How to Evaluate Privacy and Attribution Risks in AI Advertising

Evaluate AI advertising by tracing data and purposes, checking consent and user controls, separating modeled attribution from observed conversions, and documenting accountability.
Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Evaluate AI advertising by tracing each data flow and purpose, checking consent and transparency for the relevant jurisdiction, separating observed conversions from modeled estimates, and testing whether user controls, retention limits, and accountability work in practice. AI does not exempt an advertiser or vendor from ordinary privacy and consumer-protection obligations. The workflow below is a practical review framework, not jurisdiction-specific legal advice.

1. Define the advertising system and each purpose

Start with a concrete description of what the system does and where AI affects the process. “AI advertising” is too broad to assess: audience selection, personalization, creative generation, bidding, fraud prevention, and conversion measurement can involve different data, decisions, and risks.

Describe the use before reviewing the model

  • State the business purpose for each operation, such as selecting an audience, adapting an ad, generating creative, or measuring a conversion.
  • Identify which components use AI, what inputs they receive, what outputs they produce, and whether a person or an automated system acts on those outputs.
  • Name the organizations operating each component, including the advertiser, agency, platform, model provider, and measurement vendor.
  • Keep purposes distinct in the inventory. Data collected for measurement should not silently become an input for targeting or model training.

The UK Information Commissioner’s Office (ICO) frames AI data-protection review around risks and controls, including purpose limitation and accountability. Its AI and data protection guidance is UK-focused and should be applied with the relevant local requirements in view.

2. Trace the data, recipients, and retention

Map the complete path from collection to use, onward sharing, and deletion. Include data sent to a model as well as the identifiers and signals used to match people, devices, ad exposures, and conversion events.

  • Compatible Model(s): Magicmoon brand filter only for 24 inch -diagonally measured - widescreen monitor - aspect ratio 16:9 - filter size: width: 20 15/16", Height: 11 13/16" (531mm x 298mm)
  • Superior Privacy: The computer privacy filter makes the screen appear dark when looking at it from an angle (the angle is about 30 to 60 degree), but bright when looking directly at it. To change the privacy level - simply adjust your monitor’s brightness accordingly
  • Eye and Screen Protection: Privacy Filter does not only protect your private life but also protects your eyes by blocking 30% of blue light , blocking the harmful blue light between 380 to 495 nm, it filters out the blue light and relieves eye strain
  • Perfect For Open Workspaces: Great for maintaining screen privacy in open work spaces
  • Includes Two Options: Option 1 uses clear adhesive strips that securely attach to any computer screen. Option 2 (for computer screens with a raised bezel only) uses slide mount tabs that easily stick to the display frame, allowing you to slide the privacy screen filter on and off as needed

Build a data-flow inventory

  • Inputs: account or contact details, device and browser signals, identifiers, conversion events, inferred attributes, and model prompts or payloads.
  • Matching: the identifiers or other signals used to connect an ad interaction with a person, device, or later event; record whether the linkage crosses sites, services, or contexts.
  • Outputs and recipients: predictions, audience segments, generated content, reports, or bidding signals, and every party that receives them.
  • Retention and reuse: how long each party keeps data, whether it is used for model training or another secondary purpose, and how deletion is propagated.
  • Controls and evidence: the notices, consent records, contracts, vendor documentation, and system settings that describe or govern each flow.

Compare actual processing with the organization’s notices and commitments. In its January 2024 post, “AI Companies: Uphold Your Privacy and Confidentiality Commitments,” the Federal Trade Commission (FTC) says privacy commitments apply regardless of where they were made and warns that using consumer data for another purpose without clear, conspicuous notice and affirmative express consent can create legal risk. Do not assume a vendor’s AI feature has a separate privacy exemption.

3. Check legal basis, consent, and transparency by operation

Consent and notice requirements depend on the actual processing and the jurisdiction. Review device access, personalization, measurement, and cross-context sharing separately instead of treating a single consent signal as a universal permission.

Review the applicable choices and disclosures

  • For each region and operation, identify the relevant legal basis and whether consent is required for the data access or advertising use.
  • Check that disclosures explain what data is used, for what purpose, by which parties, and whether it is shared or retained for another purpose.
  • Test whether users can make a meaningful choice and withdraw consent without unreasonable friction; confirm that withdrawal changes downstream processing as intended.
  • Verify that platform-level settings are not being treated as a substitute for the advertiser’s or API caller’s own obligations.

Google’s Privacy Sandbox compliance FAQ, last updated 11 March 2025, says its APIs access data stored on users’ devices. It explains that interest-based advertising is not generally within a strict-necessity exemption under EEA and UK ePrivacy rules, and that API callers remain responsible for consent and clear information. Google also says a user’s decision to enable Topics on a device does not replace the caller’s own consent for its activities. These are Google’s explanations of its platform and the cited EEA and UK context, not a universal legal conclusion for every country. Platform availability and interface behavior can change.

4. Separate observed conversions from modeled attribution

Attribution reports can combine events directly observed by a platform with estimates for journeys where some signals are unavailable. Make that distinction explicit before using the results to judge campaign performance or set automated bids.

