Keep a dated record of when you worked, what the platform paid or deducted, and each work-related expense—and preserve the original platform records, receipts, and mileage evidence behind it. Those records can help organize a wage or misclassification claim, but they do not by themselves establish that you were an employee or that a particular expense is recoverable. The rules depend on where and when you worked and what kind of claim you are making.
Start with a dated work-and-pay ledger
Create one chronological spreadsheet or paper ledger covering each platform and each relevant work period. Record what you know from contemporaneous documents separately from later estimates. Include pay amounts and expenses as separate entries rather than combining them into a single net figure.

| Record | What to enter | Useful supporting evidence |
|---|---|---|
| Date and work period | Date; start and end times or online periods; platform; and a short description of the work period. Track time and passenger trips separately if they do not cover the same activity. | Platform trip history, account records, calendar entries, or other contemporaneous records. |
| Miles | Date, beginning and ending odometer readings or miles driven, and the work purpose. Note the method used if you did not record the readings at the time. | Mileage log, trip history, route or mileage records, and odometer records if available. |
| Pay | Gross fare or other gross payment, tips, bonuses, fees or deductions, the date paid, and the amount actually received. | Pay statements, weekly or annual platform summaries, tax forms, and bank deposit records. |
| Expenses | Date, amount, category, work purpose, and any reasonable allocation between work and personal use. | Receipt, invoice, account statement, or other record showing the expense. |
| Evidence reference | Filename or location for the supporting item and a brief note about what it shows. | An index that points to the unedited original file or document. |
The U.S. Department of Labor (DOL) says covered employers must keep accurate records of hours and wages and recommends that workers keep their own records when an employer may not do so. For a rideshare driver, a trip list alone may not show every period the driver says was spent working. Make clear which records show actual trips, which show other work periods, and how any time entry was determined.

Keep original platform records and communications
Download or save platform account records periodically, rather than relying on access to an account later. Preserve original exports and documents without editing them; make a separate working copy for sorting, calculations, or annotations. Useful records may include:
#1 Best Overall
- TRACK MILEAGE AND MORE: Tracking mileage and expenses for work doesn’t have to be a time-consuming chore. With the Portage mileage notebook, keeping track of business expenses is easy.
- EXTRA PAGES: Meant to last the whole year, the Portage mileage log includes 60 pages, 33% more pages than other top brands. This mileage notebook measures 5” x 8”, making it large enough to comfortably fill out while being small enough to fit in a glove compartment, center console or work bag.
- SIMPLE FORMAT: Each page is designed with spaces for the date, business purpose, odometer reading, and total mileage. Plus, our form boxes give you plenty of space to write comfortably.
- DURABLE DESIGN: Built to last, our spiral mileage logbook is constructed with extra-thick paper and a stiff backing meant to stand up to daily use.
- RECORD ON YOUR TERMS: Whether you need to track actual expenses or just mileage for a flat deduction rate, this journal has you covered.
- Trip histories and route or mileage records.
- Weekly or annual summaries, pay statements, and account notices.
- Messages about pay, fees, work requirements, expenses, or account status.
- Tax forms issued by a platform and records showing payments received.
These materials are evidence to reconcile against your own ledger, not necessarily a complete record of every hour, payment, or expense relevant to a claim. Keep a simple index so you can locate the original item supporting each entry.
Document vehicle and other expenses without assuming they are recoverable
For every expense you include, retain the receipt or statement and note when it occurred, what it cost, why it related to the work, and whether it also served a personal purpose. IRS materials identify mileage logs and receipts as useful records for travel and car expenses. Keep records for expenses genuinely incurred; do not characterize a personal cost as wholly work-related without a supportable basis for allocating it.
Rank #2
- Vehicle use: Keep dated mileage entries with miles or odometer readings, trip purpose, and available platform trip information.
- Fuel, maintenance, and repairs: Retain receipts or invoices and note the vehicle and work period involved.
- Tolls and parking: Save receipts, statements, or transaction records and identify the related date or trip where possible.
- Phone, rental, and other costs: Keep bills or agreements and document the work-related portion if the item was also used personally.
A mileage logbook can be a practical way to organize entries, but it does not replace platform exports, receipts, or a suitable digital record, and it does not prove that a legal claim succeeds.

Reconcile platform summaries, tax forms, and money received
Compare your ledger with platform summaries, Form 1099-K or other tax forms, and bank deposits. Explain differences instead of forcing the records to match. For example, a platform’s gross-payment figure may differ from a deposit after fees or deductions, and the ledger may separately show bonuses, cash tips, multiple platforms, or payment dates that do not line up with trip dates.
Rank #3
The IRS describes Form 1099-K as a gross-payment reporting document and advises using it with tax records to determine what was received and what expenses may be deductible. A 1099-K is not, by itself, a complete account of net pay or a decision about employee status under wage law. Tax reporting as an independent contractor likewise does not decide a wage-law classification question.
Handle missing records transparently
If a platform record, receipt, or time entry is missing, mark the gap in the ledger. If you later reconstruct information, identify the source, the date you made the reconstruction, and the method used. Do not present an estimate as though it were recorded contemporaneously, and do not alter an original export or receipt.

DOL guidance says workers who may be misclassified or off payroll may want to create their own records of hours or days worked, amounts and methods of payment, and payment dates. Keep copies securely and share only records relevant to the claim.

Under federal wage law, FLSA protections depend on employee status and coverage. Classification is not decided just by the label in a contract, a platform’s tax form, or the fact that work is performed through an app. DOL’s January 2024 announcement described a six-factor economic-reality analysis: opportunity for profit or loss, worker investment, permanence, control, whether the work is integral to the potential employer’s business, and skill and initiative.

The enforcement landscape has changed over time. On May 1, 2025, DOL said Wage and Hour Division investigators would not apply the 2024 rule in current enforcement matters while the Department reviewed it and litigation proceeded; investigators would use longstanding principles and a reinstated virtual-marketplace opinion letter. That 2019 letter addressed a particular virtual-marketplace company’s facts, so its conclusion is not a universal classification decision for rideshare drivers.
DOL’s rulemaking page reported a proposal dated February 26, 2026, with an April 28, 2026 comment deadline. That information does not establish what happened after the deadline. Anyone relying on the current federal test or enforcement position should check the official rulemaking docket and relevant litigation for later developments. State and local laws may use different classification tests or provide different expense-reimbursement rights.
Identify the right claim before calculating what you seek
A wage claim, a reimbursement demand, a tax question, and a worker-classification dispute are not interchangeable. The records needed, the deadlines, the forum, and whether an expense can be recovered depend on the governing law and facts. Before treating a ledger total as an amount owed, identify the state or locality, platform, dates at issue, claim forum, and the specific pay or expense categories in dispute. Documentation supports a timeline and calculation; it does not alone establish entitlement.
