How to Evaluate License Plate Reader Systems for Privacy, Security, and Public Records Compliance

Evaluate license plate reader systems by following data from collection through access, sharing, retention, deletion, oversight, and potential public disclosure—with California examples clearly separated from nationwide rules.

Evaluate an automatic license plate reader (ALPR) system by tracing its data from capture to deletion: identify who operates it, what it collects, why users may search it, who can access or receive it, how use is audited, how errors are handled, and what records may be requested. The legal rules depend on the state, agency, and record. California offers useful statutory and agency examples, but its requirements are not nationwide rules.

Start with the agency’s role and the system’s data flow

First determine whether the public agency operates cameras or databases, accesses a shared system operated by another entity, or does both. Those roles can carry different responsibilities. California Senate Bill 34 distinguishes ALPR operators from end-users and assigns related but not identical duties to them.

Map the system beyond the cameras. Identify the vendor and every public or private entity that provides, hosts, administers, or receives information. Request or review the system description, contract, usage and privacy policy, and data-flow documentation. A vendor’s description of product features does not establish what a particular agency has enabled or how it uses the system.

What information does the system collect and retain?

Do not assume that “license plate reader data” means only a plate number. Establish what the particular system captures, stores, makes searchable, and associates with a plate reading. Ask for the agency’s description of collection scope and camera deployment, and check whether its policy explains the purposes for which information may be collected and used.

Retention is a separate question from collection. Compare the agency’s written retention schedule with its configured system settings and evidence that deletion occurs. Check for exceptions when data becomes evidence, is under a legal hold, or is covered by another records schedule. California SB 34 requires an operator’s public usage and privacy policy to describe retention and the process for destruction; it does not establish one universal retention period for every system.

The California State Auditor’s 2019 Report 2019-118 found that, subject to exceptions, state law did not specify a retention period for ALPR images collected, accessed, or used by public agencies. That finding is California-specific; it is not a basis for assuming a retention period in another jurisdiction.

Check permitted purposes, users, and query accountability

Find out which purposes authorize a search, who can approve one, and whether the system records enough information to reconstruct how it was used. Under California SB 34, an access record includes the date and time, the queried plate or other query data, the user’s name and affiliation where applicable, and the purpose. Confirm whether those fields are captured for both local and remote users.

Ask how the agency makes these rules work in practice: who approves accounts, what training users receive, how quickly access is removed when a person changes roles, and what happens when a search falls outside an approved purpose. Compare policy language with user permissions, training records, sample access logs, and audit findings where access to those materials is lawful. California’s State Auditor recommended search audits as a safeguard against misuse.

Evaluate security controls and vendor access

California SB 34 requires reasonable operational, administrative, technical, and physical safeguards against unauthorized access, destruction, use, modification, or disclosure of ALPR information. The statute’s categories are not a specific mandate for every technical measure below. Use them as a framework for asking how the agency protects the system and its data.

  • Authentication and data protection: What authentication and encryption measures are in use, including for data transfers and backups?
  • Monitoring and response: Are access events monitored, how are incidents investigated, and how does the agency respond to suspected misuse or disclosure?
  • Vendor and physical access: Which vendor personnel can access systems or data, under what conditions, and how are physical access and secure disposal handled?

Ask for evidence of controls rather than relying on assurances. For example, policies and contracts can clarify vendor responsibilities, while access records and incident procedures can show how oversight is supposed to work.

Trace sharing, exports, and onward access

List the recipients of ALPR information, the purpose and approval process for each kind of sharing, the access or transfer method, and any limits on onward disclosure. Examine private vendor access separately from sharing with other law-enforcement agencies; they present different access paths and responsibilities.

California Department of Justice’s 2023 ALPR Data Guidance discusses California-specific constraints. The Northern California Regional Intelligence Center’s 2024 policy, for example, says the originating agency retains ownership and control as record custodian and describes limits on sharing. These are jurisdictional and program-specific examples, not rules to apply automatically to other states or systems.

Enforcement activity can also change how a particular arrangement is assessed. In October 2025, the California DOJ announced that it had filed suit against El Cajon over alleged sharing with out-of-state agencies. The announcement describes allegations and litigation, not a final adjudicated finding of a violation.

Separate public policy access from access to system records

California SB 34 requires a publicly available usage and privacy policy. That does not mean every raw plate scan, query, log, or investigative record must be disclosed. California DOJ’s 2023 ALPR policy says the department considers applicable privileges and exemptions when responding to a public-records request or compulsory process. The outcome depends on the record and governing law; another jurisdiction may reach a different result.

For a request, identify the agency, date range, and record types as precisely as possible, then assess any applicable exemptions record by record. Depending on the agency and what it maintains, relevant records may include policies, contracts, access logs, audit findings, or system descriptions. A public policy can explain the rules without making operational records public.

Compare systems using the same evidence

When evaluating two or more agencies or systems, apply the same questions to each. Mark whether a point is a legal requirement in the jurisdiction being assessed or a broader evaluation criterion; do not treat a recommended safeguard as a statutory mandate.

Comparison area What to examine Evidence to seek
Collection and deployment What is captured, where cameras are deployed, and which entity operates or accesses the system System description, data-flow documentation, contract, and policy
Purpose and approval Permitted uses, search authorization, and how exceptions are handled Policy, procedures, permissions, and access records
Users and training Roles, training requirements, local and remote access, and account removal Training records and account or permission review procedures
Access logging Whether logs record the time, query data, user and affiliation where applicable, and purpose Applicable legal requirements and representative logs, where accessible
Audits and remediation Audit frequency, scope, reviewer, reporting, and follow-up on findings Audit procedures, findings, and remediation records
Retention and deletion Written schedule, system settings, deletion evidence, and legal-hold or evidentiary exceptions Retention policy, configuration information, and destruction procedures
Security and vendor access Administrative, technical, operational, and physical safeguards; vendor access boundaries Policies, contracts, access controls, monitoring, and incident procedures
Sharing and onward disclosure Recipients, purpose, approvals, transfer logging, and restrictions Sharing agreements, policy, and transfer or access records
Accuracy and correction How potential errors are reviewed, corrected, and communicated to users or recipients Policy, correction procedure, and available records of handling
Transparency and records requests Public policy availability and the agency’s process for handling requests Published policy, request instructions, and applicable disclosure rules

Use California examples without treating them as national rules

California SB 34 is a concrete example of a state law requiring a public ALPR usage and privacy policy and specifying minimum topics, including authorized purposes, staff and training, monitoring, sharing, accuracy and correction, retention, and destruction. It also sets out access-record elements and requires reasonable safeguards. These provisions should not be presented as the law everywhere; the governing state and local rules must be checked for the agency under review.

Agency policies also differ in scope. A California Department of Tax and Fee Administration policy posted with an effective date of September 2026 limits that department’s ALPR use to legally authorized tax and fee administration functions. It is an example of a department-specific policy, not a general rule about other agencies’ retention or disclosure practices.

California Attorney General Rob Bonta said on October 30, 2023: “As technology that helps us protect the public continues to advance, it is important that we put in place safeguards to ensure that this technology is used appropriately and lawfully.” This is Bonta’s policy statement, not an independent finding about any particular ALPR system.

What to establish before reaching a compliance conclusion

A defensible evaluation needs the identity of the state and local agency, its operator or end-user role, the specific system and records at issue, and the current rules that apply. Check current statutes, regulations, court decisions, retention schedules, public-records exemptions, procurement terms, and the agency’s current policy. Without that jurisdiction-specific review, the California examples above can guide questions but cannot establish whether an unnamed agency complies with the law.
