Do not deposit until you can identify the exact legal entity, verify that it is authorized to offer perpetual derivatives where you live, understand who controls and can reuse your assets, and document how withdrawals work. Then assess proof-of-reserves as limited evidence, calculate the complete trading and transfer cost, and inspect contract rules, liquidity, security controls, and outage procedures. These checks reduce uncertainty; they cannot guarantee that a new exchange will remain solvent or available.
- Confirm the contracting company and its regulator register entry.
- Read custody, reuse, insolvency, withdrawal, suspension, and dispute terms.
- Record the date, scope, liabilities, and assurance level of any proof-of-reserves report.
- Model fees, spread, slippage, funding, conversion, network, withdrawal, and custody charges for your actual trade.
- Start with a small test deposit and withdrawal only after the legal and custody review is satisfactory.
Why a new perpetuals exchange needs more than a fee comparison
A perpetuals exchange is not just an order book. It may be your trading venue, collateral custodian, lender, liquidation operator, and gatekeeper for withdrawals at the same time. A low advertised maker fee says little about whether customer assets are segregated, whether a withdrawal can be delayed, or how a position is handled during a market outage.

Perpetual contracts also create risks that do not exist when you simply buy and withdraw an asset. Funding payments accrue while a position is open, leverage magnifies losses, maintenance-margin rules can liquidate positions, and the exchange’s index, mark-price, insurance-fund, and auto-deleveraging systems affect the result. Evaluate the platform in that order: legal counterparty first, custody second, financial evidence third, then operations, market quality, and total cost.

Find the contracting company, not just the brand
Open the terms of service and write down the exact legal name that will contract with you. Record its registered address, governing law, dispute forum, and the entity named on account or custody documents. A domain name, app name, or corporate registration is not itself proof that the entity may operate a derivatives venue.

Also determine which company holds customer assets, runs the matching engine, provides liquidity, and processes withdrawals. A platform can use separate affiliates or an external custodian. Your rights depend on the entity named in the relevant agreement, not on the logo shown in the interface.
Check authorization in your own jurisdiction
Search the current public register of the regulator responsible for the activity in your country or region. Confirm that the entry belongs to the same legal entity and covers the specific service you intend to use: crypto derivatives or perpetual contracts, custody, execution, and any dealing or brokerage activity. A money-laundering registration, a corporate filing, or permission for spot trading does not automatically authorize perpetual derivatives.
Check whether your location, client category, leverage limit, collateral type, or professional-status election changes what is available. The Securities and Exchange Commission’s investor guidance warns that crypto entities may not be registered for securities activities and that investor protections depend on the regulated activity. That warning is not a determination about any unnamed exchange; it is a reason to verify the exact entity and permission yourself.
Read the contract before opening an account
Save a copy of the terms and note the date. Look specifically for:
- the governing law and dispute-resolution process;
- the circumstances in which the account or withdrawals can be suspended;
- the exchange’s right to change rules, fees, listed assets, or leverage;
- liquidation, settlement, and force-majeure language;
- which entity is responsible if a custodian, market maker, or technology provider fails; and
- the insolvency process and any stated priority of customer claims.
If the documents identify only a brand, use vague offshore entities, or leave the custody and insolvency relationship unexplained, treat that as an unresolved risk rather than filling the gap with assumptions.
2. Map custody, reuse, and failure risk
Ask who controls the keys and records your balance
Determine whether the exchange controls private keys directly or uses a custodian and sub-custodians. Ask how customer balances are recorded, whether assets are held in omnibus or individually identified accounts, and which entity can authorize a transfer. An account balance displayed on screen is a contractual claim until the documents establish what property or rights it represents.
Look for segregation and restrictions on reuse
Find explicit language about segregation from the operator’s own assets. Check whether the exchange may lend, pledge, rehypothecate, stake, or otherwise reuse customer collateral. If reuse is permitted, identify the counterparty exposure, consent mechanism, and what happens when a borrower or the exchange fails. “Cold storage” or “institutional custody” marketing does not answer these legal questions.