Document what the model estimates

  • Define what qualifies as a directly observed conversion and which signals are available for that path.
  • Record what becomes unavailable when consent is denied, what the model infers instead, and how estimates appear in reporting or bidding.
  • Label modeled conversions as estimates rather than directly observed user-level paths. Preserve the distinction in dashboards, presentations, and performance decisions.
  • Review how calibration, changes in consent rates, and model drift could affect estimates and downstream targeting or bidding.

Google Ads Help describes Consent Mode behavior in which denied consent changes tag behavior so tags do not read or write advertising or analytics cookies. Google says modeling uses observable, consented journeys and historical trends to estimate paths for unconsented journeys, and that modeled results can appear in Google Ads reporting and affect bidding. The opened help page does not show a publication or update date, so confirm current platform behavior before relying on it.

Google also reports that consented users are typically 2–5 times more likely to convert than unconsented users. This is a Google-reported finding, with no year stated on the opened page; Google says it varies widely by consent rate, industry, and conversion type. It is not an independent or universal benchmark. The page’s example of 50% consent, a 19% conversion drop, and an 18% modeled uplift is illustrative, not a general statistic.

5. Test user controls and lifecycle safeguards

Check whether the choices described to users work across the full data path, including advertiser systems and vendor-held copies. A browser control or deletion action should not be assumed to remove records already held elsewhere.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Exercise the controls end to end

  • Test whether a user can understand the processing, make a choice, and withdraw consent in the interfaces actually used.
  • Verify how deletion requests and retention limits apply to the organization’s own systems, vendor systems, and downstream recipients.
  • For Privacy Sandbox use, Google documents Chrome controls to turn off APIs, block Topics or site interest groups, and delete ad-measurement data through browsing-data controls; it also describes API-specific deletion mechanisms for callers. Confirm the current controls and test the relevant mechanism for the implementation in question.
  • Check that security measures and access restrictions cover prompts, payloads, outputs, identifiers, and retained logs, not only the model itself.

Use the ICO’s data-protection principles as a review spine: lawfulness, fairness and transparency; purpose limitation; data minimisation; accuracy; storage limitation; security; and accountability. The ICO notes that AI can exacerbate existing risks or make them harder to assess and manage. The controls needed are context-specific, not a complete checklist that applies identically to every system.

  • Easy Installation: Choose between 2 simple Options; Slide-On/Off or Mounted. Not touchscreen compatible

6. Assign accountability and retain review evidence

A privacy review is only useful if people own the decisions and can show how they were made. Integrate the work into existing risk and governance processes rather than treating it as a one-time approval of a model.

Assign named owners and keep records

  • Assign responsibility for the data inventory, consent signals, model documentation, vendor review, deletion, incident response, and performance monitoring.
  • Record the purposes approved, the data and recipients identified, the legal and consent analysis, the controls tested, and the reasons for accepting or reducing remaining risk.
  • Set review triggers for material changes to data inputs, vendors, model use, retention, user controls, or how estimates influence automated decisions.
  • Keep evidence that actual practices match statements made to users. The FTC emphasizes that companies must honor their representations about data collection, use, and sharing.

7. Add the EU AI Act transparency review where applicable

For EU deployments in scope, include Article 50 of the AI Act in current reviews. As of 7 October 2026, the European Commission says the Article 50 transparency obligations apply from 2 August 2026. The Commission published provider and deployer guidelines on 20 July 2026.

The Commission describes provider obligations that include informing people when they interact directly with AI and machine-readable marking of AI-generated or manipulated content. It also describes deployer disclosure duties in specified cases involving emotion recognition, biometric categorisation, deepfakes, and certain public-interest text. Determine whether a requirement applies by examining the system’s role and actual use; do not assume every advertising use of AI is covered in the same way.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Compare implementation options on the risks that matter

When choosing between approaches, compare them using the same questions. The lower-risk option is not automatically the one with the least AI; it is the one whose data use, user choices, uncertainty, and controls are proportionate to the stated purpose.

Review axis Question to ask Evidence to examine
Data access How much personal data is used, and how sensitive is it? Input inventory, inferred attributes, and whether less data could serve the purpose.
Identifiability and linkage Can signals identify or connect people across sites, devices, or contexts? Identifiers, matching logic, and recipient access.
Consent and control What choice is required, and can users understand and withdraw it? Notices, consent signals, settings, and withdrawal tests.
Attribution uncertainty Which conversions are observed and which are modeled? Reporting definitions, model documentation, calibration, and the effect on bidding.
Retention and deletion Can data be deleted within the required period across the chain? Retention settings, deletion procedures, vendor commitments, and test results.
Sharing Which parties receive data or outputs, and for what purposes? Recipient and subprocessor inventory, contracts, and actual data flows.
Transparency and auditability Can the organization explain the processing and substantiate its claims? User-facing disclosures, system records, vendor documentation, and review evidence.
Automated influence How do estimates or AI outputs change targeting, bidding, or other decisions? Decision rules, monitoring, and safeguards against misleading performance signals.
