Before contacting HR, write down what you were paid, what you expected, the dates involved, and the record that supports your expectation. Keep the account factual, compare the same pay component and period, and mark anything you do not know. A pay mismatch is worth checking, but it does not by itself prove discrimination or another legal violation.
Start with a dated, factual timeline
Record the pay period or compensation effective date, when you received or learned about the decision, and when you noticed the difference. Separate what you personally saw in a pay statement or letter from what someone else told you. Use neutral descriptions such as “the statement shows” or “I expected” rather than assigning blame.

The EEOC’s worker-facing Pay Discrimination resource advises employees to keep records of what they are paid and what type of work they do. A short timeline makes it easier to explain the question without relying on memory.

Gather the records you can lawfully access
Collect only materials relevant to the discrepancy and keep them securely, in line with workplace confidentiality rules. Do not take personnel, customer, or business records that you are not authorized to access.

- Schedules, approved timesheets, and personal notes of hours worked when the question concerns hourly pay or overtime.
- Written communications about a raise, promotion, performance decision, or pay calculation.
- The policy or plan language you believe applies, with its title and date.
For covered nonexempt workers, U.S. Department of Labor (DOL) federal recordkeeping rules include fields such as hours worked, pay basis and rate, earnings, additions and deductions, wages per pay period, payment date, and period covered. Those rules do not answer every state or local pay-statement question, and they do not give an employee automatic access to every internal employer record.
Compare the same pay component and period
Identify precisely what differs: base pay, overtime, a bonus, commission, a benefit, or another form of compensation. Match the period or effective date before comparing amounts. Include hours and rate where relevant, and distinguish gross pay from deductions and net pay.

For an hourly or overtime question, list the days and hours worked, rate, overtime hours, gross amount, deductions, and net amount shown in the records you have. DOL provides a printable work-hours calendar; it can help organize a personal log, but it is not a substitute for original pay statements or employer records.

If comparing roles or another employee’s pay, record context carefully
A job title alone does not show whether two jobs are comparable. Note duties and responsibilities, work location, hours, experience, seniority, and known performance or salary-grade factors only when the information is lawfully available and relevant. Label unknowns as unknown rather than filling gaps with assumptions. Do not seek confidential employee files.

EEOC investigation guidance describes materials that may be relevant when an agency investigates compensation, including job descriptions, work performed, compensation policies, and possible explanations such as education, experience, seniority, salary grade, or performance. That does not mean employees are entitled to every internal record before speaking with HR.

Ask which policy or calculation applies, whether HR needs any additional information from you, and when you can expect follow-up. Afterward, note the conversation date, who you spoke with, the explanation given, and any next step or expected date.

Understand what a discrepancy does—and does not—show
Compensation can include more than salary. EEOC materials describe compensation to include overtime, bonuses, stock options, profit-sharing, insurance, leave pay, and other benefits or remuneration. A difference in any of these items may be worth asking about, but the difference alone does not establish unlawful treatment.
Federal protections depend on the legal issue. The Equal Pay Act addresses sex-based wage differences for substantially equal work in the same establishment and recognizes statutory defenses. Title VII, the Age Discrimination in Employment Act, and the Americans with Disabilities Act address compensation discrimination on their respective protected bases under different frameworks; their comparator and establishment requirements are not identical to the Equal Pay Act. These distinctions cannot determine an individual case from a pay comparison alone.
The EEOC says covered federal EEO laws protect people against retaliation for opposing compensation discrimination or participating in covered proceedings. If you are concerned about a later workplace event, make a separate factual note of what happened and when; whether an event is unlawful retaliation depends on the circumstances and applicable law. State and local rules may also apply, so consult the relevant labor agency for requirements beyond the federal sources described here.
