Outbyte Driver Updater FREEFix the driver behind crashes, sound loss and screen glitchesFind Drivers →Outbyte PC Repair FREERepair Windows errors before they cause bigger problemsFix Now →Start with public, authorized sources: publisher and developer statements, interviews, contemporary reporting and established game-history archives. Then trace any clip to its earliest findable source and label what the evidence actually establishes. A video is not the same as a playable build, and finding a clip does not prove its origin, date, project or development stage. Don’t download or run an unknown prototype to satisfy curiosity.
How to find footage without chasing unsafe downloads
- Start with public records. Check the relevant developer’s or publisher’s announcements, public interviews and contemporary press coverage. Specialist histories such as Games That Weren’t can help identify cancelled and unreleased projects; its coverage does not mean every item is officially released or authorized for redistribution.
- Trace a clip to its earliest findable publication. Note who uploaded or published it, the date, the description, any named source and the original context. Reposts and compilations can remove those details.
- Look for independent corroboration. A named developer or publisher statement, a reliable contemporary record or genuinely independent sources can strengthen an attribution. Multiple posts repeating one rumor are not independent confirmation.
- Identify what the clip is said to show. Record the claimed project, platform, development period and build. A recording might show an early prototype, not the cancelled project’s final intended form.
- Stay with ordinary video playback. Avoid pages offering an executable, ROM, playable build, password-protected archive or “verification tool” from an unknown host. Don’t install software or disable device protections just to view footage.
How to evaluate whether a clip is what it claims to be
Use the same checks for every clip or archive record. The goal is not to turn a plausible attribution into certainty, but to distinguish documented facts from claims that remain unverified.

| Check | What to record or ask |
|---|---|
| Provenance | Who supplied or published the material? What is the earliest traceable source? |
| Date and context | When was it published, and what development period, platform or build is claimed? |
| Corroboration | Is there a named developer or publisher statement, contemporary record or truly independent reporting? |
| Artifact type | Is this a video recording, source code, a gold master, a distribution file or playable software? These are different things. |
| Rights and policy | Does the rights holder identify the footage or material as leaked, or indicate NDA restrictions? Is sharing permitted? |
| Access safety | Can you watch it as ordinary video, or does access require an unknown download, executable or disabled security feature? |
The Library of Congress Recommended Formats Statement distinguishes software preservation materials—including source code, gold master builds and distribution files—from video recordings. It describes a recording of software in use as a possible substitute when no preservation copy exists or significant online dependencies cannot be recreated. That preservation guidance does not grant consumers permission to download a leak.
The reviewed sources do not establish a universal technical test for proving that leaked or cancelled-game footage is authentic. Use precise descriptions: “attributed to,” “reported as,” or “not independently verified” when that is what the evidence supports. A credible context may support an attribution without establishing permission to redistribute the clip.

Why authenticity, preservation and permission are separate questions
A video can document software without being the software itself. A playable build may preserve features a recording cannot show, while a recording may be the only surviving trace of a version that cannot be run or recovered. Neither fact alone establishes who has the right to distribute it.
That distinction matters in game-history work. James Hodges’s 2015–2016 Electronic Media Review case study, “Unauthorized Archives and Unreleased Software: Preserving a Cancelled Project,” examines Sonic X-Treme, in development from 1994 to 1997. Its abstract describes a grey-market, peer-to-peer preservation effort involving former lead designer Christian Senn, collaborators, collectors and bootleggers. The case illustrates how unofficial collecting can preserve historical traces while leaving authorization and provenance questions unresolved; it is not an endorsement of downloading or distributing unauthorized software.

What publisher policies and U.S. law say—and do not say
Publisher rules are specific to the rights holder and can change. Rockstar says leaked pre-release footage will be taken down regardless of how it was obtained. Bethesda says it may request removal of leaked content or footage from illegally obtained versions, as well as beta material that violates an NDA. Check the relevant rights holder’s current terms before sharing or publishing a clip; these examples are not universal industry rules.
For the United States, the Copyright Office’s Section 1201 overview explains the DMCA’s restrictions on circumventing technological measures that control access to copyrighted works, including games. The current 37 CFR 201.40 includes limited, carefully conditioned exemptions, including certain preservation activities by eligible institutions and specific cases involving qualifying lawfully acquired games after an external server stops providing access. These are not a general personal license to acquire leaked software, bypass access controls or repost footage. Rules vary by jurisdiction; consult a qualified lawyer about a specific situation.

Nintendo’s Intellectual Property & Piracy FAQ defines piracy to include copying, downloading or distributing illegal game products and warns that suspicious offers can be scams seeking money or personal information. That warning is not a reason to label every video, archive or historical discussion as piracy; evaluate the particular material and its context.

An unknown build is not a safe way to authenticate a clip. Malware scans can reduce risk but cannot prove a file is benign. CISA’s device-protection guidance recommends keeping systems updated, watching for phishing, using a standard account for routine activity and making secure backups.

- For your notes, keep the URL, capture date, uploader or publisher, named source and the project or build attribution claimed.
- Mark whether a detail comes from official documentation, firsthand testimony, contemporary reporting or a repost.
- Preserve uncertainty in your notes as well as in any public description; do not turn a repeated claim into a confirmed fact.
- Back up your own notes and authorized files to an external drive or vetted cloud service. CISA advises disconnecting an external backup drive when it is not actively in use.
These steps protect your own records; they do not legitimize a leak or make unknown software safe.