It should explain whether customers receive the underlying assets, a proportional share of a pool, or an unsecured claim for money. Verify the withdrawal route and limits
Before sending a material amount, confirm every part of the withdrawal process:
- supported blockchain networks and token standards;
- minimum and maximum amounts;
- fixed or variable exchange fees and network charges;
- daily limits, identity-review triggers, and processing windows;
- address-whitelisting and address-change delays;
- what happens during maintenance, congestion, or a security investigation; and
- the procedure for correcting a wrong network or destination.
Use a low-value test only after reading these rules. A successful small withdrawal demonstrates that the route worked once; it does not prove that large withdrawals will remain available during stress.
Use EU custody requirements as a reference where they apply
For crypto-asset service providers within the scope of the European Union’s Markets in Crypto-Assets framework, Article 75 describes custody policies, a client-position register, and custody-agreement details covering the service, security systems, fees, and applicable law. Those provisions are a jurisdiction-specific reference, not a universal guarantee and not proof that an individual platform complies. Confirm the provider’s actual authorization and the version of its customer documents.
3. Treat proof-of-reserves as a narrow snapshot
Record what the report actually covers
If an exchange publishes proof-of-reserves, save the report and capture:
- the measurement date and publication date;
- the wallets and assets included;
- the liabilities included, excluded, or estimated;
- the method used to link customer balances to the asset total;
- the provider’s independence, qualifications, and assurance level; and
- whether the work is a one-time snapshot or repeated on a stated schedule.
Check whether you can verify that your balance was included and whether the liabilities population is complete. A Merkle-tree or other cryptographic inclusion proof can show that one balance was counted in a set; it cannot show that every obligation was disclosed, that assets were unencumbered, or that the same assets were not borrowed temporarily for the snapshot.
Know what it cannot prove
A point-in-time asset total does not describe movements between reporting dates, off-chain obligations, contingent liabilities, customer-asset segregation, creditor priority, or the exchange’s ability to process withdrawals under stress. It is not automatically an audit of financial statements. An audit has a defined scope, standards, evidence, and opinion; a reserves attestation may have none of those features.
The SEC’s Investor.gov investor alert states: “In sum, investors should exercise extreme caution when relying on proof of reserves to conclude that a crypto asset entity has sufficient reserve assets to meet customer liabilities.” Use the report as one data point alongside the legal, custody, and withdrawal evidence, never as a solvency certificate.

Separate evidence types
| Evidence | What it may show | What remains unanswered |
|---|---|---|
| Wallet-address disclosure | Control or access to specified on-chain balances at a time | Liabilities, encumbrances, off-chain assets, and customer priority |
| Customer-balance inclusion proof | That a particular balance was included in a reported set | Whether the full liability set was reported or assets are available later |
| Proof-of-reserves attestation | Results under the provider’s stated procedures and date | Whether the scope equals a financial-statement audit or covers interim events |
| Audited financial statements | Information within the stated accounting scope and audit opinion | Risks outside that scope, future solvency, and terms not disclosed in the statements |
4. Examine security and operational resilience
Look for specific, dated controls
Read the exchange’s security and business-continuity disclosures. Useful detail includes multi-factor authentication options, withdrawal approval controls, address-whitelisting delays, privileged-access management, key-management arrangements, monitoring, incident response, backup procedures, and recovery objectives. A badge, generic claim of “bank-grade security,” or an undated penetration-test logo is not equivalent evidence.

Check whether the platform explains how it will notify customers about maintenance, halted markets, liquidations, security incidents, and changes to withdrawal status. Search regulator notices and independent disclosures for the exact legal entity. Do not substitute a similarly named company’s history for the entity you are evaluating.
Test recovery without risking a material balance
After the terms and controls pass your initial review, create a low-value account and verify login recovery, two-factor authentication, deposit attribution, order cancellation, and a small withdrawal. Keep the test amount small enough that a delay does not affect rent, tax, margin, or other obligations. Never send a large balance merely to discover whether an unfamiliar platform works.
No general checklist can establish an exchange-specific security audit, incident record, or uptime history for an unnamed new venue. If those records are not public, mark them as unknown instead of treating silence as a clean result.
5. Evaluate perpetual-contract mechanics and market quality
Compare the contract rules line by line
| Mechanic | Questions to answer |
|---|---|
| Collateral | Which assets can be posted, how are they valued, and can one position draw on the whole account? |
| Leverage and margin | What are initial and maintenance requirements, tier limits, and position-size changes? |
| Funding | How often are payments made, what index or formula sets the rate, and can caps or clamps change? |
| Mark and index price | Which venues feed the index, how are outliers removed, and what happens if a source fails? |
| Liquidation | What trigger, fee, partial-close process, and bankruptcy-price rule apply? |
| Insurance and deleveraging | How is an insurance fund financed, and when can auto-deleveraging reduce profitable positions? |
| Outages and extreme volatility | Can orders be canceled, funding paused, prices adjusted, or settlement delayed? |
| Settlement | What event ends the contract, which price is used, and how are delisted or suspended assets handled? |
Read the market-specific rulebook, not just the headline leverage number. A high maximum may be irrelevant if your account tier receives lower limits, and a low funding rate observed today says nothing about the rate during a volatile week.
Measure executable liquidity
Inspect the order book and spread for the position size you actually expect to trade. Record the time and instrument, then estimate the average execution price for both entry and exit. Headline volume can include activity that is not available at your size; it does not establish depth, fill quality, or settlement reliability.
Also check whether the exchange can halt a market, cancel orders, widen risk limits, or alter collateral rules. For platforms within the scope of MiCA, Article 76 describes transparent operating rules, fair and non-discriminatory fees, and procedures for orderly trading and settlement. The existence of that rule does not establish that a particular exchange follows it, so compare the published rulebook with the authorization and entity records.

