with unclear terms or meaningful value, get advice based on the actual facts and the relevant jurisdiction rather than borrowing a lottery deadline or assuming a general federal rule settles the question.
Platform policies are a separate check. Rules may differ by platform and change over time; consult the current policy that applies to your channel and promotion before acting on platform-specific requirements.

If the giveaway rules were unclear
Preserve the original announcement, the drawing record, and all communications before making a decision. The outcome cannot be determined from a general rule alone: it may turn on where the organizer is based, the platform, the prize’s type and value, the entry mechanics, and what participants were told. Do not assume silence authorizes keeping the prize, choosing another entrant, or running the giveaway again. Get advice specific to those circumstances.
