Choose single opt-in when a shorter signup path matters most; choose double opt-in when you want an extra check that the address is reachable and the person confirms the subscription. Neither method is universally required by law, and double opt-in does not guarantee better deliverability. The right choice depends on your audience, applicable rules, email platform, and how much signup friction you can accept.
What is the difference between single and double opt-in?
With single opt-in, a person submits your signup form and is added to the subscribed audience immediately. With double opt-in, the person must also click a link in a confirmation email before being added. Mailchimp describes the distinction in those terms in its opt-in comparison; HubSpot also describes double opt-in as an additional confirmation step.

| Factor | Single opt-in | Double opt-in |
|---|---|---|
| Steps to subscribe | Submit the signup form. | Submit the form, then click the confirmation email link. |
| Signup friction | Lower: no email confirmation step. | Higher: the person must find and act on a follow-up email. |
| Address check | No confirmation click is required to join. | The click provides an additional check that the person can access the address and intends to confirm. |
| What it establishes | A form submission and whatever consent record your process captures. | A form submission plus a confirmation action; it does not replace clear signup language or other compliance duties. |
How to decide which method fits
Choose single opt-in for a simpler signup path
Single opt-in may fit when you prioritize a quick, low-friction subscription and faster audience growth, and your signup and permission process meets applicable law and your provider’s rules. The trade-off is that there is no required email confirmation click before the address joins the subscribed audience.

Choose double opt-in for an added address and intent check
Double opt-in may fit when you want an additional confirmation step, are seeing spam signups, or want a more verifiable record of the subscriber’s action. Mailchimp recommends considering it in cases such as spam signups, low open rates, or abuse complaints. Those are vendor recommendations, not a promise that changing the setting will fix performance.

Do not use opt-in choice as a deliverability guarantee
A confirmation click can help filter some unwanted or invalid signups, but the sources cited here do not establish a specific improvement in inbox placement, engagement, or complaint rates. Do not choose double opt-in on the assumption that it guarantees delivery or a measurable performance lift.
Check the rules for your audience and sending platform
There is no universal legal rule in the cited sources requiring double opt-in everywhere. Requirements depend on the recipient’s location, the type of message, and the circumstances of collection. A platform may also set permission standards for use of its service that go beyond or differ from the legal minimum.

United States: CAN-SPAM is not a general opt-in mandate
The FTC says CAN-SPAM does not impose a general opt-in requirement for commercial email, but its other rules still apply. Marketing email must provide a clear and conspicuous way to opt out, and opt-out requests must be honored within 10 business days. The FTC also explains that prior affirmative consent exempts a message only from the ad-identification requirement, not the rest of CAN-SPAM. See the FTC compliance guide and its CAN-SPAM questions and answers.
United Kingdom: PECR has specific electronic-marketing rules
The UK’s PECR rules include distinct requirements and specified soft-opt-in situations; they do not amount to a simple universal double-opt-in rule. In qualifying soft-opt-in cases, the ICO says the recipient must have a simple opportunity to opt out when their details are collected. Its guidance states that a charitable-purpose soft opt-in commenced on February 5, 2026, subject to specific conditions. That route does not apply to every UK marketer or every situation. Consult the ICO guidance on PECR electronic-mail marketing.

Platform policy is a separate check
HubSpot requires verifiable permission for marketing email sent through its tool and distinguishes implied from explicit consent. It lists written permission, a form checkbox, and confirmation through double opt-in as examples of explicit permission. HubSpot also cautions that local law may add requirements. Read its pages on email opt-in consent and setting up double opt-in; these describe HubSpot’s platform rules, not legal advice.
Quick Recap
Best Value
Set up a clear, verifiable signup flow
- Describe what people are signing up for. Identify the kind of marketing email they will receive at the point of signup. Do not rely on a confirmation click to clarify an ambiguous form.
- Record the person’s action. Keep a record of the signup and the permission action your process captures. If using double opt-in, include the confirmation action in that record.
- Make the next step understandable. A confirmation email should identify the sender and purpose and explain what the recipient needs to do. Avoid making the confirmation link’s purpose unclear.
- Keep opt-out handling in place. A confirmation step does not replace unsubscribe handling or any other rule applicable to your audience.
- Check the platform’s actual signup paths. Mailchimp documents an audience-level email opt-in setting for choosing single or double opt-in. Its double-opt-in email-contact feature applies to Mailchimp signup forms, so verify current behavior for integrations or APIs before relying on it.
- Address automated submissions separately. Mailchimp describes reCAPTCHA as a separate measure to filter fake submissions on hosted forms and suggests enabling it for embedded or pop-up forms if appropriate. It is not a substitute for choosing and implementing an opt-in process.
A quick decision checklist
- Choose single opt-in if you value fewer steps and faster subscription, and your permission process meets the relevant legal and platform requirements.
- Choose double opt-in if an extra address confirmation and recorded confirmation action are valuable enough to justify the additional step.
- Check rules for the locations of your recipients rather than assuming one country’s standard applies to everyone.
- Review your email provider’s current consent policy and the behavior of the exact form, integration, or API you use.
- Do not treat either option as a substitute for clear consent language, permission records, opt-out handling, or other applicable requirements.