Total round-trip cost = entry fee + exit fee + spread and slippage + funding paid or received + conversion costs + deposit and withdrawal charges + network fees + custody or account charges
Run the calculation for both a normal exit and a forced exit during volatile conditions. A maker fee that looks low can be outweighed by crossing a wide spread, paying unfavorable funding, or paying a fixed withdrawal charge on a small balance. SEC custody guidance specifically identifies transaction and asset-transfer fees as costs to ask about. For in-scope EU trading platforms, MiCA Article 76 addresses transparent fee structures.
7. Compare candidate exchanges on the same evidence

| Access to funds | Networks, limits, review holds, delays, fees, and suspension policy |
| Total cost | Trading fees, spread, slippage, funding, conversion, transfer, network, and custody charges |
Keep “not stated” where a document does not answer a question. A low-cost venue can still have poor custody transparency, while authorization in one country does not create protections in another. An unresolved material item should prevent a large deposit until you obtain reliable evidence.
8. Use a staged deposit process
- Collect documents. Save the terms, custody policy, fee schedule, perpetual-contract rules, withdrawal policy, privacy notice, and any reserves or financial reports.
- Verify the entity. Match the legal name and address to the relevant regulator register and confirm that perpetual derivatives are permitted for your location and client category.
- Map the asset flow. Identify the key controller, custodian, ledger treatment, reuse rights, insolvency claim, supported network, and withdrawal limits.
- Model the trade. Calculate a complete round-trip cost using your expected size, holding period, funding assumptions, and exit network.
- Check market rules. Review mark price, index sources, liquidation, insurance, auto-deleveraging, halts, settlement, and outage procedures for each intended contract.
- Secure the account. Enable strong multi-factor authentication, use a unique password, configure withdrawal protections, and save recovery codes offline.
- Run a small test. Deposit a minor amount, place only the orders needed to verify the workflow, and withdraw to a wallet on the correct network.
- Reconcile records. Confirm the received amount, fees, transaction ID, account ledger, and tax or trading records before increasing exposure.
- Set a concentration limit. Keep only the collateral needed for active positions on the exchange and define a maximum balance you can tolerate being delayed or lost.
Red flags that justify stopping
- The terms name no clear legal entity or shift responsibility among unnamed affiliates.
- A registration is shown without the activity, jurisdiction, or entity that it covers.
- Custody, reuse, segregation, or insolvency language is missing or contradictory.
- Withdrawals can be suspended indefinitely, with no process, notice standard, or applicable limit.
- Proof-of-reserves gives a wallet total but no liabilities, date, methodology, or assurance scope.
- Fees are visible only at checkout, while funding, network, or forced-liquidation charges are unexplained.
- Contract rules allow unilateral changes to index prices, margin, liquidation, or settlement without clear notice.
- The exchange relies on volume claims but does not show depth or executable prices for your instrument and size.
- Security claims are undated, unsupported, or disconnected from incident and recovery procedures.
One red flag may have an explanation. Several unresolved red flags mean the correct action is to stop, not to compensate by depositing less.
What a hardware wallet can and cannot solve
A hardware wallet or other self-custody wallet matters only after you withdraw assets. It can reduce exchange-custody exposure for coins you control, but it transfers private-key, backup, address, and transaction-verification responsibility to you. The SEC’s custody guidance makes that distinction clear: self-custody does not protect assets that remain on an exchange.
Self-custody also does not preserve a perpetual position. A derivative position, margin balance, or unrealized profit stays subject to the exchange until closed and withdrawn under its rules. Keep enough operational liquidity for margin and fees, and treat any balance left on-platform as exposure to the platform’s legal, technical, and insolvency risks.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitchesKeep the review current
Regulatory permissions, supported markets, fees, custody arrangements, and withdrawal rules can change. Recheck the entity register, terms, fee schedule, contract specifications, reserves evidence, and withdrawal status before each material deposit. Record the date and the document version so you can identify what changed.
The result of this process is not a guarantee or a universal ranking. It is a documented decision showing which risks are understood, which protections actually apply to you, and which facts remain unknown. If a material answer is still unknown, do not fund the account.
