When it is safe, make a factual account, preserve original material without changing the only copy, and keep a simple index of what you have and where it came from. The right reporting route and rules for collecting or sharing information depend on your location and circumstances.
Start with safety, not evidence gathering
You do not have to build a case by yourself. UK Home Office statutory guidance says: “However, it is important to remember that victim safety is paramount and it is the job of the police to build the case on behalf of the victim, and not the role of the victim to build the case for the police.” That guidance is about the UK prosecution context; it is not a universal rule about every workplace or jurisdiction.

Before making a record, consider who might be able to find it. A shared device, account, or physical space may make an otherwise useful record unsafe. If you are concerned about discovery, discuss safe record keeping and support options with an appropriate specialist service. Do not move sensitive material to another account or device unless you have considered whether that could also be monitored or discovered.

What to write after an incident
When it is safe to do so, make a dated note as close to the event as you reasonably can. Record what you remember rather than trying to prove a conclusion. Ontario’s workplace complaint form, for example, asks for details such as names, witnesses, location, date and time, and the behaviour or words used.

Use a consistent incident-note format
- Date and time: Include the time zone or say if the time is approximate.
- Location or setting: Identify where it happened, including the platform or channel if it was online.
- People and witnesses: Record names where known and distinguish people who were present from people you told about it later.
- What happened: Describe words or actions as you remember them. Use quotation marks only for words you believe are exact; otherwise say that you are paraphrasing.
- What you observed: Separate observable details from your interpretation. If you are unsure about a time, wording, or identity, mark it as uncertain rather than filling in a gap.
- Immediate follow-up: Note any related message, report, response, or material, and when it occurred.
Keep later additions distinguishable from the original note—for example, by dating each addition. Do not revise an earlier account to make it sound more certain than you were at the time.
Preserve messages, emails, photos, and documents
Keep relevant source material in its original form where possible. If you need to sort, highlight, or explain an item, do that on a separate copy rather than changing the only original. Record when and how you obtained the material and who supplied it, if known.

The U.S. Department of Labor’s Employee Benefits Security Administration (EBSA) Enforcement Manual describes evidence considerations for investigators this way: “To pass this test, the evidence must be authentic, relevant, unaltered, and untampered with.” This is an investigator manual, not a guarantee that any particular item will be accepted as evidence or prove an allegation.

Keep a simple evidence index
An index helps you find material and explain its origin without adding unnecessary copies or circulation. Give each item a neutral label, such as “Item 01,” and record:

- when it was created, received, or copied, if known;
- who supplied it or how you obtained it;
- where the original is kept; and
- whether you made a working copy or added notes to a copy.
Keep identifying details private and share them only with people or services who need them. Confidentiality is not absolute: Ontario’s workplace guidance recognizes that investigation information may need to be disclosed for defined purposes or where the law requires it.
Choose a record format by weighing safety and access
No single storage method is established as safest for everyone. Choose only a method you judge safe in your situation, and consider discoverability, whether original material remains unchanged, how readily you can retrieve it, and who else may gain access.

A bound diary is an option, not a requirement, and the cited guidance does not establish that paper is more secure or legally superior to an electronic record. If keeping any record feels unsafe, seek advice from a relevant support service rather than taking a risk to preserve it.
Reporting depends on the setting and location
Workplace complaints
Use the applicable employer or local reporting process if you decide it is safe and appropriate to report. Rules and investigation duties differ by jurisdiction and employer. Ontario’s government workplace harassment resource says it “does not replace the Occupational Health and Safety Act (OHSA) and its regulations and should not be used as, or considered, legal advice.” Ontario’s code of practice says investigation records should be retained for at least one year in that context; that is not a general retention period for personal records or complaints elsewhere.

Stalking, harassment, or abuse
When appropriate and safe, discuss documentation and reporting with police or a relevant specialist support service. The UK guidance about police building a case applies to its own context; do not assume procedures are the same in another country or for an internal workplace investigation.
Be cautious about recording or obtaining information
Taking notes about what you experienced is different from recording a conversation, accessing another person’s account, or collecting records you may not be entitled to obtain. These actions can raise separate legal issues. Rules vary by location and circumstance, so check with a qualified local source before recording calls or trying to access someone else’s information. Do not treat a recording or a copied file as automatically lawful, admissible, or conclusive.
